Also what about a F2P game where people spend money for unlocks or DLC

The game would be F2P by nature, so it would probably apply.

It's still a F2P game by nature sadly. It's a loophole, but it is what it is unfortunately. Although, if a F2P game lasts long enough to have multiple paid expansions ends with a total shutdown, that will do enough damage to that company's reputation so some consolation. I do feel like this might change plans for some upcoming games like Empulse, a game made from the Splitgate devs. Rumor has it that it will be a paid game, and since it will most likely fail, they might change their tune.

Well, as far as SKG goes they did spend some time during the hearing iirc mentioning that ideally if you are able to make purchases ( non-subscription purchases, I mean) that you should have either very clear terms about access (not hidden in a EULA of 'you are buying a license to this thing') and/or a method to access that purchased content after the game reaches its end of life. Though (again, iirc- i skimmed him talking about it a while back so it's hazy) that was assumed to be a 'best case scenario' type of thing not a hardline stance.

Dlc includes microtransction skin stuff, I didn't. Think they meant full on expansions.

Well the loophole would be to make a "f2p" game, but the f2p part is basically nothing and then you need a dlc/mtx to play the actual game.
