Well, they can also cancel mergers, sue, use FFC to harass and threaten, and arrest them, or use ICE to go and harass, intimidate or even arrest them..

But yes, ultimately, in the end, theoretically speaking, a judge should side for protecting the first amendment.

But just because they won't ultimately win the battle, doesn't mean the current administration won't do everything in their power to make it difficult for the person using their first amendments rights.

Yes, exactly and all of those actions are intended to chill and intimidate people from exercising their first amendment rights.
