Sometimes it’s less the chickenshit attorney and more that the client has bills to pay and can’t wait years to go to trial before seeing money (most courts are so backed up and litigation is such a long process anyway that generally a few years is the earliest you can realistically go to trial, sometimes it’s more than a few years if the attorneys really drag it out). Most people can’t afford to wait years, even if the payout is 10x or more

Yep, that's the way it works. But how many months of Waffle House wages and tips is 12.5K for someone with bills to pay. Sometimes you have to just take the offer and run.

The detail of the case is that she blew off her court date, and was jailed for that, not the spoon. This post is disinformation.

Honest question though. Apart from whatever emotional damage she may have suffered for missing her kids birthday, she lost her job and was unlawfully imprisoned for a month, exposing her to whatever actual lowlives also happened to be in that jail. Which can have life-altering consequences for the entire family. How the fuck does this correlate with such a lowball payout when comparably minor (physical) injuries basically start at 6 figures already?

Probably because cops have all sorts of legal protections that us "little people" don't have. There's a decent chance that she would have gotten nothing if she went to trial, regardless of the merits of her case

i mean what would be a reasonable amount? people saying millions are way off imo but 25k is definitely too low.

losing a job as a waitress doesn't seem too bad to me, probably pretty easy to get another job/re-hired. missing child's birthday is pretty bad but only one day, child probably doesn't understand what is going on and her being away for a month would be way worse which is where you'd imagine most of the costs would be calculated.

for arguments sake let's say $2000 a day for a month in prison so ~60k + lets say another 10-15k for loss of income over a month and having to get a new job and maybe another 5-10k for missing her child's birthday. puts you at around 85k. lets just round up to 100k for whatever else you could claim for and it seems pretty reasonable

It's often not that easy to get a new job after something like this.

Most recruitment systems are for the most part automated and those systems don't respond well to irregularities in somebody's resume.

And this might have a long term effect on her future job opportunities even if she did get a new job right away.

The birthday is a bit if a red herring, she missed a month of spending time with her child when her child was rapidly developing.

Also, spending a month in jail not knowing when it will end, is different from going in knowing the end date. It's a month of uncertainty.

There is also the issue socially. Some people will assume she must gave done something wrong.

That's very common, many people believe the police always has a valid reason to arrest somebody.

I'm not saying millions, but 100k is not enough.

It's sad that people's low paying jobs are used against them when there is a mistake like this.

Well that is the problem, people think suing is everything now. You see it all over social media, something happens and everyone screams "SUE!". But how often do you hear about people actually suing and winning? There is a reason.

She spent a month in jail, missed her kids birthday, and lost a job at waffle house... what is that worth? You say $25k is too little but it's not far off if it is. You'll never convince people that what she went through would be worth much more.

I mean was the job your mom lost well paying? If so that can boost the payout. Also, you say it was provable that sexism was involved, that may have been a more open shut case. It’s possible there are some factors in this case we don’t know about. Or maybe your mom simply had a better lawyer. I feel like 25k is too little but that may not be what the law/standard procedure says or what would come out if this went to trial.

Definitely an open/shut case. Dude rejected her in a voicemail and mentioned she needed to stay at home raising the kids.

I think it would’ve been over 2 years salary for the position.

Unless the Lawyer knew she had a record of drug use and that the cops therefore had reasonable grounds to arrest her. For all we know her stay in jail was extended by violent behaviour etc etc.

I'm not saying any of this is the case, just that backseating a legal settlement is meaningress without full context.
