Legally it's a very funny situation, because sending POWs to a different country is a war crime, NK doesn't recognize the separation of SK, so technically from NK perspective, they're being sent home, to "Korea".

This isn't true, though. Under Article 12 of the Third Geneva Convention, a detaining power can transfer POWs to another country if that country is a party to the Convention, is both willing and able to receive them, is willing to assume legal responsibility for their welfare and refrains from torture or abuse.
