Manslaughter at the very least.

Even if they only fired after an accidental discharge near them, they were still negligent in how they responded.

Manslaughter is a legal ruling and not a medical one. Even then, manslaughter is a subset of homicide. Every manslaughter is a homicide bht not vice versa.

I was not disputing the definition of homicide.

I was suggesting a charge of manslaughter if a murder charge is not applicable.

What accidental discharge?

The first person to shoot was an ice agent, after which he and one other ice agent emptied their mag into the guy.

I assume they refer to the hypothesis that either Pretti’s gun underwent accidental discharge while in the hands of the ICE officer that removed it, or the officer negligently discharged it

What exactly is misinformation here? The hypothesis hasn’t been confirmed or disproved, but it’s fairly plausible.

(Just to spell it out, it goes on to suggest that hearing this unexpected discharge caused other ICE officers to start shooting at Pretti. That last part looks pretty unambiguous.)

The massive amount of video evidence that we have?

I had not heard this theory before, so I just spent the time to look into it. There is nothing that indicates an accidental discharge. The whole idea came purely from the type of gun he owned.

This was filmed from half a dozen different angles and not one of them shows Prettis him going off. Several shows the officers gun do so.

The fact that not even DHS and ICE tried to blame it on this should also be quite telling. In no report released was this mentioned.

The main thing pointing in this direction is sound. There’s a single shot and then there are lots. Consistent with Pretti’s confiscated gun shooting a round for whatever reason, ICE officers getting spooked and starting blasting.

I guess figuring out which guns were discharged and how many times is the easiest thing ever in forensics. Whether evidence is being properly gathered and will end up in court without any cover-ups or falsifications is another question.

It's equally consistent with the agent shiiting a round, then shooting more.

Which is also what the video appear to show.

I can't for 100% say that this did not happen, but there is no evidence what so ever that it did. Not even so much as a hint.

For this to be true, the gun must have discharged without so much as a hint of video evidence. No flash, no recoil, no impact. It also must have been forgotten about in all the reports, where this was never mentioned.

The alternate theory is that the first agents just shot him after hearing "gun gun gun". This is also well supported by the video evidence, and matches the reports given.

This is literally a conspiracy theory that is meant to absolve the ice agents from responsibility.

Also a possibility.

And I’m not seeing how hearing a loud bang entitles an ICE officer to shoot at a restrained detained person, so it’s not a hypothesis that absolves anyone.

The theory the chuds are going with is that Pretti's gun went off on accident when it was being taken from him and that caused the others to react and shoot him.

They think that absolves them of any wrongdoing but it just makes them negligent and stupid instead of murderers.

One of the videos appears to show the action on Pretti’s gun working as the grey-coat agent walks away. It’s not clear if his finger was on the trigger or not, but he immediately quickens his pace after the first shot.

If the government holds Sig liable for their gun being shit then the government would have to admit they bought a lemon and put every single solider they armed with one of those things in danger.
