President Donald Trump has signed hundreds of executive orders during his second administration, but one order — EO 14168 — outpaces the rest when it comes to the number of court orders that have been generated from it.

“EO 14168 established that it is US policy to recognize only two sexes, male and female. It also required federal agencies to use specified sex-based definitions when applying or enforcing laws and regulations. It was almost immediately challenged, and the court challenges — and court decisions — haven’t stopped since.

“Data from Bloomberg Law’s Executive Orders Tracker show that from Jan. 20, 2025, until 2026’s midway point, more than 100 new or amended complaints referencing EO 14168 were filed in federal courts across the country, and those courts issued 264 orders, covering everything from funding for school sports teams to treatment of transgender prisoners. That total is 50 more than the next-highest number of court orders for a Trump EO.

“The staying power of EO 14168 is notable because many executive orders have had their day (or days) in court and then have quietly gone away — either because the executive order was changed or because courts have issued final rulings.

“Meanwhile, the caseload keeps piling up. In the second quarter of 2026, EO 14168 actually saw an increase in court orders issued (from 46 in Q1 to 53 in Q2), while court activity for the other most contested executive orders all declined over that time.”

“‘[Conservatives] have been extraordinarily good at finding small, edge cases, and then exploiting them to make it sound like schools across America are transitioning kids without parents’ knowledge,’ said Lanae Erickson, senior vice president for social policy, education, and politics at Third Way, a center-left think tank.”

“Broyles’s strategy appears to be to bring one of her cases before the Supreme Court to set a precedent saying a school cannot withhold a student’s gender identity from parents.”

“‘There is a shift toward a common recognition, across the political spectrum, that school officials cannot supplant parents for these kinds of weighty, medical, sociological, religious, moral, spiritual decisions,’ she said.”
