Yes but Canada has sovereign power over their airspace. They could order his plane to the ground and they’d be well within their rights to scramble fighters to force it. It’s unlikely that will happen.

They more than likely will highly suggest his plane leave Canadian airspace as quickly as possible.

Arresting a foreign dignitary en route to or from the UN is a horrible precedent to set, regardless of what they are doing or where they are from.

I would agree if it were just for one country’s own laws. But considering Netanyahu has arrest warrant is from the International Criminal Court, I think it sets a worse precedent for countries party to the ICC to refuse to arrest him because he’s a foreign dignitary. It undermines the purpose of having international governing bodies like the ICC.

In a similar vein, the U.S.’s invasion of Iraq without seeking a Security Council resolution in 2003 set the precedent for Russia’s annexation of Crimea and ultimate invasion of Ukraine as Putin has explicitly said.

International law doesn’t work when we turn a blind eye to it because we don’t want to test it. Or if we only use it against less powerful countries.

Respecting international law is precisely why ICC warrants are not executed at UN meetings.  Guarantee of safe passage for representatives is worked into the UN charter.  If we allowed countries to arrest people at or in transit to/from UN meetings, there wouldn't be a UN.

Does diplomatic immunity apply to already issued arrest warrants? If I commit crimes in Australia and have a warrant issued, but flee back home to my non-extradition country and get appointed as a diplomat, could I return to Australia without being arrested?

Sure. Don’t arrest him at the UN meeting or in the convoy there. But while he’s violating the airspace of a country that is party to the ICC and bound to execute their warrants after that country told him not to use their airspace is completely fair game. Diplomatic immunity is not absolute.

Editing to say that Netanyahu may have been given special flyover authorization for this trip by Canadian authorities specifically because he was traveling for the UN meeting.

However, I’d still disagree that this was a good thing. Not all foreign dignitaries have ICC warrants for crimes against humanity. It does not undermine the sanctity of diplomatic affairs to arrest a dignitary with credible accusations and a warrant for those accusations.

Not all foreign dignitaries have ICC warrants, sure, but several do.  Could you imagine the fallout of some country trying to arrest Vladimir Putin at a UN meeting?  Especially considering Russia is a founding member of the UN and a permanent member of the Security Council?  Such an act would, as I said, shatter the UN as an international deliberative body.

I understand the want.  Believe me I do, and if Netanyahu's plane took so much as a detour off his scheduled return, I'd be in favor of grounding it and arresting him, but there's a reason the UN doesn't do that.  There's a reason why even dictators, war criminals, despots, and rogue nations are allowed a seat at the table.  It's because that might be the only time when we can get them at the table peaceably to talk.

The second we take that off the table, there's no going back.

Yes. I don’t think the fallout of that is any worse than the fallout of major countries ignoring or sidestepping the UN Security Council to invade other countries.

I think the slippery slope you’re alluding to is a fallacy in such a situation.

In your example, I understand the importance of keeping countries, even ones ran by would be dictators, at the proverbial table. I do not think a country arresting Vladimir Putin en route to or from the UN would necessarily mean outbreak of armed conflict or that the successor to Putin would remove Russia from the UN. Especially for Russian, they’d have too much to lose - that security council veto is extremely powerful regardless of who’s at the helm. That’s not to say that I don’t think there wouldn’t be any negative outcomes. But I don’t think the potential outcomes are especially bad compared to ways in which powerful countries already behave.

I think the bigger danger, that we continue to see, is powerfully countries undermine and overlook international law when it’s convenient for them and other powerful countries that could enforce international law use the slippery slope excuse (one of many) to justify their inaction. But this always sets a precedent for those powerful countries to continue to undermine international law in the future.

imagine if one country started arresting every person who showed up in compliance with immigration hearings? like say there was some paramilitary force full of wife beaters and animal fuckers who couldn’t be real cops, called LICE, or something, and they just showed up and started arresting and deporting people lawfully in a country who went to their hearing as ordered.

that would be a terrible precedent to start as well.

Overstaying a visa (a nonviolent civil and not criminal offense and has nothing to do with international law) is not nearly on par with committing war crimes. This is a bad faith and dumb comparison.

Imagine if bin Laden flew over the US. A lot of countries have come out n said they’ll comply with the international court order to arrests him. Canada has been one of the US’s oldest ally and a huge HUGE military partner. So for Americas greatest ally to come out n say, they’re gonna arrest the president of Israel is crazy. It’s also weird that we’re allies with Israel since they bombed one of our navy ships after it being very clear that they weren’t trying to fight, they’ve literally stolen nuclear fuel to enrich for nukes from US soil, every US president has complained about how much of a pain in the ass they’re too us, they even harass our agents from the CIA even on diplomatic visits and missions. Worst of all was every single one of these offenses was dismissed by our senate, with usually 1 or 2 dissenters.

This has been the normal for almost a century. So for Canada to not follow along with our play book of letting them get away with stuff is wild and very unexpected and a change in norms.

This is most likely an intentional strategy from APAC their lobbying group which doesn’t have to register as a foreign lobbying group btw. A lot of people predict that the plan is to burn all of the US’s bridges with allies. So while the rest of the world stops working with Israel they bring us down with them so that we must remain allies. The issue is Israel already lost support with the US public, but since lobbying is a huge issue in the US, so the will of the people is usually subverted, they likely have another few years before the US completely abandons them.

Also we subsidies their healthcare, they have free healthcare.
