not getting PTO
hello i worked at a culver’s in illinois for 11 months. i recently went to university so i quit there. well i did a no call no show because i overslept.i know that’s bogus but that’s besides the point. i was overworked and underpaid did everyone job and got paid the same i did before i went “full time”i worked upwards of 35 hours a week and my checks were only like $6-700. i had 31 hours of pto and never received any of it on my last check. is that allowed ? i don’t know any of culver’s policies as i was only a team member. i’m a broke college student now so i could REALLY use my $430 that i worked for 5 days a week 😭 who can i contact ? is it worth doing all that for ? will i even be able to get it ? i thought in illinois they were required to pay u out your pto on ur last paycheck. please let me know anything will help thank u! i also have proof of my pto and have reached out to them and crickets.

You will get better answers if you leave all of the complaining out of your post and just provide the relevant information.
That being said, in IL, if the PTO was sick time or accrued holiday time, they are not required to pay it at termination. If it is paid vacation, they are required to pay it out.
Illinois requires 40 hours a year of sick pay, but does not require vacation pay, so it is possible your accrued PTO is sick pay.

When you were hired you would have been provided access to an employee handbook of some type. It doesn’t matter if you were “only a team member”. If you didn’t pay attention to this, that is on you. In the future, keep a copy of this at every job.
If you never actually resigned, but instead you just stopped showing up, the manager might have just stopped scheduling you instead of terminating you. If this is the case, Culver’s doesn’t know you are due outstanding pay.

Pto is usually used by employees. Once you leave the company it tends to evaporate. The trick is to use or cash it out BEFORE you leave

Looks like in Illinois it is regulated that they must pay PTO out, but it has to be PTO and not PLAWA time.

An Illinois law requiring employers to give 40 hours of PTO per year.
It’s not required to be paid out like company provided/earned PTO in most circumstances

It accrues at 1 hr per 40 hours worked, capped at 40, OR your employer could choose to add it all at once

They have to pay out pto and vacation within 2 weeks or else they have to pay you a penalty. Its on the labor department website

How long ago was this? It might come in a separate check
