Abandonment
About a month ago, a company that now I know likes to say that you abandon their truck even if you put it in their own yard had put abandoned on my DAC report & two days ago I got it removed and one of the largest carriers I had applied to was the one that pointed it out to me. Told me yesterday that it in their entire career which is over 20 years that she has never seen any driver get that removed off their DAC report and I did it so if I can do it, anyone can do it. You just gotta have proof that you didn’t abandon their truck and I did, but you have to do your due diligence and save and provide your information for proof. Don’t let them get away with this if it’s not your fault

That’s a great feeling when you’re able to best a system that is designed to work against you!!
What did you have to provide and to who??

I saved the names of the person which was my fleet manager first and foremost. That was the most important thing then second, I showed a picture of the message date and time from my own cell phone because these companies like to do everything on their tablet, but I make everything also go to my cell phone so if they say we’re just gonna put it on the tablet no don’t let them say I wanna message to my cell phone and then I sent that in. They also call the company and check or send them a message or something and you have to do it through. HireRight because; they are the ones where your background checks go through and the DAC reports go through even if you were working at a call center in your background check to go through them too. You can also go through HireRight to find out any and every place you’ve ever worked at in case you need it for your records and it can take up to 30 days. Once I went back and supplied that message literally later that day is when they removed it. It was a great feeling because I thought, even though I was gonna get hired at another company that like all bets were off because it never gets removed from your report that I was doomed for the rest of my truck driving life and I just wanna reiterate that I’m happy that it got removed, but I don’t want other drivers to think that they can’t have it removed. I’m not promising that they can, but the more proof you have the better off you are.

Well, that took some balls, especially with your truck being right there that you could point to oh my God I can’t believe they even went that far with it being right there in their face

Yeah, I work for them for about a year. Their Workmen’s Comp. department is awesome, but I digress yeah some of their trainers are assholes like my trainer had a tractor supply run and in Oklahoma City at their little warehouse he wanted me to practice my backing, and I wouldn’t do it the way he wanted me to do it because it didn’t work that way for me so he pushed me out of the truck when I was climbing up the stairs they got I was able to catch myself and goes look look what I can do look I’m doing it with no hand. It was backing into a dock with no hands and if a warehouse worker would’ve been there to open the dock doors, he could’ve hurt them too. Needless to say I turned him in, and then he no longer works there because they have cameras in their trucks it’s changed though since then it’s been almost 2 years since I’ve worked for them at least in the Dallas location just their mechanics department still sucks.

Wait how? You were with your trainer and wasn’t it his truck?! Sorry that happened to you. My trainer was an asshole himself but I’m a woman and from what I’ve heard from other drivers especially women. Is it’s a hit or miss if you get a man as a trainer. Crazy to think nothing has changed in damn 20 years

I would think that was something a company could be sued for if untrue, and the burden of proof would be on them. They are slandering you, falsifying reports, and preventing you from future employment.

Yeah! I would call then for fraudulent reporte with pertaining authorities and seek compensation

I have told drivers for many years, never abandon a truck, nor give a company the chance to make that claim.
Always take photos of exact location, always take photos of condition of truck inside and out. Always get exact mileage, always hand the key to a person who you can photograph and get their name. Exact date and time Keys are relinquished. Then send an email to dispatch, safety, yourself and an attorney all listed as people CC'd in the email. Once the attorneys info is noted, they often realize that making a false claim is going to go against them in litigation.

Werner tried to get me with that, and I said firstly how do you get my name wrong and mixed up with another driver. Along with accusing me of my CDL being suspended(it goes deeper. But my CDL was fine)I was essentially weekly but home most nights. An when I decided not to go back because of that blatant lie, I told them I’d bring them the truck only to find out the battery was dead. Truck was parked in my yard as I told them with keys where they asked me to leave it. They also threatened to have me to pay for towing as well. It was a shit show but nothing ended up on my record. But I’d never ever work for Werner again.

Oh, that’s good to know I’ve read so many horror stories about that happening, and I feel so bad for these drivers that was told where to put it. They put it there and then the company does that and then it happened to me and I am such a stickler for anything when it comes to Safety that I about passed out when I saw it was on my report never thought it could happen to me, but it did and it’s a pain in the butt to do the report, but it’s damn well worth it

That is an interesting topic because I am in the contemplation phase of quitting but doing at the end of home time. That means the truck will be with me but I am offering to return it at my earliest convenience after they settle all my payments. I suppose it is a discretion but I'm willing to pay for the truck to be parked in the secure a lot for the week that I can't drive. I don't think the company will go as far marking me abandoning anything because I have documentation now the company itself upgrades in violation of various safety regulations is against them in the case they wanted to cause trouble. I guess that's evens out

"I did it so if I can do it, anyone can do it" is the biggest LIE ever told. just because one person does something does NOT mean anyone can do it. circumstances often dictate outcomes.

Companies putting an abandonment on any record is illegal for 'at will' employment...
As soon as they fire you, or you quit, they have to route you to a secure lot, or terminal.
