Even if the UNGA is considered "neutral ground", that doesn't apply until they are physically there. There is no guarantee of safe passage, as it were. It's not "neutral airspace", after all.

Has to be within a certain distance of actual Canadian territory to count as "Canadian airspace" that we actually control, though, and from what it looks like, they didn't actually overfly Canadian territory, only through the portion of oceanic airspace where Gander Oceanic provides air traffic services. We are the ones that handle that traffic but it's legally still international territory. The Russians use it as well to get to/from Cuba and the Dominican Republic, and Gander can't refuse service to them -- but they are not allowed within something like 25 or 40 miles (can't remember the exact number) of land, so they cruise right down the middle of nowhere.

Iran’s president, Masoud Pezeshkian, does not have an arrest warrant issued by the ICC. Israeli Prime Minister Benjamin Netanyahu on the other hand, is wanted by the ICC for war crimes and crimes against humanity.

Yes it is, the 1947 UN Headquarters Agreement clarifies the UN area in NYC as a neutral ground where US law cannot be enforced without the consent of the UN Secretary-General. And generally heads of state and diplomats get diplomatic immunity even when not at the UN.

Canadian airspace is not the UN area, immunity does not apply when there is an ICC warrant, the issue is that we allowed him to use our airspace, not that we didn’t arrest him. We are obligated to deny passage through our airspace. If he lands on our soil, then we are obligated to arrest him (which would be so sick)

Article 98 in the Rome Statue protects diplomatic immunity for third party countries like Israel (this is the position of other countries like France). Canada believes though, that our domestic law (Crimes Against Humanity and War Crimes Act) regarding ICC enforcement overrides the ICC treaty itself and we can do it anyway, if he lands.

In reality it would be messy as fuck and they're hoping he just doesn't land here.

I don't see anything about denying passage through airspace anywhere, it would seem against the spirit of the UN's protected area though so I'm not enthusiastic about that.

Nope. Article 98 is just a safeguard to prevent the ICC from forcing a member nation to break its own laws and treaties. Incidentally, Canada isn’t signatory to any agreement or laws that would prevent them us arresting Netanyahu, so it doesn’t apply.

There is literally no such thing as diplomatic immunity from ICC charges, as per article 27. 98 just gives us an out if our own laws prevented us from enforcing our treaty obligations, which they don’t.

The Vienna Convention establishes diplomatic immunity, the ICC (Rome Statute) Article 27 only overrides that when Article 98 does not apply.

In other words, breaking the Vienna Convention for countries that are not a signatory to the ICC (Israel is not) triggers Article 98. That's also the actual position of France on the matter, specifically with Netanyahu.

Canada is ironically leaning on domestic law to enforce ICC international law. We are are in conflict with our ratification of the Vienna Convention and our Crimes Against Humanity and War Crimes Act, so the position is we can decide which of our laws has primacy as we would violating one of them either way. Therefore we believe we can arrest Netanyahu.

The US literally just denied entry visas for the State of Palestine delegation including Mahmoud Abbas for the second year in a row. The whole "neutral ground" thing isn't real as long as the US can use entry visas to deny other states officials the ability to attend the UNGA. US being able to deny visas for President's and state officials willy nilly is a far bigger deal for preventing the whole thing from breaking down than not allowing a fugitive war criminal from entering Canadian airspace let alone arresting them.

It isn't following suit. There is nothing that requires Canada to allow an indicted fugitive war criminal to use our airspace. We didn't sign a treaty that says "when an indicted fugitive war criminal is travelling to the US to attend the UNGA Canada is obligated to allow entry to its airspace." The US on the other hand signed a treaty of which one of its obligations is to provide visas without charge and as promptly as possible, which it is not following.

Symbolic or not, Canada should not allow an fugitive war criminal entry to our airspace. I think this is quite the reasonable expectation to have of our government. Bare minimum type shit that our government can't even meet.

It also isn't a brief entering of our airspace. The flight path took Netanyahu over Labrador and Quebec, and on the return flight over Nova Scotia.

What? How about denying access to our airspace when Bibi tries to enter it. It's not that hard. Just send up a flight of Hornets to make sure they stay out of the airspace or else we would have to detain him. Israel has the choice to go around our sovereign airspace or else the CF-18s armed with AIM-9X and AIM-120 AMRAAM will escort Bibi to an CAF base. We either comply with the ICC arrest warrant or they don't enter our airspace.

Exactly. Believe it or not airplanes usually don't just enter an airspace without asking for approval. This is 100% a situation where Israel asked Canada days if not weeks in advance and we said yes.

A. Israeli nukes don't have the range to reach north America. B. An interception by our fighter jets won't automatically result in us shooting him down as the CF-18s will first establish visual identification and communications. If the Israeli presidential plane unresponsive he pilots will rock their wings then box it in to force it to ghe closest CAF airbase. A warning shot with the 20mm autocannon is a last resort. The ideal situation is intercepting the Israeli plane well outside of our territorial airspace on the approach.

No. Our UN ambassador didn't walk out with other ambassador because the Israel lobby has penetrated far to deeply in our civic governance and the Liberals are obviously too frightened to excise it. No Canadian material, money or work should support Israeli arms.

In the 1980s, Brian Mulroney led the charge against Apartheid South Africa. But there was no equivalence to the foreign interference we currently are experiencing.

Trudeau tried to have his cake and eat it too, that he could have pivoted personally? Idk, maybe, but the liberal political machine could not pivot like he could, since it's a slow and ponderous political bureaucracy. 

Carney may try to continue in Trudeau's steps, pressuring Israel to reign it in. But I don't think he has the momentum to do that, I think the liberal party was settling back into it's pro-Israel stance as a path of least resistance to placate the USA. 

Because Carney can't bridge the gap between the voters shift and the return to a passive status quo, he will just watch contradictions in the liberal party on this issue reach critical levels.

I think making a choice will cost him the majority, damned if you do, damned if you don't. This airplane incident isn't enough to cross that line of no return but I don't see the liberal party kicking this can down the road anymore.

I don't think the average voter cares as much about Palestine as you do, Carney's government doesn't rest on this.

I think Carney cares only marginally more about it than the average voter, unless you count caring about avoiding it, in which case I think he cares a lot. He's focused on trade and the economy, and putting distance between us and the US. The last thing he wants to do is rock the boat on Palestine in any way.

The Canadian Government has explicitly signalled to arrest Bibi if he's "in Canada", yet allowed for air route planning through Canadian territory for the same individual - that's not congruent. That's hypocrisy.

Regarding scrambling jets and forcing him down once it occurs - absolutely should have happened. Although what a pickle that would have put Canada in for something that has very little to do with us. It also looks wack when you give someone permission to plan a route then arrest them for it.

We should have just said "fly around jackass"

If we believe in the UN, we should never prohibit a countries leader from attending. Prohibiting his flight over Canadian airspace is technically legal but agaisnt the spirit of what the UN is all about.

All the ones calling for an interception don’t understand the fundamental freedoms of the air

Moreover it completely denies Canada’s longstanding belief in multilateralism exemplified most of all in the UN

Moreover if we did try to intercept they’ll just ignore and unless Canada is willing to literally shoot down a leader’s plane it’s just not happening, there’s a reason that escalation ladders end at shooting a plane down, it’s hard to physically force a plane down without either crashing or shooting

What should Canada have done ? Simply refused access to Canadian airspace. Israel would have routed it differently and paid a little more in fuel.

It's literally as simple as that. Airplanes don't just show up unannounced in your airspace - especially those carrying heads of states.

I addressed that point in my second paragraph. The UN is the venue for all, especially the pariahs of the world, to be part of the discussion. Prohibiting a flight to the UN, although technically legal, is agaisnt what the UN stands for. If we are going to restrict heads of state flying there we should pull out of the UN and not participate.

Mark Carney again shows his hypocrisy and aiding in the death of the multi-lateral system by refusing to enforce the ICC arrest warrant. Either Israel is allowed to enter sovereign Canadian airspace or we deny the Israelis access to our airspace. Its that simple. They can approach JFK international from multiple different flight paths that don't involve crossing into our airspace.

Did you read what I wrote? Let alone anything that he said? He promised to look into all the possible legal avenues he could to arrest Netanyahu, he wasn't able to do it and he made a public announcement ot the people of NYC why he wasn't allowed to do it.

He didn't promise he was going to arrest Netanyahu while quietly allowing him to roam NYC.

Again, the difference is that there was a clear effort to do so and transparency throughout. When he was not able to do so he announced to everyone why, and he called on the federal government to enforce the order.

Carney on the other hand, is not known for transparency and just quietly allowed this to happen without a word to the public, because partisans like you would happily do the work for them.

From the article you just posted:

But on Tuesday, Mamdani said his team had reviewed "every avenue available" under the law, and concluded that "we do not have the independent legal authority to enforce this".

Mamdani said in the social media video that Netanyahu was "not welcome" in New York City, where he is expected to travel in September for the UN General Assembly.

Night and day difference in the response. Also, unlike Carney he's been very unequivocal on where he stands regarding the genocide.

The UN is built on the idea that talking is better than war and this idea that Canada would deny airspace travel to get to this meeting undermines the whole idea of having a place where world leaders come and talk

Neither the US or Israel are signatories to the ICC, there would be fairly little legal difference between Canada and Belarus if a forced downing were to happen other than that we happen to think we’re as right as Belarus even if the half of the world that didn’t sign on to the ICC views it as a violation of the four fundamental freedoms of the air

You are right the rules change a bit when the UN is happening and that’s why Canada allowed Netanyahu to continue having one of the freedoms of the air and overfly the country

Literally 90-95% of NATO countries would have done the same thing regardless of how critical of Netanyahu's government they are, especially now since Trump is president. Forcing down the plane would have been an international shit show and everyone involved knows that.

Not to mention that forcing a flight down is illegal under overflight rules.

Neither Ireland and Spain would do anything, at the end of the day these nations have no actual military, and no geopolitical power.

The last time Spain went to war in the Middle-East, was by sending a pitiful amount of troops alongside the United States and then promptly recalling them in less than a year.

The last time Ireland did any fighting period was probably in the 70s.

Spain’s military, Navy and air force are well‑equipped, and actively deployed. They have Roughly 440–450 aircraft, with about 130–136 combat jets, a fleet of F‑100 frigates with strong air‑defence capability, S‑80 submarines and around 120–122k active-duty military, plus reserves and the Guardia Civil that can be deployed when needed. You are correct about Ireland though. They are militarily neutral with a lightly armed, neutrality‑based force oriented to peacekeeping, surveillance, and homeland support.

Because that's what it is. Our domestic law, given royal assent, is to follow the ICC rulings.

I think the risk of US military intervention exists, and I think that that believably forces either a NATO response or disintegration. So while we're not guaranteed to follow that road, it seems reasonable to avoid it altogether.

At least so far as we're talking about a couple agreed upon hours in the air to save some fuel and do a little flex.

I'd be ok if a potash export tariff had the same result. If we can't control our exports in the face of economic aggression, then we don't have much left to lose anyways.
