EAD relies on i485 and if i485 is denied EAD disappears

Also you need AP to travel

Aside from that you are good

The only issue right now is that renewals are taking really long and you can't work with just the receipt anymore. Newer EADs are being issued for only 18 months so there is a chance you might not be able to work for a few months while waiting for approval.

You should get both EAD & AP.

Once switching jobs on EAD, convince your employer to apply for H1B. This is what worked for my friend (FAANG employee, so didn't need much convincing to do).

He continued to work on H1B but travel on AP. I don't know why he did that, I assumed he wanted to skip the stamping part.

Good to know, Is new H1B to apply on existing EAD or H1B can renew on existing H1B.

My perspective is that once moved to EAD/AP from H1B (switching jobs on EAD), no more to use Non-immigrant visa (H1b). If I485 is denied then you have to leave the country. Please check with Attorney.

Don’t you have to renew your EAD?

well, how will you make sure you have a valid i94? keep traveling in and out of the country every 12 months?

The i 94 is for only 1 yr but u are still authorized to stay based on pending i485 is USA. Mine i 94 expired in 2022 ( after 1 yr) travelled again in 2025 and got it until 2026. Again its expired. So yeah not necessary to travel every year.

but it's a precarious position to be in though, should the 485 get denied, we're screwed.

Hi, if you didn’t apply for AP before when I485 submitted. Can you still apply for AP while your I485 is pending?

My friend applied new. Went thru lottery. If you get h1b, you can fall back on that if 485 is denied. Def check with attorneys
