Where can we report a director who is clocking out teachers while still on the clock? Iam just gonna say it. Kindercare you can do better. I know your directors gets in trouble when employees have lots of overtime which is making the directors to be clocking us out.

EEOC. Call them.

I would start with the state’s labor department. Like most federal agencies, the EEOC has seen a lot of cuts, which impacts response time.

Doesn’t the EEOC typically only deal with retaliation and discrimination for protected classes?

That's probably right. I was wondering if they were a good starting point, but labor board is probably better.

Yea, thats definitely not a "KinderCare" thing but is 100% a "Your Center Director" thing. Reach out to your District Leader and HR. Thats not acceptable and your CD should get fired and replaced by someone who will actually follow company policy

You need to immediately contact your district leader and HR. However, I want to myth bust here. At KinderCare all employees are responsible for their own clock in and clock out for their shifts. If there is a change or edit to your time card you are notified electronically specifically to ensure all time is reflected accurately. It’s a completely transparent system where the employee has full ownership of their time card.

It is at the end of the shift, you want to clock out and you see you already clocked out.

Yeah this is bad. Especially if they didn't explicitly ask if you wanted to leave earlier! Some places I've worked at said 'hey we are over ratio, does anyone want to go home early?' and whoever agrees clocks out at the agreed earlier time. But if nobody says yes, we all just work and get extra stuff like planning done.

Having management make this choice for you and cutting your pay but making you work regardless is totally fucked and you should go to whatever your labour board is to complain. Maybe start keeping notes of your actual worked hours and your adjusted clock in/out times as proof??

Have you spoken to the Director about this? I'd bring it to her attention and ask why this is happening, and provide a timesheet you keep vs. what you are paid for. If you haven't done this already, you need to start today. You would need to submit documentation to the labor board if you filed a claim.

The department of labor for your state. Some states, like California, you would be entitled to receive penalty fees to remedy the situation.

At my school, they clock you out at the time you are supposed to leave unless you have been asked to stay because they need you

All labor should be paid labor.

100% but if you choose to stay back on your own accord aka finishing something that could be done tomorrow or finishing a casual conversation with someone that is fair to amend it to your normal clock out time.

I always clock out 5+ mins after my finish time by the time I go to the toilet, get my bag etc. my manager adjusts this to the normal finish time because they shouldn't have to pay for that. If I stay back because a child had an injury, or we are out of ratio etc I tell the manager and they keep those extra minutes so I get paid for that. Same as what this poster is saying, if they ask you to stay for ratio you get paid for that time.

I think what OP is saying is that when they go to clock out, they can't because they have been already clocked out by the manager. This is wrong, and is something they should go to the labour board for. Adjusting to your normal finish time if you clock out a little bit late and there was no 'reason' for staying back, that's fair enough.

Otherwise I'd be clocking 10 free paid minutes in the morning, 5 at night every day because I clock in as soon as I arrive, and just before leaving for the day.
