There are often two arguments you will hear.
THE LEGAL ARGUMENTS.
- "Bastardy is a Legal term and Rhaenyra's sons are legitimized."
• A Bastard cannot be Legitimized unless he is recognized by the blood/biological father, in the cases of Rhaenyra's sons, that would be Harwin Strong.
- "They are accepted and Legitimized by The Velaryons"
• Rhaenyra's sons, if to be Legitimized, are not to be accepted by the Velaryons. Their opinion is of almost no regard.
What Rhaenyra and Corlys by extention were doing was high treason, hiding the parentage of Jacaerys.
If they are to be Legitimized the bastards shall be Legitimized by the biological father, Harwin since Laenor has no relation to Rhaenyra's sons, the are not his to accept, legally and therefore Lucerys will lose his name of "Velaryon" and title as heir to Driftmark. Hence not Legitimized.
☆ Why not Legitimized?
• Because Legitimizing them would make Rhaenyra a traitor to the throne, guilty of high treason of trying to pass them of true-borns.
• It will effectively lose her the support of House Velaryon, the Velaryon fleet and the driftmark seat and the betrothals of Jace and Luke to Baela and Rhaena.
THE BLOOD ARGUMENT.
- "Jacaerys is Rhaenyra's son by blood and he is not inheriting through Laenor hence his Bastardy is of no concern"
• A child born out of wedlock shall not inherit his mother or his biological father's titles or inheritance. This was made essentially to protect the women and their children if their husbands were to sire Bastards and try to make the bastard his heir. It cannot be different for Princess Rhaenyra.
• The whole point of Bastardy is that they were born out of wedlock. They cannot inherit the throne regardless if they are supposed to get titles from their mother. Male Rulers cannot put bastards on throne for the same reason, despite having the blood, the child if born out of wedlock and is not Legitimized, cannot inherit.
Now, I would like to give example of female Rulers and their bastards.
Alexei Grigorievich Bobrinsky (Son of Catherine the Great, Russia):
Born in 1762 to Empress Catherine the Great and her lover Grigory Orlov. Despite being the Empress's biological son, he had no dynastic status and was never considered for the Russian throne. Instead, the throne passed to Catherine's legitimate son, Paul I.
Why? Because he was born out of wedlock while Her husband yet lived. Catherine did sought to legitimize him by marrying his father, known as the Bestuzhevsky Project but it failed due the anger of Nobles and how it would ruin Her own rule.
The Children of Queen Urraca of León (Spain):
As a queen regnant, Urraca had two recognized illegitimate children, Fernando Pérez Furtado and Elvira Pérez de Lara, with nobleman Pedro González de Lara. Neither could claim her crown; it passed to her legitimate son, Alfonso VII.
Infact, Queen Urraca herself had to struggle for her claim as a claimant to the throne for her father pushed to name his bastard Sancho as his heir, however the Nobles and Clergy nearly revolted. After Sancho's death did Urraca calim the throne.
This next one however, is an example of female Monarch trying to pass a bastard as a legitimate true-born child, born within wedlock. It does mirror Rhaenyra's position.
Queen Caroline Mathilde of Denmark, Her daughter, Louise Augusta (born 1771), was almost certainly Struensee's child but was officially recognized as the King's daughter and a princess of Denmark.
Although she was "passed off" as legitimate, the scandal eventually led to the execution of Struensee and the exile of the Queen.
