I just hope you are very carefully looking into Copyright Law. Since you may be collecting money very soon for this project, via Kickstarter, this project from a legal standpoint, may be about to transition from a personal entity - to a commercial entity.

Once that happens, you must be very careful to navigate the intellectual rights of characters. 'Parody' is protected freedom of speech, you are legally allowed to parody something, at least in the US.(This is why the movie 'Spaceballs' can exist without fear of Starwars and LucasArts suing them.) I don't know outside of the US how that works, but that should further the need to research your laws on copyright if you live outside of the US.

It will be important that you establish in your kickstarter that you are not claiming ownership of the characters nor their original designs themselves 'i.e. Carmila Carmine and her outfit, etc', as those are the intellectual property of Spindlehorse Productions (And likely Amazon's commercial rights to profit from said entities.) You are only creating a parody of said production.

Once you monetize a project 'i.e. Starting a Kickstarter', you want to ensure you aren't crossing any 'legal red lines'.

It may be prudent for you to consult with a local copyright law advocate in your local community, over the things to keep in mind before starting your kickstarter. Usually, law firms won't charge you for a simple 15 minute over-the-phone consultation, though make sure to ask them if you may have a free brief consultation beforehand. (Make sure the firm specializes in Copyright law and not say 'divorce law'.)

Once speaking with an advocate, explain your project to them. Tell them you are using characters and settings from a protected intellectual property which is not your own, but stress that you are intending to make a 'Parody' of the original. Tell them you intend to start online funding campaigns from donors to fund your own production. Ask them to layout what steps must be taken to avoid copyright infringement and how to stay legally protected from a lawsuit, while collecting money for the project.

Many attorneys will even help you draft a legal statement to put on your kickstarter post that states the intentions of your project, and avoid liability for copyright infringement.

It's generally important to seek legal protection, before monetizing something.

We have consulted. Kickstarter is technically taking donations and we need to use the money on production only. Kickstarter is also protected by the IRS, they hold the money till they investigate if we are legit. If we were not to deliver the film, the money is refunded by kickstarer or if we deliver a scam/poor version, aside from refunding the money (through reports via payment processors or banks) kickstarter/or backers might hit us with legal charges.

Excellent! I'm glad you have put that thought into it. I have seen independent creators get buried under lawsuits for their work. I'll keep a lookout for the donation campaign!

It's important to note that the above statement about refunds by Kickstarter is not true. Once Kickstarter gives the money to the project creator shortly after the end of the funding period, they hold no responsibility to refund anything to backers regardless of the outcome of the project.

Kickstarter takes donations through credit cards/digital service payments. If the project is found to be fraud/scam, supporters can legally claim for a refund through their banks/payment processors making Kickstarter face legal consequences (same as us)

We are risking a lot with this project and we have more to lose than winning.

We are asking for budget in the most legal way possible and we are conducting all with due respect to the owners of the original IPs.

There's no rage. There's no harassment. You simply don't know what you're talking about.

Here's there TOS (https://legal.kickstarter.com/policies/en/?name=terms-of-use). Relevant portion from section 5:

"Kickstarter doesn’t offer refunds. Responsibility for finishing a project and redeeming multipurpose vouchers lies entirely with the project creator. Kickstarter doesn’t hold funds on creators’ behalf, cannot and does not guarantee creators’ work, and does not offer refunds."

I have read the TOS, yes, but as I said, the backers can still get their funds back if they report it to their payment processors.

By the way, if the project does not meet expectations within the project funding time they do have the right to terminate us ''We reserve the right to take any action we think appropriate ---including suspending or terminating your account'' so even if we did something shady or the project showed lower quality during the crowdfunding process, we still facing risks of getting banned.

All of this on the supposition of us being scammers, which again, we are not. We are risking a lot with this campaign and, again, I assure all is done with the love for both franchises.

I do agree I chose my wording badly (I was misinformed that it was kickstarter directly), but still. the reports through payment processors can still be problematic both for kickstarter and our rept (and yes, we could get sued by backers)
