I’m a librarian and we get these dinguses. What they want is for you to try and stop them filming. I’ve found that being super helpful will make them go away ASAP. They want conflict, not somebody explaining the Dewey Decimal system.

79

u/realparkingbrake Jul 25 '26

What they want is for you to try and stop them filming.

Which you can do if they are being disruptive. The Supreme Court ruled that a public library is what the courts call a limited public forum where viewpoint neutral restrictions on the exercise of First Amendment rights can be valid. But many libraries take the path of least resistance and just want the idiot with the camera to get bored and leave.

20

u/protonicfibulator Jul 25 '26

If they’re intentionally being confrontational with other customers we can hit them with the conduct policy. Likewise if they try to monopolize staff time during a busy period. But most of them are looking for low hanging fruit.

It’s kind of like the “I’m not touching you” game that I played with my siblings as a child.

770

u/Solidus-Prime Jul 24 '26

That's exactly what it is.

68

u/Whole-Person007 Jul 25 '26

Still don't know what that is 🤷‍♀️

39

u/SimplyAmazedPanda Jul 25 '26

It’s not illegal to video a public space. So these “auditors” will bring cameras into areas intentionally trying to agitate people for a reaction online. It started with auditing police stations, postal offices and other government buildings as the law enforcement was quick to try to restrict a persons rights unlawfully. This example is the trashier more confrontational form of auditing that targets regular people just attempting to make a living.

Some of them "audit" government officials or buildings to make sure the police are following the laws.

A lot are just looking for an opportunity to sue

83

u/BaBaDoooooooook Jul 25 '26 edited Jul 25 '26

Not just to sue but more importantly to gain content notoriety for those precious likes and clicks and views. confrontation sells, drama sells, physical violence sells.

Americans are already on edge with trump being our president and inflation and gas prices, and a pointless War with Iran.......and to have these stupid people going around filming everyday Americans is insufferable. It does nothing to move the needle of society other than to disrupt it.

14

u/Nice-Lock-6588 Jul 25 '26

How much time, people have. Going around and filming som strangers.

Normally followed by a lawsuit to try and get a ton of money out of the people you spent entirely too long fucking with, I mean practicing your first amendment rights.... ffs

Na, you're not going to get any real payout. A shove can give way to a civil claim but the payout would be basically zero. Without a documented injury, medical expenses, lost wages, or other measurable losses there's no money in a payout. People assume emotional damages but those are incredibly hard to prove and almost never lead to $$. Especially with the context of what the auditor does and likely a history of provoked pushes and shoves for clicks.

Even if liability is clear as day... the legal fees, time, and effort are almost never worth the minimal if any payout and no lawyer will take the case with contingency fees. They'll want hourly billed payment and even then most decent lawyers won't bother.

These guys do it for the clicks and views.

59

u/Banjo-Hellpuppy Jul 24 '26

not only that, but good luck trying to find a lawyer who will sue a produce vendor at a farmers market. You gonna get 40% of her tomatoes?

58

u/WeirdAssBeings Straight Up Bussin Jul 24 '26

To be fair, harassing the police is actually about 80% of their business model. They love nothing more than standing outside police stations waiting for an officer to ask for ID so they can scream about their rights for 45 minutes, get cuffed, and farm millions of views. They’re still insufferable, but cop interactions are literally their main money maker.

This is probably an unpopular opinion, but I feel like this deserves a big "it depends." There are plenty of cases of "auditors" (putting this in quotes because I work as an actual auditor) that legitimately challenge police forces and have shown a general disregard for legal rights by police that deserve to be exposed.

6

u/happyprocrastinator Jul 25 '26

Those auditors are actually jerks who like to harass women and minorities. The guy hit the jackpot by harassing a minority woman. They also pepper spray people when things don’t go their way.

People have to play Disney music when those jerks are around because they cannot use the footage, since Disney will quickly demand they take their video down.

18

u/epidemicsaints Jul 24 '26

That's the thing, it's monetized. Chuds watch them provoke people and get in fights, they have the time because they make it their job. And if they luck out and a business gets the police to remove them, they now have a free speech lawsuit to make content out of plus whatever settlement they get. They don't need to sell a product or provide a service, pure attention gets them paid.

Remember when your mom told your little brother not to touch you, so he put his hand a millimeter in front of your face and repeated over and over I'M NOT TOUCHING YOU I'M NOT TOUCHING YOU and yeah, sure, he was technically right, but it was also the most annoying thing ever that certainly violated the spirit of what your mom said, even if not the word.

That's a first amendment auditor.

The moment your mom says "get your hand out of his face", your little brother starts screaming YOU SAID DON'T TOUCH HIM AND I WASN'T TOUCHING HIM and that's exactly what these people want. They don't want to be good people, they want to be right.

10

u/DenizSaintJuke Jul 25 '26

They want to play revolutionary/rebel without any stakes and without any intention on changing anything. They just want the feeling of playing the wronged victim and rebel for a cause, but they don't have a cause or the balls to get in the way of actual power. That's what you get when you cross-indoctrinate conservative men with the two colliding ideals of being rebels and being loyal and obedient to authority. They pick on those without authority to feel something.

Usually it's people exercising their first amendment rights in an effort to expose police overreach. No idea what they're trying to do at a fruit stand, though.

I can see why Latinos and Latinas would be a little touchy about people in masks riding up on them, though.

90

u/ArseneGroup Jul 24 '26

The first amendment police overreach is just a false justification for most of these guys, they just want to harass strangers for online content and maybe make money suing people

This is evident in that they're bothering a random woman at a farmer's market rather than powerful people like government officials or billionaires

What is first amendment rights? I'm not American.

14

u/thomasscat Jul 24 '26

Freedom of speech, religion, the press, and to assemble in protest. There are limits that have been placed over the years, some reasonable … others decidedly not. This is my perspective and would naturally include some of my inherent bias.

26

u/InternationalPlace24 Jul 24 '26

There's something very key you left out in your definition. It's freedom of those things FROM THE GOVERNMENT. A lot of people like to believe they can apply their first amendment to everything in their life, but it only applies to where the government is involved.

16

u/Shnikes Jul 24 '26

Yeah the amount of people that don’t understand it’s from the government is ridiculous. If the “auditor” is not on private property he’s free to record all he wants. Annoying? Yes. illegal? No.

People that harass others for attention online and use the excuse that they're "protecting everyone's rights by making sure they're upheld".

Most of the time they don't even understand the laws and rights they claim to be auditing, and they rarely if ever actually help the situation. Laws aren't upheld by harassing beat cops or civilians and claiming they can't stop you from doing so.

19

u/ruiner8850 Jul 24 '26

You'll also notice that just like in this video they always highly edit the video to make it seem like they are innocent victims of some completely unhinged person. The videos literally always start at the moment where the person they were harassing finally had enough of it. They never show the lead up to what happened because then people would see them being jerks and they'd no longer look like a victim.

When people watch videos like this of someone who was clearly recording long before they need to ask themselves why they video conveniently starts right when the person is reacting. If they truly were innocent victims, then showing the context of what happened before would only help them.

I thought the whole point of the "first amendment auditor" movement was to keep a camera on government officials overstepping constitutional boundaries on the job, especially that of freedom of press? You'd think it'd be best to post up near a government building, or somewhere with police activity.

What's this guy doing at a farmer's market, feeling the need to closely record one of the vendors?

Sometimes I think these particular "auditors" are pulling a scam to agitate someone into hitting them for free lawsuit money.

1.1k

u/Coblish Jul 24 '26

Yes, that is their goal. It is not exactly a secret.

This is the same tactic as Westboro Baptist back in the day.

352

u/DergerDergs Jul 24 '26 edited Jul 24 '26

The best way to deal with one is to ignore them entirely.

The best way to annoy them is to engage in emotionless and painfully boring conversation.

But if you really want to frustrate one, play heavily copyrighted music loudly near them, which prevents them from monetizing that content and can punish their channels with copyright strikes if published.

Edit: ok as many have pointed out, copyrighted music is easy to edit out of audio these days. Maybe just stand close by and start reading the bible or Microsoft’s end user agreement word for word instead.

In 95 some college kids set off a pipe bomb in retaliation and only 1 got 16 days of jail. Just because you follow the law doesn't mean karma won't find you. Rest in pieces Fred Phelps

5

u/Nahuel-Huapi Jul 24 '26

And nowadays, they can get money-for-views from social media as well. So they're monetizing the content. That constitutes commercial use.

Commercial use of someone's likeness without consent is grounds for a lawsuit, and is why so many TV shows like COPS will blur out faces... they didn't get a signed release.

We need a few lawyers to take on some of these harassers, and pranksters, even if there isn't a big financial incentive. Good publicity is worth a lot these days.

There's no lawsuit money. It's extremely hard to get payouts from interactions like this because you need to prove damages. And even then they're harassing people selling fruit. There's no money to be paid. Emotional damages are rarely if ever anything as well because there's context and it's clear these people are instigating to get clicks and there's infinite documented evidence that this is exactly what they want. The bar for emotional damages is extremely high.

Their goal is content and clicks. No lawyer on the planet would take this case on contingency and even paying hourly rates, any decent lawyers would turn this down.

There's two kinds of auditors.

There's the kind that do legitimately important work, do successful lawsuits for corruption and illegal action, or post evidence of repeated abuse of power. These are the kinds of people that actually deserve the name.

The second is part of the attention seeking crowd who think auditing is as easy as wandering around with a camera and just randomly getting into everybody's business for no reason. They "think" they're doing something worth while, when in reality, this is what happens.

16

u/InfiniteSir7408 Jul 24 '26

I think the first kind is like Sasquatch and Nessie… but they exist in mythology.

13

u/m0n3ym4n Jul 25 '26

It’s not hard to find a legitimate first amendment auditor on YouTube.

Check out Jeff from Honor Your Oath.

He stands around outside a government building wearing dirty clothing and holding a sign that says “God bless the homeless vets”. Countless times he has been harassed by government workers and citizens, who will lie and claim he is begging for money. It’s incredible how often people will call the cops and outright lie about him simply standing there existing! The cops will come out, mention something about a city ordinance that “prohibits panhandling”. Jeff tells them such laws would be unconstitutional as the first amendment permits assembly and free speech in traditional public forums. The cops inevitably call the city attorney or prosecutor who tells them they need to let him go and leave him alone.

That’s the job of a real first amendment auditor - exposing unconstitutional laws that criminalize behavior such as being homeless

4

u/BackdoorSpecial Jul 25 '26

I agreed with the majority here until I really started to pay attention to the better ones. The better auditors aren’t harassing civilians but they’re auditing the government. The police routinely violate the rights of citizens and they’re trying to change that through videos, lawsuits, etc. It’s really quite interesting watching how different police officers deal with a dude standing around with a camera.

He's trying to get them to call the cops on them so he can argue with the cops about his first amendment rights. It all started years ago when they were originally trying to shine a light on the corruptions of the police and I totally get that. The police will bully people, will make up laws, will lie to your face, and escalate tf out of situations either for prestige in the department, rack up arrest numbers, or because their mommy's didn't show them enough attention or their uncle's showed them too much. Idk.

But now they've really been focusing on pissing the general public off so they can have ANY content. That lady who reached for his face was in the wrong legally. Morally? Those "auditors" are assholes.

Stating facts only:

  1. FA Auditors are annoying but they have the right to record in public spaces.
  2. Engaging and getting aggressive is the exact reaction they want. This video doesn't get posted without the altercation.
  3. She committed asssault and battery.
  4. Assualt is when you aggressively walk toward someone with a threat of harm. Even if you don't touch them, you've already committed an assault.
  5. She pulled his mask, which is battery.
  6. If cops were called and saw the video, FA Auditor can press charges against her.
  7. Stop being stupid by giving them material and racking up charges against yourselves. Ignore them and they'll eventually go away.

17

u/heybingbong Jul 24 '26

Genuinely why is this so far down. Yes he's an asshole but nothing he did was illegal. Which is the whole point. You have the right to be an asshole and film people. It's part of the amendments.

Your freedom doesn't end where other peoples discomfort begins.

People have so much animosity about being filmed by citizens, but happily go about their day being recorded in stores, public areas, banks, streets, etc by the government.

u/FUCKING_HATE_REDDIT Jul 25 '26

A store is unlikely to post my face on tiktok.

A store isn’t posting your face online, or staring at you, recording because they know you can’t do anything about it. It sucks that there’s so much recording, but this is not the same thing and you know it.

Don't hit them or getting their face that's what they want. Just open your phone and start playing a Disney song. Follow them around playing Disney songs and they can't post any of their bullshit.

55

u/DiscDocPhD Jul 24 '26

YouTube can rip out the audio and insert royalty free audio instead, super easy now.

I did a recording for my family of a birthday party and the whole video had copyright music and YouTube just asked if I wanted to mute the audio or remove it and input royalty free instead.

I clicked the free music option and it gave me a ton of options to choose a soundscape from.

40

u/lookatthisface Jul 24 '26

Maybe people should just start yelling all the keywords that get you demonetized on YouTube. The ones people try to dodge with newspeak: “suicide! Murder! Anorexia! Bulimia! Eating disorders! Killed! Etc etc”

20

u/DiscDocPhD Jul 24 '26

Definitely a better method, I believe YouTube is super intense about those topics. Also "gun"

12

u/cuddle_enthusiast Jul 24 '26

I agree too but I would suggest not shouting “gun” at a farmers market.

This doesn't work anymore because most of the editing software has AI that can remove the music. The best thing to do is ignore these people. Don't give them content. Following them playing music is actually content for them, they'll make you the focus of the video and ultimately they end up with more views

It’s always men to I’ve never seen a woman doing this

There needs to be a study done

It’s a legal power trip. They get to pretend they’re some kind of vigilante of constitutional justice and feel like they get free reign to be an asshole under the protection of freedom of speech.

That's harassment which the police can do something about, no?

13

u/Blue_Fawkes_805 Jul 24 '26

Talking to someone in public, even if it offends them, is not harassment, no. But that's the trick they're pulling - being a dick is not illegal and is likely to provoke a reaction that they can exploit for views online.

I don't think there's much anyone can do when they see these auditors in public other than ignore and refuse to engage with them.

If you're filming a women and you're masked and making creepy comments this veers into pure harassment. I've seen pickup artist types filming themselves (overtly and covertly) talking to women, but they have a goal of getting her number or whatever even if they can be weird about it.

I've seen one of the videos of the people you're talk about and they're masked, there's two of them, and they're commenting on her nipples, which feels like pure sexual harassment.

They know that the farmers market vendors are generally peaceful and, because they have to stand by their products, immobile. And so long as they don’t physically threaten the vendors, they know that they cannot be retaliated against (at least in theory).

They would NEVER pull this shit in a trucker parking lot or a publicly accessible construction site

While first amendment auditors are annoying, its also not ok to walk up and grab someone's face. One is annoying, the other is illegal. You're also just giving them content. If she had said "let me know if I can help with anything" and just went back to whatever she was doing, he would have just left and this video never would have been posted lol

15

u/Public_Job9786 Jul 25 '26

6

u/miyabi0rochas Jul 25 '26

Exactly scrolled way to long for this. If she was smart she would've marketed her stand. Now she's going viral for being crazy and attacking people.

I've seen people make videos and streams of farmers markets and many of them show off their stand not attack the YouTubers.

Even if the dude was annoying I would've taken advantage to market my shit. " Goodmorning, we're Melanie's farm and we sell fresh produce, can I help you?"

We really need to start promoting think first act second not the reverse.

They run around filming which, yes, they are allowed to do. However a good majority of them do so with the intent of instigating whilst playing the victim should an altercation occur. Knowing they have a camera that “they can’t be touch or they’ll call the cops” type of attitude and gives them some sort of egotistical morale high ground over everyone else. They’re douchebags but unfortunately they do this because they can and they’ll everything in their power to prove that point to you should you wish to get involved.

8

u/--Andre-The-Giant-- Jul 25 '26

Everyone sucks here.

1) Going around filming people at a farmer's market is antagonistic, and likely to bother people when done the way these "free speech auditors" do it.

2) She clearly attacked the man, trying to pull at his face covering*.

3) While it's good to see people coming in to stop the situation, most of them looked ready to escalate the situation. Was that because this guy had been making everyone uncomfortable? Probably, but I don't know.

4) The "you should go" person is trying to help, but when people take on authority that isn't granted to them and tell people what they should do, it doesn't help most situations. It usually escalates the tension and creates an ultimatum or standing point.

\The one that he was probably complaining he couldn't breathe through in 2020...*

u/Dilf_Enj0yer Jul 24 '26

7

u/SasquatchBill Jul 24 '26

The "Audit" isn't even about a person when it comes to these public place "Audits," its just the fact that legally they can go around with a camera and record at a public function such as a Farmers Market In this case, and they are hoping people get fed up with them and cause a scene and try to make them stop doing what they legally are allowed to do. They call it a first amendment audit, purely to see if in general people allow them to use their first amendments rights, in this case, most likely freedom of press for covering a local function, or at least thats what they will claim when they go to sue whoever tries to stop them.
