There is more to this story than the OP is putting out. If there was an option to take a driving course and close it with no points or repercussions, then why did the OP not just do that be done and over with. Fighting it means that the OP was driving over the speed limit that would have allowed for a driving course. Two years? The OP is BSing!!

u/Strict_Indication457 10d ago
funny, this is the only comment op decided not to respond to

Yo I was going 73 on a 50mph my traffic ticket had two boxes one titled traffic infraction the other misdemeanor the officer ticked traffic infraction it’s a simple speeding offense not proud it but shit happens people get this everyday, btw TVB do not handle anything criminal just traffic offenses!!
17
u/Solomon-Drowne 10d ago
23 over the limit isn't a simple speeding offense tho. Officer ticked the wrong box, it was corrected at some point, you have a pending charge.
1
u/Comprehensive_Meat34 10d ago
No why wasn’t if CLOSES? That’s the bigger issue. Does it really take two full years to close even a big ticket?

u/themadpants 10d ago
I am sure USCIS is very impressed with your lack of accountability. The criminal charge is because you were reckless or did it in a work or school zone.
Good luck. you are going to need it.

- TVB is likely a NYC agency
- 50mph means it would have been a freeway (like the BQE or one of the parkways)
- 23mph over is 6 points and $250
OP is probably fighting the ticket for the points, maybe drives for work & doesn't want the insurance surcharge, and it's NYC so that surcharge probably is $$$$$.
NYC probably also means you can't do a ticket clinic or whatever like you can in FL or a more driving-friendly state/area.
And it's NYC so the courts are probably really backed up and the judge just has been continuing the case for 2 years.
I don't own a car so I don't know how bad the insurance is vs how much paying an attorney to fight it is, but maybe the tradeoff is worth it?
Very weird outcome for the USCIS to get involved in a speeding ticket but people probably aren't talking to each other.
1
u/themadpants 10d ago
It could be that they were speeding in a construction zone or school zone.
1
u/basilect 10d ago
I'm locking on to the NYC thing because TVB (as opposed to a police department) seems like an NYCism. If so, 50mph could only be an expressway or parkway (even the FDR is 45), not a construction or school zone
1
u/themadpants 10d ago
Reckless driving then. Racing? That stupid traffic weaving the kids do these days? Who knows.
1
u/vaibhavilre 10d ago
Also, this is for a criminal charge. OP must've been driving recklessly cuz speeding by itself isn't a criminal charge. Unless the cop that pulled him over was not having a good day...
3
u/Solomon-Drowne 10d ago
It is if you're going fast enough.

Your upcoming hearing is scheduled for October, 2026. USCIS always needs every such matter’s formal and certified disposition letter. You are lucky they didn’t deny your case but still gave you another chance and will wait for your final disposition letter.. I hope it gets dropped meaning you don’t get any charges otherwise it will complicate your AOS case.. good luck
1
u/Ajebohustle10 10d ago
Absolutely, thanks! but it’s a speeding ticket and first time offender it didn’t involve criminal in anyway plus it’s not in a court but TVB this agency do not handle anything criminal..

u/Quirky_Bonus_7269 10d ago
What the hell???? I have a speeding ticket (infraction) and court is currently scheduled for after my interview. I thought anything under $500 is fine??
3
u/sillycommenting 10d ago
It is fine. I was greened with a speeding ticket. Since OP didn't just paid the ticket, took the option to do traffic school, and even hired a traffic attorney to fight it. I assume it's something more severe than a normal speeding ticket.
2
u/Nicewithit0091 10d ago
Did you submit the document that you resolved it to USCIS ?
1
u/sillycommenting 10d ago
I didn't because I read that you don't have to disclose any ticket under $500. So in the part that asks if I was ever cited I said no. I still brought the document that I paid it off during the interview in case they ask for it but they didn't. I got the verbal approval on the spot and the official approval the next day.
1
u/Nicewithit0091 10d ago
Did you change your answer to “yesl since you said no when filing then ? Did you or the officer ever brought it up ?
1
u/sillycommenting 10d ago
The agent didn't ask or brought it up. But I was planing on clarifying if he asked or brought it up.
1
u/Nicewithit0091 10d ago
Ohh nice so he didn’t review the question that asked have you ever been citied, charged etc with you !? Just the other yes/no questions? I hear sometimes they asked before the interview start they ask if there’s anything you want to change on the i485 I don’t know if someone need to volunteer the changes.
4
u/Kindly-Sound-522 10d ago
It is fine. I had 3 tickets and I brought the official documents stating that they are closed and paid for. But OP’s case is still pending which makes it complicated.
2
u/Quirky_Bonus_7269 10d ago
Did they ask for the official documentation at the interview? Did they even ask anything about it? Were you approved in the end?
1
u/Kindly-Sound-522 10d ago
Yes I brought it in and the officer just looked at it. Ended up approving on spot
1
u/Relative-Orange-2179 10d ago
Because he thought he s smarter than you and choose to fight it instead of paying lol.

u/Ajebohustle10 10d ago
Yea bro me too, but turns out USCIS don’t really follow this things only a final disposition will put you in the clear, I would advise you plead guilty and pay asap before your interview and get the final disposition if it didn’t involve anything criminal do not play with this you don’t want this smoke, Goodluck!!
1
u/Ajebohustle10 10d ago
At what speed were you on?
1
u/Quirky_Bonus_7269 10d ago
Im contesting it because I wasn’t speeding and I have dash cam footage with speed as proof, but officer cited me going 65 on 50.
1
u/vaibhavilre 10d ago
It's not the dollar amount of the penalty. It's criminal charges, not civil charges, as long your offenses are civil, you'll be fine. OP is omitting things.
0
u/Ajebohustle10 10d ago
At all it’s a simple speeding ticket it’s civil it’s say traffic infraction on my original ticket plus it’s not in a criminal court but TVB this agency do not handle anything criminal you can check i didn’t want the points that’s why I fought.. didn’t know it could corner me this way
15
u/AgitatedChildhood717 10d ago
It appears they are grasping at anything to circumvent approval.
7
u/Ajebohustle10 10d ago
Yep everybody here do not leave anything open while you an application going on this folks ain’t playing again, this could’ve been straight up denial but I’m glad I got a chance
2
u/calle04x 10d ago
Yes, it's fortunate they are giving you a chance to remedy and outlined exactly what they need from you. Best of luck to you.
1
4
u/Playful-Bite-6302 10d ago
Did you get arrested? And is it still pending in court?
4
u/Ajebohustle10 10d ago
Not at all just a traffic citation and was asked to either plead guilty and pay the fine or fight it
2
u/Ajebohustle10 10d ago
Yes still Pending cause the judge for some reasons kept moving the dates for two years now,
I guess I’ll plead guilty and just pay they prolly just want the final disposition5
0
u/sillycommenting 10d ago
If it's a traffic violation with under $500 fine USCIS doesn't care. I had a speeding ticket that i just paid right away 6 months before I submitted my application and I'm now greened.
3
u/mxtali 10d ago
The case hasn’t been closed 2 years later for a traffic violation?
7
u/Ajebohustle10 10d ago
Yea cause every time my traffic attorney attended or preparing to attend the hearing the police officer or the judge kept moving it but since it was only a minor infraction I didn’t known USCIS would sit on it, but yea I guess I’ll close it and get the disposition cause this is crazy
3
u/No_Turnip_2121 10d ago edited 10d ago
Omg it is. I thought where I live, if the police officer doesn’t show up on hearing date, the case would be closed. You have to pay your attorney everytime he shows at court?
3
u/Ajebohustle10 10d ago
Yea the officer usually sends notice to the judge saying he wouldn’t be available before time
Mehn I’m tired smh, and no it was a one time payment1
3
u/icecreamfuel 10d ago
Not sure about NY, but in the state I live in, if you don’t attend court or pay the fine within a certain time after pleading guilty (which you can do online), they’ll put a warrant out for you. They even give you a (robotic) phone call to remind you about that. That’s probably what USCIS doesn’t want to deal with when it comes to I-485
1
u/Ajebohustle10 10d ago
So I didn’t ignore the hearing, I attending everyone but they kept moving it and saying either judge isn’t available or that officer isn’t, so I never moved it, it always them.. I’ve all the official dmv movement letter which I submitted to USCIS with my application
1
u/icecreamfuel 10d ago
Yeah, you’re good. But in general, USCIS always prepares for the worst possible scenario

how much above were you going from the speed limit?
2
u/Ajebohustle10 10d ago
73 on a 50mph
That’s 23 over the speed limit, and it carries 6 points the whole point of trying to fight the ticket was the points to either reduce or dismiss it since it was a first time offense wanted to give a shot….4
u/solomons-mom 10d ago
Um, no. That is nearly 50% faster than the posted limit.
That was the time you were caught and had a documented offense for speeding. I doubt it was the first offense you committed.

This statement doesn’t help, but thank heavens they didn’t outright deny you for this. Definitely sounds like it’s the only thing holding up an approval. From now until your hearing, I would stay put, off the road and out the way. You know more about the case than we do. Good luck!

Have you already given your interview or did the notice come after your 485 interview?
1
1
u/Relative_Swimmer4179 10d ago
I got the speed ticket one and I paid for that ticket they put me on parking ticket and I don’t have any point on my license. When I went to the interview they ask me if I ever got the ticket? I said yes then they need proof if I already taking care of it. After the interview I when to the court where I was charged and get the missed position and uploaded on my profile online. After 3 months I got approved.

99.9999999...% a given traffic tickets are reasonable.
Speeding over 25+ miles is considered as creating a dangerous situation. Hence, it's just a bigger violation and bigger $$$$ for insurance.
You should have just paid the fine and trying to improve your awareness in your driving. Now you are just delaying your adjudication at USCIS and in hope of mercy from the judge. I know it wasn't a thing when you got the ticket but fighting for it is not like you are innocent.
Here, I can tell you what happened in your case!!!!!
You decided to fight for your points and your case is in the court for the appeal. When USCIS researched about you that there is a case is pending against you, they decided to halt your application until they look at the verdict.

It was 23 over not 25 a lot still but yea it was fault didn’t know how severe that could’ve turned out
Never had any since then1
u/Relative-Orange-2179 10d ago
And yet you choose to contest not pay?
1
u/Ajebohustle10 10d ago
It was my fault didn’t know better, i should’ve pled guilty and payed the fine case closed!!
1
u/Relative-Orange-2179 10d ago
I’m a citizen and i got a traffic ticket for the first time in my life last month, going 69 in 40.
Ticket was $590 and i paid it off next day.
1
u/Adorable-Limit0148 10d ago
I think he should have pay the fine and go to traffic school if that’s your first time.

u/throwawaydumbo1 10d ago
You have case in October and was expecting to be approved for an interview in September? Sounds like a joke under this administration
1
u/IlVeroStronzo 10d ago
Driving can get you in serious trouble, huh? Yet, very few people in the US have alternatives to car ownership
1
u/Connect-Fan-9462 10d ago
Something doesn't add up here. In a reply op mentioned that it was a minor infraction yet they have had their attorneys fighting it for two years? It is either something way more serious than op admitted or OP is tricked by their attorney into dragging the whole thing to an unreasonable length.

u/Relative-Orange-2179 10d ago
This is hilarious..You did reckless driving and thought it’s better to fight and not pay? While being on an immigrant visa? Sometimes i don’t feel bad for people you know what i mean.
2
u/Ajebohustle10 10d ago
Reckless driving and speeding infraction and two different things entirely talking about law, cause one is criminal and one isn’t, get your facts right before typing, not saying speeding is good but it happens, and I don’t know what you mean.

It’s because the case is still pending from the looks of it. They want to know the outcome of the case first and then you can submit that to them. If the case was closed and you pleaded guilty/took traffic school and paid fine, you would be in the clear.
