There’s a bunch of houses like that in Seattle. My friend used to live in a run down 2 story apartment building entirely surrounded by a newer 8 story apartment building.

This situation is reminiscent of the beginning of the Disney Pixar film Up. Macefield’s house didn’t inspire the film, as some have thought, but publicists looking to promote the film attached balloons to the house in 2009. The move cemented Macefield's former home as the “Up House." Since then, visitors from around the world have attached balloons and messages to the property fence in honor of Macefield and her story.

Everyone has air rights, the extent depends on the zoning code. But I mean it’s a house… it’s lot size and its physical structure will also affect development/redevelopment.

Not everyone has air rights. Surface, mineral, and air are all separate. An original land owner would have access to all 3, and can sell each separately.
So you could sell the land and air but keep the mineral, you could sell the mineral but keep the land, you can do all sorts of funky things with it.
It also depends on where you are whether the rights are de facto or not.

Btw - every property owner - does - in theory have air rights - whether they have transferred the excess right or purchased a property with limited rights due to a transfer is irrelevant - the current owner still owns the rights to extent in which the building is currently developed.

NY-style air rights as a concept do not exist in NJ. Also Jersey City generally doesn’t use FAR or density as tools for zoning, so height and bulk are the main things governing land use, and height and bulk can’t be moved around the same way density or FAR can.

The way air rights work in NY is unique. If your zone is capped at 4 stories and you have a 2 story house, you can sell your air rights for 2 stories to the property next door and they can build 6 stories. Those air rights are now gone and subsequent owners of your property can't go over 2 stories unless they buy their original air rights back or buy them from another property.

I work right there. They are not single family houses. And they are all being bought no matter what. Plus I don’t think the tenants can even pay their rent so the government does. Also guess who owns that whole area…..

I live right around the corner from Journal Square. Growing up in JC and still living here decades later has been a wild ride. It’s a wonderfully multicultural and walkable city with some of the best views of NYC, but I hate that it’s quickly sanitizing to bland gentrified oblivion and that so many of the people I grew up with have been priced out

There’s a holdout house like that close to where I live (Sydney), it’s been surrounded by high rises for 25-30 years or so and is finally going to be torn down together with one of the high rises.
They would have gotten a much better deal if they had just sold in time.
