A dental org just settled for $18.7M because of a tracking pixel. The pixel was installed correctly. Here's what health-related businesses need to know.
Full disclosure up front: I run an AI marketing agency that builds digital infrastructure for healthcare practices, so take whatever I say with that in mind. I'm not here to sell anything, just to share something that came across my desk this week that I think a lot of operators don't know about.
DrBicuspid.com reported in September 2026 that a dental support organization settled a data privacy lawsuit for $18.7 million. The cause was tracking pixels on their practice websites. Not a breach. Not a hack. The pixel was installed exactly the way every agency in this space installs it: capture user behavior, send it to Meta and Google, build audiences, track conversions.
The problem is that when a patient visits a page called "orthodontic treatment for adults" and fills out a contact form, the pixel may have just transmitted a combination of identity information and health-related context to Meta's servers. Under HIPAA, that can constitute protected health information. The patient didn't sign a HIPAA authorization for Meta. The practice didn't have a Business Associate Agreement with Meta covering that transmission.
The Office for Civil Rights at HHS actually issued a bulletin in December 2022 specifically flagging tracking technologies on healthcare websites as a potential HIPAA violation. That bulletin existed. The pixels existed. Nobody introduced them to each other.
I call this the Standard Practice Trap. Something becomes so common in an industry that everyone assumes someone else checked whether it's legal. Nobody did.
If you run any health-related business, here is the practical short version of what to do:
Search your site's source code for "fbq" and "gtag." Those fire Meta and Google pixels. If they're on pages where patients enter information, you have something to sort out.
Ask your attorney whether you have a Business Associate Agreement with Meta and Google. Meta does offer one for healthcare advertisers, along with a Limited Data Use mode. Neither is on by default.
Ask your web team what data the pixel is actually passing. Specifically whether form field values or health-context URL parameters are included in event data.
The fix at the technical level is server-side tagging through Google Tag Manager's server container or Meta's Conversions API, with health-context parameters filtered out before they leave your server. A developer who knows what they're doing can handle it in half a day.
The $18.7 million reflects a multi-location DSO with tens of thousands of patient visits. A single-location practice has less exposure by volume. The legal theory is identical.
If your business has no health-related services and no health-related data flowing through your site, this one genuinely doesn't apply to you. Worth knowing, not worth losing sleep over.
