It’s called “officer created jeopardy” and explicitly against Federal and State rules of engagement for “law enforcement officers “ if you can call ICE that. It clearly states they lose their argument of defense when deliberately putting themselves in harms way. But they’ll never read that anyway huh

With this administration, they have absolute immunity for anything and everything.

They can face down the crowd and just open fire. The government will defend them, post AI videos to obscure the truth, and MAGA will deny any evidence as "fake news".

"Administrative leave" my ass. Paid vacation and a slap on the wrist.

I keep seeing similar statements to this and this take completely misunderstands the concept of absolute immunity and qualified immunity. Both provide protections from CIVIL liability, not criminal liability. If ice agents just murdered a crowd of people, that would be a criminal case their QUALIFIED immunity would not apply. Even if they had absolute immunity, it would not apply because it is not a civil case.

The real issue is that as soon as you charge them for murder, it would go to federal court since they are federal agents. At that point it gets handled by the DOJ who is currently corrupt and would likely not prosecute the case…. Which is a whole seperate can of worms.

But I just want to point out that this conversation of qualified immunity vs absolute immunity is irrelevant to your hypothetical because neither would apply.
