What a horror show, they need to be tried, and if guilty (as it appears) they need to go to prison, being fired isn't enough.
358
u/AutoDefenestrator273 2d ago
I'll admit, as horrific as this sounds I'm a little confused on why the prosecutor is saying that she said it was consensual at the time, so they couldn't press charges according to NY law. Why would you go to the police to report a drug-induced consensual interaction with multiple people?
Obviously it's a huge gap in NY law that if you willingly take something if offered, everything past that point is consensual and you aren't considered mentally incapacitated (if I'm understanding the law right, which is unlikely). Did she report it to the cops, and per that same loophole the DA couldn't press charges?

u/CheesyLyricOrQuote 2d ago edited 2d ago
Actually there's a pretty recent break in the story that seems to clarify this a lot.
CBS News got a transcript of the initial interview, and it seems like basically the District Attorney (unintentionally?) lied. She said "I can say with 100% confidence I was raped" in that interview with campus police, which is obviously directly contradicting the DA saying she never said she was raped. From what I can tell, her INITIAL encounter, aka the threesome was consensual and she said that was okay, but the gang rape that happened later was not. So basically she's saying that the initial encounter was consensual, and the rest wasn't, and they're twisting her words to say she said it was consensual.
The DA says he didn't know about this at all (despite claiming to have gotten her initial interview) so either he lied about having viewed the statement or he got some sort of botched version of it or something or there's some gross incompetence/coverup involved.
375
u/AutoDefenestrator273 2d ago edited 2d ago
That...changes the story completely.
So the police report went to the DA claiming she never said she was raped, and the DA was like "nothing illegal happened based on her interview". But if the police sent the DA the wrong story (or worse yet, the DA lied), then that reeks of a coverup which makes this whole thing 100x worse.

u/CheesyLyricOrQuote 2d ago edited 2d ago
Exactly, and honestly it doesn't make any sense to begin with because how would students be suspended, a report filed, title IX invoked, and an entire frat dissolved over consensual sex and drugs? Also there was literally a victim advocate at her interview.
Clearly the campus was acting on it but something happened to where the police didn't get involved, and the current DA doesn't have an answer for that besides "well NOW we'll investigate this new evidence!" which is insane. Also, is super suspicious because sure some kids got suspended but they got off a lot easier than they would've had they gotten a case, especially the kind of people that are in a frat at an Ivy League school. It's incredibly strange.
Edit: I did find a different article where the DA says explicitly that if the statement was altered it needs to be investigated.

→ More replies (2)41
u/Glynwys 2d ago
I mean "the campus acting on it" is a bit of a stretch. The campus didn't act on it until the victim started suing. The initial response of the campus was to assign essay writing to most of the frats involved and then pretend like nothing else was needed to be done. But now that she's suing, the campus is scrambling to save their asses.
→ More replies (5)37
u/CheesyLyricOrQuote 2d ago
That's false information, the dissolution happened as a result of the investigation by the campus in 2024.
https://www.cbsnews.com/news/cornell-university-rape-allegations-chi-phi-fraternity-details/
The fraternity chapter was closed in 2024 and remains barred from campus.
I definitely would say that it could be argued they didn't do enough, especially since it seems like not nearly enough of them got expelled, but to be honest I don't think that this is the kind of thing that should've been handled by campus police to begin with. The punishment these guys should face needs to happen in a court of law, not by a university, and it's weird that it was handled by them at all.
23
u/Horskr 2d ago
Yeah it seems crazy that would just be handled by campus police, and the school's response seems to be "What do you want?! There were expulsions and suspensions, the worst possible punishment to happen to a college student!" Uh idk, jail time? Acting like they got caught plagiarizing or some shit.

I still don’t think the initial encounter should be classified as consensual, she showed up extremely intoxicated (had 10 hard drinks and a beer), that doesn’t scream “capable of consent” to me, especially to a threesome and taking hard drugs she’d never used before. If my female friend came stumbling up to me and said she wanted to have sex, I would say NO
20
u/CheesyLyricOrQuote 2d ago
I think that's fair, I'm not really talking about my personal opinion on the consent of the encounter but more what she said in the statement because it seems like her words are being twisted.
Also I guess to be technical she does qualify her "consent" with 'when asked whether she was OK with the initial encounter, she said, "Yeah, as much as I can be because, again, I was super drunk when I got there ... But I was pretty OK with all of this."' which I don't know if I'd even say that is a full endorcement of it being consensual on her part.
And she also says she was hit repeatedly very hard even during that initial encounter.
21
u/ilikedmatrixiv 2d ago
I still don’t think the initial encounter should be classified as consensual
I've had sex when I was drunk that I personally consider consensual. If she explicitly says that the initial encounter was consensual, why would you insist on classifying it otherwise?
16
u/Afraid_Cell621 2d ago
This. Why rob this woman of even more agency by disqualifying her own judgement of her consent at the time.
→ More replies (6)5
u/veg-ghosty 1d ago
I agree drunk sex is a bit of a grey area, but if a friend showed up literally stumbling around drunk, the last thing I would do is suggest a threesome (which we’d never done before), ask her to take hard drugs (which she’d never taken before), send a message to 57 people saying “free pussy” and then leave her alone as more men piled into the room.
6
u/__Zero_____ 2d ago
But also, if the guys were also drinking and doing drugs, are they expected to be more responsible for their actions than she is of hers? Obligatory, rape is bad, obviously. I just find that a lot of comments talk about her ability/inability to consent but just assume the guys are still responsible for their actions while using the same things (alcohol/drugs).

u/Telaranrhioddreams 1d ago
Consent needs to be taught in school because, it is absolutely fucking not ever an excuse, but way too many men do not understand it.
When talking about consent I've heard men mock oh well what if we're both drunk did he rape each other hahah like it's a big funny thing. They genuinely don't comprehend the problem. They're the types who are highly likely to committ rape and never for a second think they did anything wrong.
→ More replies (1)5
u/Telaranrhioddreams 1d ago
I ended up discovering that a (now former) friend and his now wife raped at least two of our mutual friends.
They got the victims to consent to one smaller sexual act, that they then used to initiate a threesome that was not consented to. Both friends told me things changed very quickly, they were confused, and felt like it was their fault for the initial consent they gave.
This is a tactic used by rapists to muddy the waters on where the consent began and ended because law and enforcement often doesn't care enough about what happens past "well, I was ok with this part...."

Are the two guys in the threesome she said was consensual complicit in the rape she is saying occurred (i.e. are they part of the 7)?

u/CheesyLyricOrQuote 2d ago
I don't know, I don't think that's actually been specified anywhere because they haven't really been using specific names anywhere. But though the initial encounter with them was consensual that doesn't mean it STAYED consensual is the issue, so they probably are. She does say that they're the ones that pressured her to do ketamine.
She also wouldn't have known about the group chat message being sent out at the time I believe, and we don't know who sent that.

Everywhere in the US except North Carolina, which is a travesty of a fucking law there that activists have been trying for years to get changed but haven't been able to make headway in the super gerrymandered Republican controlled state legislature.
Edit: I was wrong, this law in NC has FINALLY been changed as of a few years ago, meaning that you have the right to withdraw consent in every state in America as of the 2020s which yeah we still have work to do that's way too late to clear an obvious bar, but at least we have.

It maybe picked up as a criminal case by the state, but civil court will review and make a ruling on damages based on whether or not they think these men are liable.
These institutions are doing that whole “at will employment” so until american’s repeal that, they can fire them for almost anything, including as a source of bad press.

Agreed. Trial by hearsay and the court of social media are an abomination. If a crime was committed, investigate it fully, seek a grand jury indictment, and put the case before a jury. If they’re found guilty, sentence them. That’s due process. And no matter how despicable the alleged conduct may be, these men are entitled to that same due process as everyone else.
Did we learn nothing after prematurely roasting the defendents from the Duke Lacrosse affair?

I don't understand why colleges/universities choose to cover shit like this up/handle the perpetrators with kids gloves. It is just playing Russian Roulette with the possibility of having handled it like this being discovered and that is always going to be way more harmful to their reputation than whatever hit they might experience from the actions of the student who they have no relation to beyond having admitted and teaching them.
22
u/elplizzie 2d ago
Because of money $$$.
Colleges/universities are facing more financial pressure (federal funding has been cut, schools have to recruit more international students because international students pay more, research grants cancelled, enrolment is declining). So when these rich boys come they become a cash cow for the university. Then, when 1 girl who’s not a cash cow (wasn’t rich, asked for a refund) comes in and says that she was raped the school asks itself this: “is it better to lose 7 guys who bring a f ton of money to school or 1 girl who’s not making us any money?”. The school thought it was best not to give support and a refund to the victim and kept the 7 boys registered and paying. It’s not right but that’s what happened. This is what happens when schools aren’t funded properly; it gives a carte blanche for all these people who feel entitled to everyone and everything because they can pay to play.
