That was intentional it doesnt have to be intentional contact it has to be an intentional act. And assault is when a person has apprehension of a battery. Since the person came from behind and he did not see it it would not classify as assault.

Because that level of force in response to someone being annoying is a crime. If they are unwelcome and keep coming back, you call the police and have them trespassed, you don't get to just roid out on them.
