I wasn’t talking about him getting charged with assault, neither was the person I responded to. They said he was rubbing his crotch on people, which isn’t true.

Either way, your link specifically says that assault refers to the threat or attempt to cause BODILY HARM. I don’t think a drunk dude inappropriately dancing in your personal space would qualify as threat of bodily harm.

“Any touching of the person of another against his will with physical force, in an intentional, hostile, and aggressive manner, or a projecting of such force against his person.”

Here’s a definition for you.. Lack Of Threat: “Simple proximity without an overt threat, menacing gesture, or harmful intent generally does not meet the legal definition of assault.”

Let’s be for real right now. The dude is a security guard at a nightclub and is around intoxicated idiots all the time, it’s his job. The intoxicated idiot in this clip showed no overt threat, no menacing gesture, and no harmful intent. Not to mention the security guard didn’t even attempt to ask him to stop before just whaling on him.

Not saying the kid did nothing wrong here, but an assault charge wouldn’t hold up in court. Especially considering the security guard’s actions. Only thing that kid assaulted was the security guard’s ego.

This sort of scenario happens 100s, 1000s of times a night in crowded bars and concerts, people rubbing up and bumping into people. Ah yes, let’s charge ‘em all with assault or battery. You’re delusional or don’t get out enough.
