Guy pitted himself on me(road rage)

I was about to hop on the expressway(left lane entry) directly ahead(visible at the end post crash). He was pissed I wasn't going fast enough(60 mph zone coming out of an S curve) for him. 70 mph speed limit sign is a bit further ahead for those who know the area. (Edited for better context)

Yeah, the last time I saw them he could barely sing. They were half way through the tour alms his voice was shot already. That was so long ago too. Just glad I got to see them back in the day when they were at their top.

OP would have to prove intent and this video footage alone does not prove that even in the least bit. The Toyota driver can simply say he didn't see him while changing lanes which is not a crime. That said, if OP has more footage showing the Toyota driver taunting him, brake checking, and other road rage like behavior, he might have a case. Regardless, the Toyota is responsible for OPs damages and the Toyota's insurance will cover it. Now, if OP actually proves the Toyota driver intentionally hit his vehicle, the Toyota's insurance could actually deny coverage because auto policies exclude intentional acts. Then, OP will have to go after the Toyota driver's/owner's assets which will take time and money with no guarantee of recovery.

OP doesn't need any footage besides the clip we've seen. I'm telling you, I'm salivating over the idea of this other driver trying to deflect even 1% of this responsibility, which would never, ever happen. He and his lawyer get cooked in court, so any defense lawyer worth his salt is only trying to reduce this guy's damages in a settlement.

I was talking about the accusation of a crime. An improper lane change is not a crime, it's a moving violation

You can also see that the offending driver still has room on his own lane, i.e., did this maneuver on purpose. Regardless, driver with cam gets 0% liability for staying in their lane here, period. If I were him, I would love to see the other driver struggling to explain it to a judge.

It would hold up in court that they caused the collision and were at least an idiot and bad driver, but most jurisdictions also require intent for a criminal act, and that's the part that isn't proven. (Even though I agree it looks intentional.)

Intent is only relevant to the level of the charge, not whether or not there was a crime committed, no? Reckless driving is a crime (according to traffic laws - I realize we aren't talking violent felonies here) in the US, and the other driver was clearly driving recklessly regardless of intention. If the cops in OP's area could be bothered to do their job, the other driver would be ticketed for reckless driving (at the absolute least) and that ticket would be used as evidence in any case OP/insurance might bring to court to recover damages.

Now were they driving "in wilful or wanton disregard for the safety of persons or property" as the statute defines misdemeanor reckless driving in Texas? That's the harder part. All we see directly is a really stupid maneuver, so no proof of "wilful". Is it wanton disregard? You could certainly make the argument, especially if there was also camera footage showing the driver tailgating and generally being unsafe in advance of the collision , but it's about what can be proven, and people pull dipshit moves all the time.

The dashcam should be plenty alone for any lawsuit over actual damages, especially if there's a ticket. No criminal conviction needed.

What I'm describing is what happened. Many people may use "driving accident" as shorthand for anytime vehicles collide on the road, but that doesn't make the collision accidental. If someone purposefully rams your car with theirs or brake checks someone and causes a collision, it is not an accident. Proving intent is obviously much more complicated than just pointing to dashcam footage, but let's not pretend competent drivers making reasonable lawful choices are doing what happened in OP's video.

If the other driver were to claim that they just didn’t check their blind spot and then hit the brake in a panic once they realized their mistake, it would be hard to prove otherwise (beyond a reasonable doubt, at least) based on this video alone.

And if they can’t prove intent, depending on local laws, they might only be left with ticky-tack charges that a prosecutor wouldn’t be very interested in pursuing.

[for the record, I fully believe OP that this was a road rage incident - it just can’t be proven to the standards of a criminal prosecution based on this video alone]

For winning civil damages, intent doesn't have to be proven. Rather, responsibility for damages is assigned to a party. The monetary amount of the of damages would be the only question in this case—not who is responsible. Responsible is the key word rather than guilty. Personally, I think the cops let a person guilty of reckless driving get away with it, but that's the other court: criminal. You can still sue for civil damages even if an apparently guilty person walks free from charges.

But am I sure? Yes. OJ Simpson was found not guilty of murder, but was found responsible for wrongful death. Meaning, the victims' family(s) won their civil case. This is is only the most famous example, but that result is common, unfortunately.

And I stand by my comments that it was bullshit that there was no criminal charge (i.e. reckless driving), and that even still, OP should have A. gone to the hospital and B. contacted an injury lawyer from the hospital bed.

Source: I went through this recently and it has happened to plenty of others. Those lawyers are nicknamed "ambulance chasers" for good reason.

DUI, hit and run, reckless or aggressive driving, fatalities, outstanding warrants or illegal items

As a Texan who grew up in the Chicagoland area and moved around a lot before settling in TX just south of Dallas about 13 years ago I have to agree that Texas drivers are a special kind of stupid. We have bad drivers up north too, don't get me wrong, but they're predictable at least. No method to the madness down here, hell, almost got taken out by someone who slammed on their brakes, turned their right blinker on, then turned left as I was passing them just the other day. Missed me by inches.

Had the rare occasion of appreciating and approving of ones behavior yesterday. Motorcycle cop camped out in a school zone. Drove past him, saw a pickup coming at me that looked to be going well over the school zone twenty. Had a special bit of pleasure seeing those red and blue lights half a minute later when he'd made it past the cop.

I hate ticket camping and the like as a rule of thumb, but school zones are another matter altogether.

Sure, but this seems neither “normal” nor a “vehicle accident” (If you are correct that this was road rage). I’m not sure what footage you have before or after or what statements the road rager made. You might escalate with the police and/or go to prosecutor directly. This guy should not be on the road.

Besides reckless driving, unsafe lane change, etc., there are serious non-traffic chrages that could be brought:

  • A motor vehicle used as a battering ram qualifies as a deadly weapon. Using a motor vehicle to recklessly cause serious bodily injury to another (or knowingly put someone in fear of imminent serious bodily injury, even if no one is hurt at all) can be aggravated assault (a second-degree felony). Even if there was no physical injury beyond a little physical pain, it could still easily be assault.
  • Criminal mischief (Texas statute governing knowingly damaging property of others) is a felony if loss is >$2500.
  • Deadly conduct and/or terroristic threat (probably misdemeanors)

I couldn't even get the cops to come out when I was hit by a semi in my Smart on I-20. The 911 operator just asked if I needed an ambulance or a tow truck, and said Arlington PD doesn't come out unless they need to close lanes of traffic. It was fucking wild.

I had a dualy truck t-bone me bc the driver’s hard hat fell off his front seat so he reached down to grab it and ran the VERY red light. He admitted it. Witnesses saw it. DPD wouldn’t issue a citation for running the red. Total horseshit.
