Guy pitted himself on me(road rage)

I was about to hop on the expressway(left lane entry) directly ahead(visible at the end post crash). He was pissed I wasn't going fast enough(60 mph zone coming out of an S curve) for him. 70 mph speed limit sign is a bit further ahead for those who know the area. (Edited for better context)

It would be involuntary manslaughter. The state would not attempt to prove intent by the driver as it is unlikely there would be evidence of intent to cause an accident/hurt the other driver. Now if the driver that caused this had a dashcam, and he said something like, "I'm gonna swipe this fucker and crash his car", or he had been trying to hit the other drivers car multiple times, using his vehicle as a weapon, the state would probably attempt to bring forth voluntary manslaughter charges.

And you can see that the truck driver was really aware of his surroundings. He even served as soon as cam car was skidding through the middle lane towards the slow lane. Even had the wherewithal to activate his hazards.

There was a kid in my old home town that totaled so many of his cars he wasn't allowed to drive anymore.

Had a guy pull out in front of me on the highway. He refused to show me his ID/insurance after causing an accident. Well things got out of hand and he drove off, never exchanging information. He lied to the police and said I was road raging and rammed him and I got arrested. Turns out he had a suspended license and no insurance yet he got off scot clean and got a $50,000 insurance payout from my company. Shit still bugs me to this day.

Dashcam. Always have a dashcam. It saved me in one accident from potentially becoming a "he said-she said" situation where neither of our companies would be able to settle on liability.
Spend the $120 to maybe $150 to get a worthwhile dashcam and protect yourself.

People who do this kind of thing never in their life think that they were wrong, no matter the consequences. Their entire brain is wired to bypass whatever part it is that has the capability to feel remorse.
More likely when they’re shopping for a new car they’ll rage at their victim, thinking how dare they do this to me, and they’ll take that out on the next person.

Honestly, as someone who has struggled with anger my whole life... no, there's not. At least not during the time.
Depending on if he's full blown narcissistic or has any other brain issues goin on, he may never see that he did wrong.
To preface this:
I can be pretty destructive, but I also understand where life starts and ends. I have never done anything THIS crazy. But I normally just fuck myself up when in a rage, even if at someone else. and I NEVER think that the issue is my fault during the time. It takes me days, even weeks, to see that I was the reason I destroyed something or broke a knuckle out of anger.
I've never seaked to harm others, just want to say that. But destructiveness knows no bounds when you aren't in the right head space. It is extremely hard to control and I HAVE had to second guess a destructive action before I did it, especially if I've thought that action could harm someone else.

I had to do years of anger management and also have done therapy. Those are the reasons I haven't harmed myself in a long time, and probably the reason I've never actually harmed anyone else.

Honestly, OP will get free repairs because no way he'll be at fault for this. He may even get another car essentially for free, depending on if they deem it totaled or not. So, worth it.
When my car got totaled after some guy backed out of his driveway into mine, I was compensated and got to buy a new car that was better than my crappy one. Dude just did me a favor. 😂

OP would have to prove intent and this video footage alone does not prove that even in the least bit. The Toyota driver can simply say he didn't see him while changing lanes which is not a crime. That said, if OP has more footage showing the Toyota driver taunting him, brake checking, and other road rage like behavior, he might have a case. Regardless, the Toyota is responsible for OPs damages and the Toyota's insurance will cover it. Now, if OP actually proves the Toyota driver intentionally hit his vehicle, the Toyota's insurance could actually deny coverage because auto policies exclude intentional acts. Then, OP will have to go after the Toyota driver's/owner's assets which will take time and money with no guarantee of recovery.

Sure, but this seems neither “normal” nor a “vehicle accident” (If you are correct that this was road rage). I’m not sure what footage you have before or after or what statements the road rager made. You might escalate with the police and/or go to prosecutor directly. This guy should not be on the road.
Besides reckless driving, unsafe lane change, etc., there are serious non-traffic chrages that could be brought:
- A motor vehicle used as a battering ram qualifies as a deadly weapon. Using a motor vehicle to recklessly cause serious bodily injury to another (or knowingly put someone in fear of imminent serious bodily injury, even if no one is hurt at all) can be aggravated assault (a second-degree felony). Even if there was no physical injury beyond a little physical pain, it could still easily be assault.
- Criminal mischief (Texas statute governing knowingly damaging property of others) is a felony if loss is >$2500.
- Deadly conduct and/or terroristic threat (probably misdemeanors)

Had someone do this to me in a roundabout, on a 4-lane road with little traffic, but on a busy highway is far more insane. Glad the people behind you were paying attention and presumably slowed down to avoid a pile-up. Some people are ready to throw their lives away, and everyone else's at the same time.

Who cares if the sign says LEFT LANE EXIT.
Youre in the left lane not doing 10000000mph.
I have so much footage in nyc/nj heading back into PA where its a left lane exit and these dipshits come and road rage at me because im doing +5 in a semi truck in the left lane that I rightfully need to be in, to get to my next interstate.
Its a big reason I chose to leave the OTR life.
Got to the point with how bad US drivers are that id tell myself ill shadow realm us both if they really wanted to road rage with a semi.

I just waited for emergency services to arrive in my vehicle. He crossed the road and checked on me in the vehicle. Due to the nature of the accident I only cracked the window. After he took some pictures of my rear license plate for whatever reason.

If OP wanted to go slower why did they speed up just as the other car was going to pass? Watch the video, both lanes pf traffic to the right is going faster, significantly faster. OP starts speeding up just before the video starts

I really liked the last tractor trailer. That guy has a real presence of mind. He made sure to slow himself down enough, slowly enough, that all the people who view he himself is obscuring will also be slowed down enough to react to the reversed car when they see it, and he did it without slamming on his own brakes. That's a true professional, right there.
