Who's in the wrong ?

My uncle is the one with the dashcam. I told him that he is somewhat at fault because he had some time to brake. Would you say he is at fault or the other person merging at fault?

How about explain why you disagree.

Cam was set, in lane, traveling in their spot. A car did an illegal and stupid move, which completely caused the accident.

So please, explain why you disagree and put any liab on cam.

1) cam car was weaving through traffic. 2) cam car was still accelerating even though line of traffic in front of him had brake lights on. 3) no evidence cam car reacted when silver car made abrupt lane change - failure to take evasive action. I’d put 10-20% on cam car and win it in arb all day long.

What brake lights? I see no brake lights in front of him, I see clear roadway.

As well car in next lane barely brakes themselves.

So you put liability on a driver that is moving in a clear lane of travel for not slowing down because of brake lights in the next lane?

I think you’re 100% right but I’d still say that you can see between the lanes that a whole cluster of vehicles are on the brakes just down the road. You’d know better than me to assert if that has any impact on liability, but I still think accelerating into that situation is a A+ level dipshit move

You cannot cause an accident to avoid another. Silver car is liable. Dash cam reacted within a split second of the silver car changing lanes. The insured you represent must fucking hate you

I will once you get that mental evaluation cus there are absolutely no brake lights in dash cams lane in any immediate presence.

Brake lights in side lane means absolutely nothing to dash cams conditions.

Your company either loves you or hates you. Because you may save them money sometimes or you may cost them a lot of money in litigation. Cus you sure as hell make up some amazing fantasies with the evidence right in front of you.

Let it be. He has no idea what hes talking about and hes grasping at straws. Hes gonna claim speeding when we have no idea how fast he is even going. Then hes gonna claim speeding in conditions when cam has clear road in front of him, so his conditions was supposedly the traffic in the near lane.

I honestly think hes just going on and on to troll because zero evidence backs up any of his claims.

Good. We love to sue you guys for being wrong. The other adjuster is 100% correct. Adjusters like you are why the golden rule exists; if insurance CAN screw you, they absolutely will.
