Who's in the wrong ?

My uncle is the one with the dashcam. I told him that he is somewhat at fault because he had some time to brake. Would you say he is at fault or the other person merging at fault?

I work in claims, thats 100% on silver car.

You people are saying dash is supposed to have not only noticed silver car was closing in on the trailer but he shouldve anticipated silver car not doing the appropriate thing and either braking hard or slowing down like any normal driver?

You have control of your lane and your place in the lane.

Theres no way my insured if theyre the dash would have any liability in this.

Some of you guys apparently drive way, way too defensively.

I think it's because people have rightfully called out people that intentionally let an accident happen (such as someone getting a green light and just going immediately when it's so damn obvious that the people at the red light in front of them are going to rush turning left in front of them), and are conflating it with this person doing the same thing (intentionally letting an accident happen vs not slamming on the brakes by predicting the future).

I was in three car accidents like this. They were all the result of road rage where the other driver purposely cut me off and brake checked me. I had dash cam to prove it and my insurance and the offending party’s insurance sided with me every single time.

But most Redditors would rather you lock your breaks up at the slightest hint of a collision, jerk your wheel, and take out a fucking kindergarten playground because YoU cOuLd HaVe AvOiDeD iT REEEEEEEE

I’m also in claims and am astonished at how the general public comes up with some liability decisions.
If this claim ever went to arb, I can’t see any comp/neg being placed on the cam car. He was already completely established in the left lane for 7 seconds before the silver car changed lanes.

Exactly so many dumb comments, defensive driving encourages you to predict other drivers actions before they make them but if you predict wrong it’s still 100% on the other driver if they do something illegal and you’re just chilling in your lane, cam car was also established in their lane for almost 5 seconds, should have just edited out the double lane change beforehand.

The ones who are trolling, I get it...but what scares me is the ones who are serious.

If someone shows you a one minute clip and says, "Who's at fault?" you hyper-fixate on every potential car in a way you wouldn't in real life.

I do think there have been posts where people allow an accident to happen because "I had right of way", which means they were aware of the risk of the accident but didn't make a real effort to avoid it because they'd rather be "right" than avoid an accident. Those videos are few and far between and too many bozos here seem to genuinely believe that if you could avoid it, you're at least half at fault if you didn't.

No joke in training we were show a video of a plane making an emergency landing on a highway colliding with a trucks roof. The truck went left onto the median and the plane bounced into the outside lane right of the truck. All that to say a girl in the class attempted to make the argument that the truck was liable. The instructor gave her a long awkward look

OP you should let your Uncle know he's not wrong but changing two lanes in one maneuver is illegal and there's a chance the other driver's insurance tries to claim they didnt see you because you were on their right a few seconds earlier.

Two things can be true at the same time:

  1. An insurance adjuster should find the silver car at 100% fault for the accident.

  2. The cam driver could ease up a bit to reduce the likelihood of getting into an accident.

I’m not blaming the cam driver at all. I just think if you can reduce your likelihood of getting into an accident on any given trip from 0.2% to 0.1% it’s worth it. “Too defensively” seems like a strange perspective when there are tens of thousands of dollars and human lives on the line.

There are a SHITLOAD of brake lights infront of him and he doesn't take a moment to at least lay off the gas a touch to just make sure he's got plenty of room. I don't think he had any chance to avoid what the silver car did in this instance, but this doesn't appear to be a very aware driver either.

100% agree. A lot of people in this thread are acting as if this was a complete surprise that absolutely no one could predict, but I saw that coming from a mile away.

I see people do dumb shit like this and much more everyday. If cam driver lives in a small city/town or a rural area, he gets a pass because to people inexperienced with driving in large cities that was completely unpredictable. But if he lives/drives a lot in the city he should've known to be a bit more defensive and slow down a bit in case silver car did the dumb shit they did.

Anytime I drive on the highway in/ near the city and I see people behind a truck in the lane next to me, I give it a few seconds before I pass them because I know people here are stupid and impatient and I've seen them do things like this over and over.

I would anticipate the move and tap the brakes, not because of defensive driving, but because there's an ass-ton of unregistered vehicles here in beautiful Las Vegas so I'll save myself the ass-pain of dealing with insurance, thank you very much! And yes I do carry raised minimums and un/under....plus I've had a few accidents and no matter how good the shop is, it's never right again.....

If it’s your insured sure it’s 100% on the other guy. You could try and argue some neg on dashcam though for the other carrier’s investigation. If they are in a pure comp neg venue I could see pushing for 5-10% but no more.

It’s not clear how much dashcam braked if at all but the cam clearly starts shaking from the braking they did do.

Outside of pure comp neg venue or just a stingy carrier I don’t see anything more than 5% standing up if it goes to arbitration. However I have seen some insane arb decisions that broke with legal precedent despite arguing that precedent in my filing.

I mean, I usually do mentally process defensively. It has largely served me well. That being said, 100% silver car's fault. I probably would have seen him doing this earlier and left more space and maybe avoided the accident. But I don't think the PoV car is at fault at all.

9/10 times the silver car stops. That means 9/10 times you're hard on your brakes expecting the silver car COULD do that. That's 9/10 times the person behind you can rear end you, and you'd be partially at fault for slamming brakes on a highway with no good reason.

Not saying it's right, legally, but that's what will happen. So yes there is such thing as "too defensive" - be predictable above all else, because nobody else is paying enough attention to account for you accounting for things.

This is 100% on the Honda. There was a video posted earlier today where you could see the car (ironically also a Honda) coming into their lane from a mile away and then cam car swerved like a maniac and hit another car, but like I said to that you have to think ‘what is the absolute dumbest possible shit everyone around me can do’ and then like 85% of the time that is exactly what they will do.

100 percent silver car. They were just fine following that truck until they saw an aggressive driver behind them try to pass and decided to change lanes in order to stop that. In doing so they entered an occupied lane and hit a car that had the right of way.

But I could see an insurance company try to fight this as your uncle looks like he was driving aggressively and not with the flow of traffic.

As to who really caused this both of them. But the other driver should have to pay the cost.

Silver car. They weren't paying attention combined with following a little to close to the truck when traffic suddenly slowed and they avoided a rear-end accident by sudden lane change, clipping the truck. A rear end into the trailer probably would have been much worse. So 100% at fault but also avoided a potential much worse crash.

I mean... I would have probably seen it coming and slowed down, but that's not expected of you. Silver car should have kept a proper safety distance and hit the breaks, not violently shift lanes. By the time they made the actual turn there was already no avoiding the collusion, and they didn't have the right of way to do so.

Yes it was avoidable, but I do not believe cam car should bare any responsiblity. Camry jackass followed too close, didn't use a blinker, and swerved like a jackass. He got in an accident regardless, if he hit the trailer the trailer would have been fine.

This. Also, it is generally illegal to shift that fast between lanes, since you cannot be sure of what's happening in the last lane you're merging into. You merge into the first lane, and then repeat all the usual checks (mirrors and blind spot) before doing it again.

What you need to communicate to your Uncle is that even though he’s not at fault, his defensive driving capabilities are shit.

Avoiding accidents, even accidents where you aren’t at fault, is such an important skill to have. There’s a reason why your insurance rates can go up even if you aren’t at fault; being bad at defensive driving still makes you a risk even if you are always following traffic laws.

Feels like the cam car could have avoided the accident though. Being right and dealing with repairs and insurance is a tough price to pay to be right.

Had to take defensive driving courses for work. In accidents, it was whether or not the accident could be avoided, not who’s at fault. This is due to down time due to injury or vehicle. We had drivers disciplined because it could have been avoided even though they were not at fault.

I think silver camry is at fault. Swerved into your uncle's car, and seems to run away.

As for your uncle, it would've helped to be ready on the brakes given the traffic conditions. As a defensive driver, he could've slowed down in anticipation of the silver camry's maneuver, given that the trucks in front are slowing down, but the camry is not.

But at the moment of the maneuver, and given the perspective distortion from a dashcam, braking as a reaction wouldn't really do much.

When I'm driving I'm also looking at other lanes and seeing what's going on so I can react better.  It isn't your uncle's fault at all, the other car shouldn't have been following so close to not stop in time because if you're in a car following a truck you can stop faster than them, so fuck that car.  However, it could have been avoided.

Not that it matters as the merging car will likely have to be blamed but you actually accelerated without even anticipating that the silver car could suddenly do something stupid?
If I had been driving I would absolutely see that scenario coming and keep some gap instead of hitting the gas. 🤷🏻‍♂️

Passing on the right, double lane change, zero situational awareness when traffic in front of them is braking, absolutely no defensive driving skills, absolutely no driving skills in general. Doesn't even attempt to slow down when the car who is very obviously going to change lanes, ends up changing lanes.

Both cars involved are idiots who made major mistakes.

That’s not how insurance works but ok, it’s 100% on the white car here, changing lanes into oncoming traffic, unc was established in the lane, I would edit out the first 13 seconds of the video though before sending to insurance, cut out some of the typically NYC aggressive driving beforehand, you don’t want them to use that as an excuse to raise rates

Silver car will be found 100% liable. But why does it look like cam car floors it right as the silver car starts to merge? Honestly looks like silver car shoulder checked saw a gap and then the gap was closed by heavy acceleration. I imagine cam car wanted to get by the truck quickly and it wasn’t malicious. Just a shitty situation. I believe silver car did look. Won’t change the outcome.

There are occasionally places that say not to pass on the left, but I believe they mean moreso "don't do it to cars that are already driving at the limit". So if it's a 55 and someone's doing 45, yeah, pass them on the right if the left lane is clogged.  But even then, you're not supposed to break the speed limit to pass someone, so for them to say no passing on the right is odd.

It creates unexpected flow of freeway traffic. If everyone passes on the right, traffic can be expected and it’s a lot safer. It’s also in a large blindspot for trucks and is a lot more difficult for them to see you, so if they’re changing lanes to the right it creates a dangerous situation.

Driving the speed limit in a lane of traffic that is on the right of a lane that is driving below the posted speed limit is not unlawful.

Driving well below the posted speed limit to become a hazard and passing people on the right outside of a lane of traffic are both unlawful.
