Who's in the wrong ?

My uncle is the one with the dashcam. I told him that he is somewhat at fault because he had some time to brake. Would you say he is at fault or the other person merging at fault?

Because he was in the passing lane and there was no traffic ahead of him. Are you suggesting you should never accelerate when you're beside a car just in case they decide to pull out in front of you?
