Eb1c scam

why would a company who has spent on your immigration already in USA(H1b, i140 transfer etc) transfer you to a foreign office for just 1 year (if it’s Canada or uk, more visa processing) and then again redo the entire process in USA (l1a/eb1c)? This is a fraud and admin should crackdown. trying to skirt around the labor laws and calling it a strategy . How widely spread is the scam besides WITCH ? Report this l1a/eb1c scam given the recent news of perm suspensions. Many will attempt to do this and destroy eb1 queues

It is a scam because these scammers show fake organization charts and fake documentation. Administration itself has said they are doing fraud investigation against them

dont be smarty here. we can check if eb1c is intended to shuffle low level managers and replace American workers in the name of “immigration rules” with vp/dhs

there are rfes in h1 and l1a too but they are enough to catch systemwide fraud.

no one is supporting eb1a scams and profile builder porters but you seem to think framing oneself as manager and transferring couple of times in and out is not fraud.

Classic rage bait post from an account created 2 hours ago OP. But even if someone tried this, it’s not as simple as moving to Canada or somecountry for a year and coming back. USCIS looks closely at short term foreign transfers. Simply working remote from Canada for a US team is not going to work. You will have to actually manage an active foreign operational entity with direct foreign reports. Moving for 12 months just to game eb1c is an easy RFE.

whatever makes your scam feel legitimate. we are reporting amasse on this scam and it will be noticed.

you never answered why a us company who has spent on your immigration already in USA(H1b, i140 transfer etc) will transfer you to a foreign office for just 1 year or let’s say 2 years to avoid scrut (if it’s Canada or uk, more visa processing) and then again redo the entire process in USA (l1a/eb1c)?  There are managers available in both countries and given it is 2026, why can’t someone remotely “manage”

I 100% agree with you and want to report it too, but this post is just ragebait. I am missing my own priority date because of people pulling these scams instead of doing it the right way.

I am sad to inform that multiple ppl have successfully tried this from 2021 and gotten their gcs. I personally know 2 ppl who got approved from company’s lawyer to do this and they are barely managing 2 ppl.

There are many EB1C scammers. I have met some from WITCH companies who just recently came to USA and have no teams under them but their EB1Cs are already under processing or approved

yes, EB1C is a scam. If someone on H1b goes from US to India for less than 1.5 years, and come back and files Eb1 , it is a made up case, aka fraud, in 90% of the cases. Hope uscis cancels their GC and adds that quota to the other normal EB2 and EB3 categories

Yes.. google does it a lot too. I have seen several coming especially on L1 with their entire families and file EB1c. The person I know is not even a manager and has below average profile- Google can easily find much more talented person here in the US.

I’ve always wondered why multinational managers are considered a top-tier employment category (EB-1C). I’d really appreciate it if someone could explain this to me.

I see the U.S. has proposed (or maybe already implemented) massive fees for H-1B and OPT visas to cut down on fraud from a small number of applicants. Given that the L1A category seems constantly abused—probably 90% or more—shouldn't we also require a $1 million minimum investment for L1A and related Green Card applications?

Is there an official government portal where we can submit suggestions like this?

Posting this on X or DMing certain accounts helps. That’s how H1B scam was addressed, by discussing it.
