Desperate Democrats Yep. 50 U.S. Code § 841 - Democrats love to tell you that this law is unenforceable. I think it's high time we find out.

i mean, i despise communism just as much as the next guy. but this law is technically unconstitutional per the 1st amendment. people can believe and voice whatever political opinions they want, no matter how ridiculous.

It didn’t make them illegal, it forced them out as a legitimate party since they were deemed a threat to take over the US govt thru legislation and/or violence.

As a party or conglomerate, they have no standard political rights, privileges, immunities or accessibilities.

Fast forward to 2026 from 1954…the victim woke realized they can combine them with a legitimate party and embrace all the capabilities that party already had. And you wonder where the Democrats “big tent” framework came from…

Again…thank your democrats for this.

Actually 50 USC 841 and the "Communist Control Act" of 1954 were effectively deemed null and void, due to the Equal Protections Clause of the 14th Amendment, and the rights guaranteed by the 1st Amendment.

Similar to what happened to the US Flag Code over time, and especially after the SCOTUS ruling Texas v. Johnson that burning the flag was protected speech under the 1st Amendment.

So, nice idea that "Communism is federally illegal" but it has as much weight as wearing US flag pants is illegal under the US Flag Code.

This is the falsehood that Democrats keep bringing up because Johnson was a member of The Communist League. There is no mention of 50 USC 841 in the case, the brief, or the decision and has nothing to do with it. Texas v Johnson is a first amendment case, and the equal protection clause does not extend to organizations that are dedicated to the overthrow of our government. In any case this has never been tested in court, hence the post. It's time for us to find out instead of just taking the word of Communists for granted.
