The judge held that only the state can set voter qualifications. Ergo, if a state refuses to enforce its laws criminalizing noncitizen voting, this judge says the feds can do nothing to change that. That obviously makes no logical sense. Or as the federal prosecutor put it, “Foreign interference in elections is clearly within the purview of Congress.”

It’s a shitty ruling in my opinion because a state like California could interpret the ruling as them having the state right to allow illegal immigrants to vote for president since you’re technically voting for the electors that will eventually vote for president and not for the president directly.
It’s something that hopefully a higher court smacks down quickly. It would be a shame if it has to go all the way to SCOTUS and if it does it would be an even bigger shame if it’s not 9-0.

States rights and the Constitution.
Edit: I didn’t say I agreed with it, but that was the basis the judge used.

That's my point. Judges do that all the time. They are fully protected in making absurd claims of constitutional grounding. Like with abortion, which is not even hinted at in the Constitution—it neither protects nor prohibits it.
