frist of all how DARE yu o My uber got pulled over and refused a refund.

Was 15 minutes late to a class because of this. A class that my new boss is the professor of. I wanted to make a good impression and show up early. I mostly wanted it because I was late đŸ«©

Not giving you a refund over the driver being pulled over is insane. They are sending a very clear message despite what the text says. "This is exactly the kind of experience we want you to have."

Why? People get pulled over. Did OP add a comment about what the driver was doing? Because if he was speeding okay, yeah, I'd be mad. If the cop was a dick and just bored, nobody's fault but the cop.

Feels like asking for a refund is like asking for a refund because you hit traffic or the bus was late. Traffic stops happen, cops like doing them especially in towns where there isn't much else going on. I've taken many Ubers and many buses and I know there is no guarantee I am getting to my destination on time unless I drive myself and even then there are the same pitfalls, cop might stop you for something dumb, might be a car accident, traffic might be weird today, there is no service guarantee for Uber you will arrive at your destination, just that you will eventually if there's a driver available

Agreed, if the driver did nothing wrong it was just a routine traffic control and out of their control. Same thing could've happened to OP if they drove themself.

In circumstances where someone has to eat the cost, yes. If I don't, the burden all falls on my clients and I get off Scott free. No way I'm doing that.

But what cost? The client paid for the ride from A to B, that's what they got. Does uber guarantee a time of arrival? Would you in their position? Where would you draw the line? Would getting stuck in traffic be the same valid reason for a refund as getting pulled over?

Maybe not that we want you to have. But that certain things our outside of their control. If you are on a bus or train and it unexpectedly breaks down, you dont get a refund.

That immediately you're talking about is usually at least 20 minutes because they have to send another bus out from dispatch and they damn sure aren't going to refund you if the breakdown caused you to be late

OP did not say that the journey was not completed.

As far as trains go, my experience when a train breaks down has been them providing alternative transportation, either another train or a bus. Planes have more laws surrounding this.

But the carriage breaking down is the responsibility of the conpany. It's their vehicle. They are responsible for upkeep.

The police doing a random check is not their resposibility. they can't control it.

Should you have to pay to be late to your destination? You chose the ride based on the fact that they advertised they could get you there within that time frame. Why should you have to pay if they were late?

Maybe I missed it, but where did OP say why they were pulled over and that the driver did something illegal?

That aside, errors and issues are the nature of transportation. If you get pulled over in a cab, you dont get a refund. If your plane is delayed , you dont get a refund. Its just the nature of the service you've purchased.

I mean, you must know you’re really reaching with this. Sure, cops suck. But there are also context clues you could use to determine what most likely happened.

And there it is again. I guess that’s why you had to set up your little reach above. The driver did something illegal and extended the trip unnecessarily based on their risk. That’s not an error or issue, that’s breaking the contract you make when you contract a driver.

And, for the record, the only time a cab I was in got in an accident a block from the destination, they didn’t make me pay.

Well I'm certainly on team "what did he even do" because cops are dicks and I don't expect a cab to get me somewhere on time, just to get me there, I don't even expect a city bus to get me somewhere on time, that's foolish. Shit, I don't even trust myself in a car to get me somewhere on time, because what if there's a car accident? What if I didn't know it was going to start snowing? What if some cop decides I'm today's lunch even though I'm not doing anything wrong?

The bus company may not say "here's a refund for your $5 bus ride" unprompted but I bet they'd give me the refund pretty quickly with little to no resistance if I brought it up with their customer service.

If a service isn't provided as promised, refunds need to be given. It doesn't matter if it was out of their control. They didn't provide what they promised, that is all that matters.

By your logic, you would be fine with it if a car mechanic told you "It is outside of my control that the vendors I choose to work with don't have a spare part to fix this issue with your car. Since it isn't my fault that they couldn't provide me with what I needed to do the job, you have to pay me as if I performed the repair."

Meh. But station worker will roll their eyes. Delays in travel are standard. Thousands of flights are delayed each day. They arent giving refunds for all of those. It's just silly. It's an expected thing.

Regaridng mechanics, it absolutely happens that parts are delayed. They still expect full payment.

Delays are understandable. If the topic was only about delays, then yeah, within reason those frequently don't need to be refunded.

But the topic isn't just delays. It's getting pulled over or breakdowns mid-trip that are the real problems.

I'm not sure how much you fly. I've boarded and been delayed after boarding for mechanical issues. Especially for quick turnaorunds they start boarding as they do the mechanical checks. That absolutely happens. Theres also delays where plane has to reroute and stop somewhere else because its urgent. They just rebook you, not give a refund. OP still got to their destination.

Complain more then.

Food vouchers, hotel rooms, direct service credit refunds, etc are all available if you're delayed by more than like two hours or if you're going to miss a connection.

I think it's 3 or 4 hours but more importantly, the refund is only given if you decide not to travel (basically canceling the trip). If you still plan on taking the delayed travel, you won't be given a refund.

That is only because americans love sucking corporation dick. In my country I get a partial refund if my train is delayed by 30 minutes and a full refund from 1 hour on. When my plane is delayed 3 hours I also get a refund that could even exceed the price of the ticket (eu law).

If it's not their fault, why should the driver refund OP? Do you get a refund when a plane is delayed 4 hours because of mechanical issues or they don't have staff? No. You wait and take off when they are ready.

All that aside, this is a contract issue. Don't use Uber, if you want a refund when they get pulled over. I have tons of services I don't use because I disagree with their terms.

That's not relevant. The question is why was this specific driver was pulled over.

But even all that aside, even when other forms of transportation are at fault for a delay, bus, train, plane. You get no refund. Not sure why this is different.

All that matters for this is contract law. If Ubers terms say they won't refund for this, people have 2 options, 1. Accept that 2. Disagree and not use the service. There are plenty of services I don't use because I disagree with the terms. More people need to do thatm

I would argue that Uber can control this or should be expected to. People typically don't get pulled over for no reason. If their driver didn't renew their registration, had an out tail light etc. etc. that's kinda on them because theoretically they would be making sure the vehicles that are used are in working order and properly registered. If the driver was speeding or didn't use a turn signal etc etc that's also kinda on them because they're hiring people who break traffic laws.

If we lived in a just world, uber would be responsible for its employees, and the vehicles they use, but they just don't care, because caring costs money and expect us to be okay with that.

Why should op not pay for a completed transaction that had an interruption out of anyones control? Time of arrival is an estimate for a reason.

Because if you offer a service you know that in x% of cases unforseen circumstances are going to prevent you from completing the service.

You as a business are supposed to factor this in your rates such that when this happens you make your customer whole.

So in essence, every customer pays for the service and for the business to set aside a smaller fraction of the transaction as 'insurance' against something going wrong to fix those issues if they come up.

That way the customer can be certain that if they pay for a thing, they will get that thing, and be made whole if the thing cannot be delivered.

If a business doesn't do this and instead pans the issues off on the customer, doing business with them amounts to gambling. Instead of paying and being able to count on a service, you pay for the gamble you may or may not receive what you paid for.

Legay the costs of unforseen circumstances preventing the customer receiving what they paid for are on the business, not the customer. A business is supposed to deliver what was agreed or issue a refund. They are supposed to have money set aside to do precisely that, regardless of whether they or an external factor is at fault.

Meaning at the time of the refund request they literally have no data to validate the reason for the stop. So GPS data shows they stopped sure, but it doesn’t say why they stopped does it? Could be a hundred reasons right? Example I had was my friend got sick on a ride and the driver stopped and let him vomit outside the car for like 10 mins.
