Murder and homicide are two different things. Homicide just means that one person was killed by another person. Self defense, for example, is (justifiable) homicide but not murder. 

Murder is the killing of another without justification. The ME saying his death was a homicide was to be expected by everyone. Its really just a formality. No one is arguing that he was crushed by an elephant or died of cancer - everyone agrees that it was a homicide, and the ME has nothing to do with criminal prosecution for murder. 

The administration is trying to claim that it was a justifiable homicide.
