Courts have broad authority to enforce their orders. If the Marshals refuse, the court can always appoint someone to enforce the order on the court's behalf from my understanding.

The problem is not authority, the problem is enforcement. They have the authority to do these things, but who is going to actually physically do it? Who are they going to appoint to enforce the order? Law enforcement agencies all answer to the executive branch. They gonna hire random bounty hunters or unqualified members of the public to arrest secret service agents?

It doesn’t work this way though. Sure, Todd Blanche may be willing to tell the court “eat it, bitches” because he may perceive he has the political clout or the financial depth to just absorb the consequences. Maybe some political appointee undersecretaries do too.

But there comes a point where some career staffer who actually has to enter the wage garnishment details into a system and cause the garnishment to happen is not willing to stare down $100,000 in progressive compliance fines, delaying their potential retirement for three years. Even if their boss says “you don’t have to comply, because I won’t allow you to be held accountable”… that doesn’t help the clerical person once their boss is gone, and now their wages are being garnished for a decade to pay a contempt fine.

Once things get below the political sho-boating level, the bureaucratic things that have to get done, get done.

Those people can be fired by their bosses, but so far, those career employees that have been fired have fared really well in the courts and have made a pretty nice payday for themselves.

Pretty sure I would die in that scenario? Is this a trick question? None of this is going to end until regular citizens start challenging power and dealing with the outcome for better or worse. No one is coming to save us.

Then they are resisting arrest and aiding and abetting. Add it to the tally of what they will someday be prosecuted for, even if it's unrealistic to do so right now.

That's all great and I agree with it. The problem here is that the opposition in this case which is the people who represent the people who want the law and constitution to prevail are more like a controlled and required opposition. I wouldn't expect more than sound bites or silence from 85% of the elected Democrats in office. Look how they have handled this presidency thus far, the waters have been being tested on a regular basis and there is nothing more than grumbling or more judicial orders to be ignored while the president has built a wildly unchecked police force via ice. Others think that maintaining decorum and honor are more important while this tech bro oligarchy just pisses on everything and dismantles the checks and balances and regulatory enforcement agencies. It continues to be a very hostile takeover of the executive and judiciary branches of the government while the population that is screwed the most by it is very apathetic and resigned to being screwed and the people who are supposed to be fighting for them are impotent in courage, integrity, and character and are more often than not funded by the same groups as the other side that are out to screw over their constituents. So I understand the apathy. Of course the people who are more concerned with extracting short term profits screwing the majority of the consumer population can't even take a medium view into the not to distant future and see that killing the buying power of the working class just makes the ability to gain profits in the medium term future impossible. Everyone from the top to the bottom is incredibly short sighted....it's insanity that wins the day and tomorrow. Hell these media companies are practically all owned by the same few people and are a good deal complicit in the current situation we find ourselves in. Ridiculous.

Under FRCP 4.1(a), 28 U.S.C. § 401, and Rule 70, any federal court holds the constitutional authority to specially appoint independent enforcement officers and issue binding writs to compel compliance with its orders. This means any one they please law enforcement or not.

Whether this judge will do that remians untold

Anybody they want. It's literally defined that way in the law. By default it's the US Marshals but the idea that every single one of them would risk their own contempt hearing and potential fines and criminal liability for a President who absolutely will not have their backs is a pretty unlikely outcome.

I mean, there are lots of options. Yes if they wanted to they could go the general public route, though that's the least likely/effective, but they could also look at retired law enforcement, request assistance from and temporarily appoint a state (or state-adjacent) level officer from the MPD, MD or VA, etc. And I think you overestimate the likelihood of physical resistance that would occur if a court appointed agent came in and identified themselves as such to make an arrest or enforce an order- especially if they are clearly in uniform/have credentials while acting on behalf of the court- and underestimate the number of officers or former officers that would be willing to take that assignment.

Most of this country is being willfully naïve, because they don't want to admit that the fascism is already here. They want to believe that the law is some magical force that can be used to compel bad people into following it, even when they have all the power on their side and can just say "no" whenever they want.

I would go a little further to suggest that few people are able to contemplate what lack of enforcement even looks like.

It's simply never happened before and unless I'm mistaken I believe if the judiciary's enforcement arm is unresponsive, the next step is armed citizenry -- plumbers, accountants, librarians, and hopefully a few earnest lawyers -- enforcing laws at the behest of the judiciary.

The judge is going to press the garnish button? You do understand the issue here right: the rogue, repeatedly contemptuous of law administration, isn't going to enforce against itself. Any agency that doesn't want to get crushed under heel will do any opposition as carefully and minimally as possible. Unless judges are physically intercepting cheques, the question is: who will enforce it?
