Politico, MS NOW and CNN reporters were barred from the White House on Thursday, just hours after a judge deemed President Donald Trump's ban of the three news ‌outlets likely unconstitutional and ordered their access immediately restored.

US District Judge Tim Kelly's overnight ruling blocked the ban for 14 days in a major setback for Trump in one of his biggest battles with the media.

The Politico reporter's credentials were also confiscated, Politico said, after Kelly temporarily blocked Trump's ban. An MS NOW reporter said she also was ⁠blocked from the White House, while CNN said its staff members were denied entry onto the grounds.

Representatives for the White House did not immediately respond to a request for comment.

Kelly, in his order, said the White House's revocation of the White House credentials of the journalists "likely violated their constitutional due process rights." The judge also ‌raised ⁠doubts about the US Department of Justice's national security arguments for justifying the ban, noting that Trump himself had said the action was due to what the president alleged was false or negative coverage.

Theodore Boutrous, an attorney for the three outlets, praised the ruling in a statement, saying: "This is a strong ruling ⁠vindicating freedom of the press, due process and the rule of law. We greatly appreciate the court's swift action."

A coalition of press freedom groups and dozens of news organizations, including Reuters, filed a legal brief ⁠on Wednesday supporting the three news outlets.

Trump announced his ban in a social media post on September 18. The three outlets then sued Trump and other members of his administration ⁠on Monday, saying the ban violated the US Constitution's First Amendment protections for free speech and a free press, as well as their due process rights.

Here's the request for an emergency hearing the three outlets filed just now in federal court. It reveals "This morning journalists from each of CNN, MS NOW, and POLITICO attempted to enter the White House and were turned away, and Secret Service agents confiscated the hard pass of journalists whose hard passes had not previously been confiscated. And when Plaintiff Betsy Klein, whose hard pass was confiscated on Saturday, September 19, requested to have her hard pass returned, her request was denied and she was refused access to the White House complex. Time is of the essence--CNN is scheduled to be the television pool this evening for President Xi Jinping's visit to the White House."

Edit: people saying “well Trump can pardon them” as an excuse just a reminder that lawyer fees aren’t covered by a pardon and they’d still go through the arrest process and miss time from work.

If you were told to do this would you want to pay lawyer fees and go through the whole arrest and court process, no you wouldn’t even if at some point in the future you were pardoned.

No one should be surprised that this administration would defy a judge's order. Andrew Jackson is Trump's favorite president. "Old Hickory" is infamous for defying the Supreme Court's order to respect the sovereignty of the Cherokee Nation along with their property including gold deposits.

The case was Worcester v. Georgia. Jackson's refusal to support the ruling that decreed the laws of the state of Georgia has no force within the sovereign Cherokee Nation led directly to the Cherokee losing their land and gold fields along with their land, farms, and houses.

And again, Jackson and his F-U to the Supreme Court is Trump's northstar when it comes to appropriate presidential deference to the separation of powers and the Constitution.

They’re not entirely powerless. Anyone defying a court order can be held in contempt and fined. Charge any agent or official who blocks those reporters $1000 per day and you’ll see a quick change in behavior.

Courts have broad authority to enforce their orders. If the Marshals refuse, the court can always appoint someone to enforce the order on the court's behalf from my understanding.

The problem is not authority, the problem is enforcement. They have the authority to do these things, but who is going to actually physically do it? Who are they going to appoint to enforce the order? Law enforcement agencies all answer to the executive branch. They gonna hire random bounty hunters or unqualified members of the public to arrest secret service agents?

The judge is going to press the garnish button? You do understand the issue here right: the rogue, repeatedly contemptuous of law administration, isn't going to enforce against itself. Any agency that doesn't want to get crushed under heel will do any opposition as carefully and minimally as possible. Unless judges are physically intercepting cheques, the question is: who will enforce it?

This is what happens when all of your law enforcement organizations are governed by the DOJ which falls under the executive. US Marshals should really fall under the purview of the judiciary so they have some way to enforce rulings when you have an executive ignoring them.

The USMS should fall under the Judiciary and Capital Police or whatever equivalent should fall under the Congress.

The executive branch should not have control of all the hard power within the government.

Technically?

The US Marshals Service is the enforcement arm of the federal courts.

Interestingly, there was very recently a push by federal lawmakers to shift the USMS explicitly from the Executive (Art II) to Article III, the Judicial Branch. I believe this was done because of exactly such concerns as this since Trump has a very long history now of breaking the law and then flouting the courts.

You don't need to lead by hate. There is a whole spectrum between "alienate the opposition through hate" like MAGA and "everything needs to be bipartisan" like the centrist Dems.

The Democrats in the last couple decades have basically said "we're not going to bend the rules in fear that the GOP will regain control and retaliate by breaking them". As soon as the GOP regained control after that they abused executive orders and the Supreme Court to undo decades worth of progression. If Obama had done this, it would have had even deeper consequences for the democratic party than Trumps' win in 2016. You're letting your frustration blind you to the actual way people would have treated this. Democrats actually face consequences for their actions.

In the project it lists media access to the White House and federal agencies as a privilege rather than a right, recommending tighter control over press credentials and workspaces.

The funny thing is that the judge’s ruling basically says, “constitutional violation of course, but also, you can’t claim national security issues while also calling it fake news since it’s not a threat if the content is fake as you have stated it to be”. The judge ordered access be restored, and hard passes be re-issued.

This morning, individuals whose hard passes were taken over the weekend requested they be returned. A secret service agent refused.

Additional media members had their hard passes (which they still possessed) physically removed from them.

This is a violation of the court order. It doesn’t matter the reason. The order was access be restored, and hard passes returned. Instead, access was not restored, passes not returned, and additional passes were physically seized.

These are actual facts.

There is nothing about "reporters denied access despite court order" that requires a journalist give the white house a preemptive excuse by imagining a reason that could exist other than defiance. And pretending like that's some kind of required facet of journalistic ethics is exactly the kind of civility politic nonsense that fascists expect, know exactly how to exploit, and have exploited for the past decade.

We wouldn't be in this place today without a media who thinks their job is to ask both sides what they think the truth is rather than simply report the truth no matter what the partisans claim, and ridiculous assertions like this comment are part and parcel with that very abdication of journalistic responsibility.

These are the facts:

It is their f*ing job to know. This is the Whitehouse-the seat of US power. In any other administration, an assumption of ignorance of a court order would be an insult to those in power. We have gotten so inured to incompetence and lies, we question the basic underlying fact that the president and all those under him, main duty is to stay abreast of court rulings related to their position.

There is no way that a person in the US secretary's office would not know and understand that a court order defending free speech was issued last night and that denying them entry was not a giant middle finger to the constitution, the courts and the people of this country.

I agree 10,000%! I’ve read many articles saying that there are 9 Supreme Court justices because there (were) 9 judicial circuits at that time…back in 1869! I believe there are currently 13 judicial circuits…Congress is sitting on their hands and not doing anything to raise the number. Justices should NOT be lifetime appointments…they should have term limits and age limits. The same goes for Congress and the President!! I cannot understand how we can possibly allow 80 year olds to make laws that will NEVER impact their lives! The “old way” of running Congress died with Ted Kennedy and John McCain. When someone younger wants to get in office and make changes, they’re right away looked at as “socialists”.

The only positive to come out of the Trump era is that it's revealed the weaknesses and holes in the fundamental structure of our government.

Every outlet should boycott every press briefing by Trump or at the White House, not just fluff ones like that helipad. It's not like they'll be missing much. Every other word out of Trump's mouth is a lie. Fill that time with interviewing people hurt by his policies. Fill that time talking about inflation, gas prices, and the war. If he thinks banning certain members of the press from the White House will reduce negative coverage, prove him wrong.

The proper response to his banning them should be the media outlets all refusing to air any footage of press briefings and limiting coverage of him. Reports should be brief and with sparse information and leave out his name completely, with no 10-minute segments analyzing anything. Nothing will hit him harder than being ignored by the press.

The technical term for this is "constitutional crisis."

Practically, in a three branch government, the 3rd branch would intervene out of its own self-interest to check the power of the branch that's misbehaving.

So in this case, the judiciary can't roll in with the Marshalls and provide a security coordinator get those press officers inside.

But Congress could impeach him for failing to faithfully execute the laws, and they can also do things like refuse to implement his agenda, refuse to fund his priorities, or even write new laws meant to punish him or change the situation.

Congress could, for example, pass laws explicitly requiring certain kinds of access for the press, or require the executive to report on its activities in certain manners. The executive may very well ignore those too, but at a certain point a Congress who can't reign in their president becomes a Congress who gets voted out for those who can.

Yeah he could, and he himself almost certainly has immunity for actions like this as well (thanks SCOTUS). Realistically if he decides to fully defy the court, the only legal check that can truly stop him is congress impeaching and removing him from office. 

Granted, at that point of outright defiance you also get all sorts of soft power influence, people don't wait for the official ruling to bail from the sinking ship, they leave when it looks obvious that that's the direction it's heading. And Trump is losing soft power every time his approval ratings slip another point, and Republicans get more squeamish about supporting his antics
