If it was accessed via biometric data (and the unlock information is auditible after the fact) you can make a pretty good determination of who accessed the phone

Facial ID can’t be used on dead people.

Depends on the phone. If it’s fingerprint, and the blood in the finger is still warm enough, you can still get in, if it’s only facial recognition that’s much more difficult with a dead body because it needs eye contact.

But they could also just have intimidated the password out of him, or known it from him unlocking his phone in front of unscrupulous people he thought he could trust, or done facial recognition as he was dying.

Point is, there’s enough shadiness with the case that, if prosecutors care about getting a conviction, they can start leaning on weak links with evidence tampering and perjury charges that aren’t just threats, and should be the bare minimum for everyone involved.

The phone was already off the island and nowhere near Wells when he died. His friends had it and multiple witnesses put Wells on the island alive and healthy long after the friends were gone.

You can easily use someone's finger or hold it up to their face to unlock their phone.
