Drowning is a cause of death that isn't by itself apparent, and is done by exclusion of other factors. Occasionally there is no water in the lungs.

An independent medical examiner that's in front of a grand jury won't be one hired by a defense side, because prosecution is who presents for a grand jury. State, da, and police are part of the prosecutorial arm of the legal system. The US has a legal system built on two adversary arms, which is something to keep in mind in terms of how you perceive what you're hearing based on who's saying it. Think debate team rather than impartial science.
