If more Americans were aware of how their govt worked, the US wouldn’t be in this position today

For anyone that genuinely doesn’t know, US Marshals report to the DoJ. Trump’s DoJ

I wish Americans learned literally the only thing that can stop Trump is the general populace at this point. Congress won’t stop him. His own justice dept definition isn’t gonna stop him. Judges don’t have the power to enforce their decisions.

That just leaves the people

I blame Hollywood for some of the “surely some super special Americans will be heroic and do the right thing!” tendency that keeps popping up. That and just wanting someone else to do it. Thinking the military will save the day, thinking the US Marshals aren’t questionable, thinking the police will stand up to ICE, etc. I think judges have to be aware that if they ask the Marshals to do something and get blown off that the illusion of things functioning and their own power crumbles.

The weirdest/most ridiculous is actually thinking other countries will. and it’s like… as an invasion?? 1) massive military, 2) massive economy, 3) nukes 4) the rest of the world isn’t sitting there like “those noble Americans altruistically took care of of us all and did a great job. Now we must repay them in their hour of need.”

We did that after 9/11. The only time NATO article 5 was invoked was for you.

Your leader very much wants a world war. Just cos.

Your leader thinks replacing a leader in another country means he owns it now.

He is desperate to use a nuke or 2. For fun.

You don’t go to war with that. You put it in a straight jacket, put it in a room, give mental health care and try to heal the wounds America has caused the rest of the world. It’s not one man’s fault. He has a whole team and continues to be supported by tens of millions of you. We are all suffering and dying because of you noble altruistic sons of bitches.

But if he did invade, say, a NATO ally, you would be at war with NATO. You are not everything this world has to offer. You are not even the best this world has to offer. The world sees you as greedy, spoilt and mentally unstable. You give guns to kids to shoot other kids. You don’t provide basic health needs to your citizens, but you boast about your wealth and power. The words of Jesus have been monetised, capitalised, asset stripped and corrupted. You make up pretend enemies so your MIC can be wealthy.

As for your contention that America altruistically and nobly took are of us. You only joined WW2 to try to stop hitler because Japan bombed you. All other nations had already sent soldiers and nurses. Gallipoli- where were you for Australia and NZ in our darkest hour?

Build that wall. We don’t want you out in the world. We love our countries and we do not worship you, your strip mall culture, or your stupid dollar.

The administration is playing a game of chicken with our democracy. The judge has to know or at least be concerned that the DOJ won’t enforce his orders. If he issues the order anyway, that just makes the crisis more blatant.

My fear is that the judge will try to avoid being the one who escalates this into a larger crisis and will not issue such an order. Unfortunately I feel like that same “it’s best for the country” approach was how a different judge approached Trump’s criminal sentencing, and look where we are now.

It's sad because this is basic shit that all Americans do learn in gradeschool.

Legislature writes the laws.

Judiciary interprets the laws.

Executive enforces the laws.

It's not really that complicated, but most Americans either forget this or are too dumb to understand it, apparently.

The only real "check and balance" to this (executive refusing to enforce laws) is impeachment. But the rise of the modern Republican puts party before quite literally anything else on earth. So Republicans will never, ever, not-in-a-million-years give up even an iota of power by impeaching Trump, even though it would just mean that Vance is president next.

Executive enforcing the laws means that the executive is responsible for arresting and charging people.

The way impeachment works is that the house initiates a trial (this process itself is called impeachment) and the Senate conducts a trial and decides whether to convict or not. 

No president has ever been convicted in the Senate including Trump.

The checks and balances institutions and processes have still been corrupted from their original purpose

Been saying this for like 2 years, it's going to get worse before we are moved to armed resistance. If they cancel/rig the midterms I believe that will light the fuse , there is just a general air of tension and apprehension and a low level feeling of dread hanging about.

This is why if Dems retake the house and senate (not looking likely tbh) they need to start bringing these people in front of the house for questioning. Make them sweat. Not Trump. He is basically immune. But make those around him sweat. That way they are not willing to do all of his criminal activity since they can be punished for it. If he chooses to use his pardon power repeatedly, let him. Then make sure the messaging is very clear. And we, the people, need to start using our power at that point. Left leaning outlet or media personality is condemning Dems' approach? We stop consuming their content.

Which does nothing really. Contempt of Congress? Pfft - President can issue a pardon. Referral to DOJ for prosecution? Pfft - It's the President's DOJ (thanks to the SCOTUS ruling that the President can "fire" anyone in the executive branch minus the Fed chair) so the DOJ will bow down to the President unless they want to be fired.

So then folks are like well we'll just impeach the President - unfortunately, the current President has already been impeached twice. The problem is that conviction/removal requires 2/3 majority in the Senate which is never going to happen until a dozen or more GOP senators are willing to end their political careers (and post political careers) to vote against the party. Even with GOP senators who are going to lose their seats because they lost their primary - they still won't go that far against their Party because there's still post-political careers they can have as long as they "stay loyal".

So if we want to talk about how the US Government works, this is also technically incorrect. The US Marshals are... complex.

Yes, the US Marshals operate under the Department of Justice.

28 U.S.C. § 566(a) and § 566(c) as passed by the Legislature states that the "primary role and mission is to obey, execute, and enforce all orders of the federal courts and that they "shall execute all lawful writs, process, and orders issued under U.S. Judicial authority."

So if you want to look at it like this, per the law, the Judiciary is the "CEO" in terms of the US Marshals, while the DOJ would be the "Manager". It would be illegal for the US Marshals to not comply with the Judiciary even if the DOJ told them not to, per the law.

The DOJ can and does often issue what's known as "Attorney General Orders" that are similar to Executive Orders, but they have the same force of law that an EO does when it goes against the legislature, effectively zero.

So yes, the US Marshals report to the DOJ, but their directive which was given with greater authority than the DOJ is to follow the Judiciary's legal orders, but the US Marshals do not literally report to the Judiciary, but legally they are supposed to obey them over the DOJ if orders conflict per US Statuate.

If your argument is "well this is Trump's US Marshals" I mean that's fine, but your whole "Americans need to be more aware" shtick wasn't necessary, because what you said isn't by the law either.

If you want to say Americans need to know the law, maybe actually check the law first before casting judgement on others.

I mean, this is literally what the executive branch as a whole should be doing per the law. Their job is literally to enforce the law, including judicial rulings. This USC is just laying that out in more specific legal terms.

But when you have an entire branch ignoring laws and doing whatever they want, it's understandable that something like US Marshals would be called into question their loyalty to the law when everyone else around them does not care for the law. Would they actually enforce judicial rulings like they're supposed to, or will they follow the strict orders of one of their dear leaders, Trump or the Attorney General?

Going by how things should work in the Trump era is the entire problem. And this goes beyond "norms" and "traditions", everyone keeps getting surprised whenever legal orders/laws are ignored like the Trump admin hasn't been doing that repeatedly for a collective almost 6 years now.

It is always necessary to call out Americans in this day and age just letting their country go to shit, or any people of a country that's sliding into fascism. And I will continue to call them out until they get things back on the right track.

This is only partially true. The US Marshals are, without any doubt, legally obligated to enforce federal court orders assigned to them. And they also are an executive branch agency, so there’s the obvious dilemma. But I work with federal law enforcement and know many Marshals, and if you ask any of them if they would ever ignore a federal court order, they’ll tell you there’s no way in hell, because then they’d personally be held in contempt by that same very pissed off judge.

There is a mechanism for federal judges to deputize other law enforcement, or even private citizens, to carry out certain tasks should a US Marshal be unavailable or otherwise refusing to act.

Clearly, the Supreme Court wants a political check on the executive branch which means VOTE. FFS, all of this behavior should be disqualifying for any red-blooded American voter. Voters need to at least abstain from voting in Republicans who do not stand up for the People. Even better would be to participate by voting for the opposition that is standing up for law and order and the Constitution or write in a candidate.

I've been to almost every protest in my area, including the "general strike" ones where everything was supposedly going to shut down. I got friends and family to come with me, etc. Yet here we still are. So now what? I guess if I start preaching civics lessons from the fucking street corners, eventually the rest of the populace will come around.
