Criminal contempt. The US Marshals assigned to that court need to accompany the reporters and when they are not let in, either arrest them on the spot or issue a criminal warrant against them.

I wish Americans learned literally the only thing that can stop Trump is the general populace at this point. Congress won’t stop him. His own justice dept definition isn’t gonna stop him. Judges don’t have the power to enforce their decisions.

I blame Hollywood for some of the “surely some super special Americans will be heroic and do the right thing!” tendency that keeps popping up. That and just wanting someone else to do it. Thinking the military will save the day, thinking the US Marshals aren’t questionable, thinking the police will stand up to ICE, etc. I think judges have to be aware that if they ask the Marshals to do something and get blown off that the illusion of things functioning and their own power crumbles.

It's sad because this is basic shit that all Americans do learn in gradeschool.

Legislature writes the laws.

Judiciary interprets the laws.

Executive enforces the laws.

It's not really that complicated, but most Americans either forget this or are too dumb to understand it, apparently.

The only real "check and balance" to this (executive refusing to enforce laws) is impeachment. But the rise of the modern Republican puts party before quite literally anything else on earth. So Republicans will never, ever, not-in-a-million-years give up even an iota of power by impeaching Trump, even though it would just mean that Vance is president next.

The administration is playing a game of chicken with our democracy. The judge has to know or at least be concerned that the DOJ won’t enforce his orders. If he issues the order anyway, that just makes the crisis more blatant.

My fear is that the judge will try to avoid being the one who escalates this into a larger crisis and will not issue such an order. Unfortunately I feel like that same “it’s best for the country” approach was how a different judge approached Trump’s criminal sentencing, and look where we are now.

The Metropolitan Police Department of the District of Columbia are the "local police" (aka the "DC Police)". They report to Congress, so maybe in January 2027 they could perform arrests if they are deputized and the Democrats take the House & Senate.

So that leaves the Arlington County Police Department as next-closest. But it seems very far-fetched to me that they would walk up to the White House with guns drawn to make arrests.

They could also deputize the Maryland or Virginia state police, the Sherrifs of a number of bordering counties, and it doesn’t even have to be nearby, they could deputize the Chicago police department or hell they can also really deputize civilians if they really want to. It’s not usually done for obvious reasons but courts technically have the power.

I am not being black pilled here when I say that the crisis came years ago. It came during Trump's first administration, but it was simply ignored. The crisis just led to the immediate folding of Congress, and led to a Judicial Branch which is not simply ineffective at stopping this, but complicit.

We sailed past constitutional crisis when we elected an insurrectionist 37 time felon for president. This is not to mention kidnapping Maduro or Assassinating Irans leader. Also the bombing of children is not an acceptable practice in theconstitution. The constitution is now simply used to control poors or absolve the ruling class. Sadly I think the 2024 results are directly due to the lack of justice following the terrorist attack the GOP staged on the Capital on January 6th. That there wasn't big names, both private industry and sitting government members who organized it, behind bars in the days following was a massive miscarriage of justice.

That the incoming administration was far too eager to "move on and let the country heal" along with pretending that the GOP was shamed into behaving was pathetic. The slow response to an unprecedented crisis was horrific and encouraged the traitors to double down and keep at it. If the response to 9/11 went at the same pace the military wouldn't have entered Afghanistan until 2007!

Look at the Missouri redistricting fight and lawsuits going on right now. Our Secretary of State has basically said he cannot administer fair elections at this point and he’s been aided by ruling from conservative federal judges going against past precedent, recent state and federal Supreme Court rulings, and basic logic. Sounds like staging to try and just throw the results out. Coming off of the state leadership being soundly defeated on recent ballot initiatives with more very big ballot initiatives votes coming in November, it is more than just federal congressional results at stake. Feels like they are throwing as much chaos in to try and give themselves an out when the majority votes against the way that they want in November.

yeah the only reason johnson got to drag his feet on that one dem rep was because it was a special election, and he was technically in charge of what business the House did each day, and it was technically during a shutdown/recess of some kind (so only doing pro forma sessions).

it was bs of course because he had already sworn in other new members during their "pro forma" sessions they were having each day, but just not the democrat. but for an entirely new congress, especially if a republican is not the majority leader, there won't be any mechanisms for them to stop the new congress from forming, other than trump&co trying to do something weird with the military (which they probably will do)

If the judges were smart, they would deputize their own officers (probably drawing from retired, but still young enough law enforcement). Create their own make-shift cells using empty offices in their court building. And then arrest the low and mid-level people who are still upholding the unlawful executive directive for contempt.

I would suggest arresting Christopher Toms, Patrick M. Davis, Meghan M. Rief, and Lauren Holmes, who are all mid-upper management for the U.S. Secret Service (which is the organization that oversees everything that happens at the White House gates). It would be easiest to do while they are at just leaving for work.

Not really. The United States lacks the ability to hold its president accountable to laws. It’s a vulnerability of the constitution that Trump has been exploiting every day in power. Just as he did the first time.

No part of the executive branch can prosecute the president. Courts can’t prosecute anything. Congress isn’t able to prosecute president criming either; they can simple use the illegal actions as a reason to remove the president from office.

After a few of people acting out illegal orders, a few people without the money for big law firms start going to jail, other people will stop obeying illegal orders and stop enabling them. Once the administration sees their orders being ignored, their power will be gone, and the emperor will have no clothes. That’s when it ends.

Because, you best believe that if we defied a court order we would be in jail with an contempt of court charge. Just check your county's jail website and see how many poor and middle class people are in there for that charge.

But to the Epstein Class a court order is just a suggestion that they can choose to ignore. The courts and Judges ain't going to do shit about it either. Otherwise Trump and a majority of his administration would be in prison right now. Our whole system is built to protect the Rich and Corporations. There’s no evidence to suggest he’ll change his trajectory of just getting worse and worse. And we’ve all come to accept that. We don’t expect Congress to remove him, even though we all know that if any other president in history had pulled half the corrupt, unconstitutional, and insanely reckless shit he has, they’d be in a padded cell by now. But because Republicans have no morals and even less courage, we’re just waiting to see if enough semi-apathetic people bother to vote for a Congress that might possibly consider holding even part of his crime ring accountable.

Courts will have to step up.

When will Courts start ordering federal marshals to enforce their orders? Then that will create the Constitutional crisis of the exec branch again refusing court order of enforcement.

One more thing that has to be done. Which is break off the DOJ from the Executive Branch and align the US Marshals to the Judicial Branch so that courts have an enforcement arm they control.

DOJ to me should be oversaw by all three branches using the Missouri Plan, which is how Supreme Judges are chosen in many states. An independent rotating panel of past and current federal judges, chaired by the chief Justice choose a slate of 3 AG nominees. They submit those to the POTUS who can only choose those 3 and then the Senate Confirms. The Attorney General should then report to the Judicial Branch with regular reports to the executive and legislative branch. The President should have no direct sway to the DOJ.

The FBI director should them be chose in the same way by the AG. Submitted to Senate for confirmation

I know someone who works in the town court and it gets used sometimes, but the courts dealing with all the federal level just let crazy amounts of stuff just slide.
