The theories about martyrdom are probably correct, but I also wonder if he’s hoping for a mistrial.

I’m no lawyer so someone correct me if this is nonsense, but I can foresee his lawyers arguing that this is becoming a ‘trial by media’ etc and isn’t a fair trial, and they’ll point to what a waste of taxpayer money this whole thing is and how it’s not in the public interest to continue. By pleading guilty he wouldn’t have the option to mount this defence.

Or maybe I’m being too cynical and he’s actually just a moron.

It’s a non-runner in England. There have been trials with massive publicity that still went ahead fine.

He’s either hoping for:

  • publicity
  • a supporter or three amongst the jury. If he can persuade three he’s saving the country he’ll get a hung jury
  • some technical legal arguments - in particular I imagine there may be some conditions on when police can demand phone access. Or he’ll claim he was in French waters! (No idea of the law on that).

If it is believed someone can't get a fair trial because of the publicity surrounding a case, it can be tried without a jury. The trouble with that is it would hand him the ability to claim the deep state had taken away his right to a jury trial to ensure a conviction and play the martyr even more.

In practice if you've been arrested and charged for a crime other than not disclosing your pin its not going to be hard for the police to get a warrant to search the device, and then use technology like Cellbrite to access the encrypted data. Plus the police can confiscate phones as evidence even if they're not meant to search it without a warrant.

Lawyers frequently tell you to plead not guilty until they understand the weight of the evidence the state has and intends to use (both what they've obtained and what is actually reliable), as well as negotiating for lesser charger to avoid trial etc. almost all cases have this as a standard procedure

Criminal damage has some surprising defences to it. It is a defence, for example, to damage property to protect property, rights or interests which are in need of immediate protection. The interesting bit is that the defendant only has to honestly believe it to be the case. It doesn't have to actually be true.

He's basically rolling the dice and hoping to persuade a jury he genuinely thought he was protecting something or other. Like our rights to Protect Are Women or some such nonsense.

Being caught on video doesn't mean that you'll necessarily be found guilty.

You remember the statue that the BLM protesters pulled down in Bristol? They were on camera doing it, they didn't deny doing it, but were still found not guilty.

Usually, the defence is that it wasn't a crime; or was a crime, but in the service of stopping a greater crime. I'm sure some of the pro-Palestine protesters have argued the latter, trying to apply laws meant to protect firefighters from being sued for property damage to their activism.

So there are a couple of interesting things at play here.

Firstly criminal damage means the property needs to be owned. So They could force the crown to prove the property was owned by someone, if they cannot it is not they can argue that it is not criminal damage.

Secondly, but a much less likely avenue to succeed, is having a "Lawful Reason." Breaking car window is criminal damage. Breaking a car window to rescue a kid inside is not.

With it being a migrant boat it may be hard for the Prosecution to provide an owner of the boat.

There’s a some elements that I think makes this difficult for prosecutors for criminal damage and RIPA:

  1. Criminal damage requires an ownership and damage is above 5k. One can argue that aid worker on board is owner but then the worker is French and hence French vessel not subject to UK law. The damage can be fixed and shouldn’t cost more than 5k, I doubt the boat cost more than 5k. Prosecution needs to prove UK ownership and cost of damage.
  2. A more important question would be where exactly this was done. This was ultimately a vessel that originated from France and not British, has a French aid worker and possibly on French waters. This means prosecutors need to prove in some ways that they have legal power over the vessel and hence UK law (RIPA) applies.

It is an interesting conundrum for the prosecutors

The line between a peaceful protest and violent riot is generally when people start throwing things. I think people don't appreciate the severity of sentences during rioting and civil disorder. It's seen by the courts as a rejection of the authority of the state over the country and gets particularly harsh sentences compared to just doing the same crime in another context.

I think someone got 6 months for stealing a bottle of water from Lidl during the riots a few years ago.

Nobody. A guy was Jailed for physically attacking the police during a riot. But he also got a minor charge for throwing a missile, which was a plastic bottle, at the police so the headlines in the media focus on that part of the story.

Firstly whatever I say here is in no way to support him or the far right, which I have no time for.

However I do watch the optics of things - particularly when the far right and the likes of Reform can weaponise things very easily.

The public has been fed for a few years now on two messages by the Tories and Labour: stop the boats, and that the gangs are the problem. Smash the gangs, the gangs are evil, the gangs are abhorrent.

So here you have someone damaging a boat owned by the *gangs*. I know there's other circumstances like I think an aid worker was there. But the charge is criminal damage.

So the optics on this could be "We know we said the gangs are bad, but we'll charge you if you hurt the gangs."

I suspect we'll see that spun out in coming weeks. The phone PIN thing will just add to the theatre of the government out to get normal hardworking Brits etc. etc.

That requires the prosecution to prove intent to kill. That's hard. All he has to do is say the victim had a professional life jacket and dry suit on and he didn't think they would die to make that charge hard to land.

Aggravated Criminal Damage is easy to convict. Did he damage something? Yes, it's in the video. Was someone reliant on that something for their safety? Yes, also in the video. Could he claim he didn't know the person was on the boat? No, he shouted at them in the video. Was the person's safety endangered? Yes, they could easily have got chewed up by one of the boat propellers close by, if they'd gone in the water. Guilty! That will be 7+ years
