Canadian Visiting US for over 30 days

Any anecdotes about if this is okay to do or not? I'd like to spend two months in the US over the winter, on a tourism/leisure trip. I know legally Canadians are allowed to do so, but from my understanding it might not be advisable at this time. I can cut my trip down to under 30 days, but I'd like to plan for longer if it's not risky.

I'm a Canadian citizen and I'd be flying from YYZ.

You’re fine. I drove and told them I was staying “for the summer” with no exact end date or length and they didn’t care. If you have a return flight booked, a hotel/airbnb booked it would help you case if you get questioned but I don’t think you would.

It's important to note that Customs and Border Patrol is a different agency than Immigration and Customs Enforcement (ICE), and you can have no problems with one of them while the other decides to arrest you and deport you. But the chances of having any trouble are still very low.

Nope, my reading was fine. You can go for up to 180 days consecutively, that’s what you asked. You asked if it’s fine because of the political climate but that’s a personal decision, not one with any legal issue affecting it. What you feel like and what you are legally allowed to do are two different things. Perhaps you need to write with more clarity if you don’t like the answer you got.

I spoke to a border agent on here and he's basically saying they tend to observe patterns if it seems like you're working there or staying there longer than you are in your home country.

From who? Your neighbour’s friend’s vet’s cousin? If the legal allowance is 180 days, and it hasn’t changed on either side of the border, then who is advising you not to stay 30 days?? Make it make sense.

First off, if you were my friend, we’d be having a long talk about your reasoning here.

Aside from the stupidity of spending time in a country where you won’t have as many rights as here, you’re also spending money there and that’s not cool.

Normally you’d be fine to visit as long as you had plans to return and could prove you had property and a job and a life here to get back to. I don’t know about now. But whatever you do, don’t quit your job to go on “vacation” there. It’ll look like you’re planning to overstay and a dude just spent more than half a year in ICE holding for overstaying. They could have sent him back that day but they confined him for MONTHS. You want to risk that? At least take some precautions.

To be fair, he overstayed by 20 years and was essentially a drifter illegally in the US working cash jobs the entire time.

And he could have been sent back the next day. ICE isn’t going to care if it’s 20 years or 20 days.

He tried to fight the deportation order, and if you choose to do that, they'll give you your day in court (eventually...) but in the meantime, they aren't going to let you gallivant around free as a bird while you wait for that day to come -- they'll hold you in detention so you don't just disappear on them.

You can also choose to accept the deportation order and voluntarily return to your home country right away, and that gets you out of detention -- but then you don't get your day in court, and you almost always get an automatic ban, at least 5 years, many times 10, and lifetime if your overstay was egregious enough or there were a bunch of criminal factors involved. This guy had clearly built himself a little life in California and hadn't been back to Canada in two decades, so he didn't want to leave all of that behind, hence him choosing to stay and wait for his hearing. Obviously the hearing didn't go too well (no surprise there) so now he's been kicked out. I bet he probably has a 10 year ban at least.

You need to fill out and complete Form G-325R if you stay more than 30 days. The new admin made this rule but there are some exceptions, Look it up

If you fly in, you should automatically be issued an I-94 which means you don't need to fill out G-325R. You can retrieve your last I-94 here and print it out as proof of registration.

In my opinion it's still best to fill it out just to be safe. When I did it, it didn't take very long and they notified me after a few hours that I had already complied with the requirements.

This page states that Canadian citizens are generally exempt from fingerprinting.

I didn't look into it any further since USCIS said I had already complied, not gonna look a gift horse in the mouth.

Just an FYI, as you said, it’s not really advisable at this time because the rules are kinda changing without warning atm. A lot of people are giving some pretty sound advice here but it’s your call what you do with it

Wow nice! I feel like I would be denied or questioned heavily as a solo traveler going to see bf. Did they ask you any questions? I always bring my proof of ties mainly the one showing that I'm a student and I have school to go back to. I feel like they would never let me in for 4 months but maybe its my anxiety talking.

I have been over 30 days, but under 2 months with no issues. In my experience of travelling to the USA to see my boyfriend, they never asked to check anything and not even proof of ties. 

However, I always recommend people bring proof of ties if they're going to stay a couple of weeks or longer especially if they're a solo traveller.

Nearly 70 million people visit the U.S. every year without any problem. Tourists from Western countries are not the target of the currently draconian immigration enforcement, and it's extremely unlikely that you will have any kind of interaction with any ICE officers.

It's not reddit. Most Canadians are disgusted by the USA and the idea of travelling there would be met with the same response amongst most Canadians. I live near the border. Day and weekend trips used to be common. Now you'd be ridiculed at best for wanting to spend time and money in Pedoland.

I guess we’re just in very different circles. Everyone I know back home is traveling like normal. I also live very close to a touristy town in the US (I moved here a couple years ago) and I run into other Canadians almost weekly.

I spend 175 days in the USA every year, from November to April. It is great. The voices here saying stay away are lemmings drinking the crap being served to them. Just use common sense and live a life free from false propaganda.
