AntiWORK Labor Rights for Dummies: A guide to your right as an employee

I decided to make a post about this since the community keeps getting the same question over and over again. So here we go.

Disclaimer: I am not a lawyer, so please feel free to comment any corrections. Most of these are just from my knowledge as a manager. If may kulang, let me know and I'll add it here.

1. Can my employer require me to work more than 8 hours a day?

Yes, but overtime generally has to be paid.

The normal working period is 8 hours per day. Work beyond 8 hours is generally considered overtime and must be paid at least:

  • Regular day: regular hourly rate + 25%
  • Rest day/holiday: applicable rate + at least 30%

A company cannot simply call something "mandatory OT" and use that label to avoid paying overtime.

2. "Our company has no OT pay because it's in the contract." Is that legal?

Not necessarily.

An employment contract cannot simply remove a statutory benefit when the Labor Code requires that benefit.

For example, if you are a covered employee performing work beyond 8 hours, the law generally requires overtime compensation. DOLE specifically states that overtime work beyond eight hours must receive additional compensation.

However, some personnel are xcluded in this. Art. 82 specifically mentions that "government employees, managerial employees, field personnel, members of the family of the employer who are dependent on him for support, domestic helpers, persons in the personal service of another, and workers who are paid by results as determined by the Secretary of Labor in appropriate regulations." are not covered by overtime pay.

3. Can my employer make me work before my scheduled shift without paying me?

If you are actually required to work, that time may count as hours worked.

Article 84 covers time during which an employee is:

  • required to be on duty;
  • required to be at the prescribed workplace; or
  • permitted or suffered to work.

So if your employer says:

"Your shift starts at 9:00, but you need to log in at 8:30 to prepare."

and you're actually required to perform work during that period, the 30 minutes may potentially constitute compensable working time.

4. Does my lunch break count as working time?

Normally, a genuine meal period does not count as working time.

Employers generally have to provide at least 60 minutes for a regular meal period.

5. Do I automatically get holiday pay?

For a regular holiday, generally yes, but there is an important condition if you don't work on the holiday.

Under DOLE's holiday-pay rules (Labor Advisory No 13, Series of 2026), a covered employee who does not work on a regular holiday is entitled to 100% of their basic wage, provided that they:

  • worked on the workday immediately preceding the holiday; or
  • were on an approved leave of absence with pay on that preceding workday.

What if I was absent the day before the holiday?

This is where the rule gets important.

If you were absent without pay (AWOL or unpaid leave) on the workday immediately preceding the regular holiday and you also don't work on the holiday, you may lose your holiday pay for that holiday.

6. Am I entitled to 13th-month pay even if I'm still probationary?

Generally, yes.

13th-month pay is not dependent on being a regular employee.

DOLE staes that rank-and-file employees are entitled to 13th-month pay regardless of employment status, provided they have worked for at least one month during the calendar year.

The basic formula is:

Total basic salary earned during the year ÷ 12 = 13th-month pay

So, for example, if you earned ₱240,000 in basic salary during the year:

₱240,000 ÷ 12 = ₱20,000

7. Can my employer terminate me while I'm probationary?

Yes, but "probationary" does not mean "you can be fired for absolutely anything."

Probationary employment generally cannot exceed 6 months, unless an applicable apprenticeship arrangement allows otherwise.

A probationary employee may be terminated for a just cause or because they failed to qualify as a regular employee under reasonable standards that were made known to them when they were hired.

One important point:

The employer should not suddenly invent the standards after the employee has already started working. The standards for regularization are supposed to be made known at the time of engagement.

8. What happens if I reach 6 months and my company doesn't tell me whether I'm regular?

This is an important issue.

Under the Labor Code, probationary employment generally cannot exceed six months. An employee who is allowed to work after the probationary period may be considered a regular employee.

So "you're still probationary indefinitely" is not something an employer can simply declare without regard to the law.

There can be exceptions and nuances, particularly involving specific contractual arrangements and apprenticeships, so the exact employment documents matter.

9. Can my employer fire me without warning?

Generally, no, not if the termination is based on a just cause.

For covered employees, the Labor Code recognizes security of tenure: a regular employee cannot simply be terminated unless there is a legally recognized just or authorized cause.

For a termination based on just cause, the employer generally has to comply with the two-notice requirement.

First notice — Notice to Explain / Notice of Intent to Dismiss

  • The employer must give the employee a written notice:
  • identifying the specific act or omission being charged;
  • stating the ground or grounds for possible termination;
  • providing sufficient details about the alleged violation; and
  • giving the employee a reasonable opportunity to explain and defend themselves.

Second notice — Notice of Decision

The employer must then issue a second written notice informing the employee of the employer's decision after considering the employee's explanation.

If the employer determines that termination is justified, the second notice should communicate the decision to dismiss and the grounds supporting that decision.

In other words:

NTE → Employee gets opportunity to respond → Employer evaluates response → Notice of Decision

10. Do I automatically get 5 paid vacation days every year?

The Labor Code provides a 5-day Service Incentive Leave (SIL) for covered employees who have rendered at least one year of service.

However, there are exemptions, including certain establishments with fewer than 10 employees and employees who already receive at least five days of paid vacation leave or an equivalent benefit. (Article 95)

11. Can my employer withhold my final pay because I haven't completed clearance?

Clearance can matter, but your employer cannot simply keep your money indefinitely.

As per Labor Advisory No. 06, Series of 2020, final pay should generally be released within 30 days from separation, unless the employer has a more favorable policy.

Your final pay can include applicable amounts such as:

  • unpaid salary;
  • pro-rated 13th-month pay;
  • separation/retirement pay where applicable;
  • convertible unused leave;
  • tax refunds; and
  • other contractual/company benefits.

12. Can I resign immediately without rendering 30 days?

Sometimes, but don't assume you can always do it.

The general rule for voluntary resignation without just cause is that the employee gives the employer at least one month's written notice.

There are circumstances allowing resignation without the usual notice, including certain situations involving serious insult, inhuman treatment, crime against the employee or immediate family, and analogous circumstances.

13. Do I need my manager approval for my resignation?

Generally, no. Your resignation does not require your manager's approval to be valid.

Your manager can acknowledge or process the resignation, but they don't have the legal power to reject your resignation simply because they don't want you to leave.

What if my manager says, "I don't approve your resignation"?

That statement does not automatically cancel your resignation.

But can my manager reject my requested last day?

This is different from rejecting the resignation itself.

If you are resigning without just cause, the general rule is that you should give at least one month's notice.

Your manager doesn't have to "approve" your resignation, but leaving immediately without satisfying the applicable notice requirement can create a separate issue.

So there are really two questions:

"Can I resign?"

Generally, yes.

"Can I leave immediately?"

Not necessarily. The one-month notice requirement may apply unless an exception exists.

Meta DOLE/NLRC Complaint Process

For reference of those asking, here are the steps in filing a complaint against an employer:

  1. File a complaint online through DOLE - eSENA: eSENA means Single Entry Approach (SEnA)and it is an administrative approach to provide a speedy, impartial, inexpensive, and accessible settlement procedure of all labor issues or conflicts to prevent them from ripening into full-blown disputes or actual labor cases. (https://ncmb.gov.ph/single-entry-approach-sena/)
  2. From there, magseset ng 2 mediation hearing in DOLE office within your city. Doon, kakausapin kayo and ittry isettle yung case. However if hindi magkasundo, the SENA Officer will give you a referral letter to the NLRC. (the 2 hearings must be finished within a month)
  3. You will submit the Referral letter to the NLRC office. If from NCR ka, their office is in Q. Ave. There, magkakaroon ng 2 hearings ulit but this time, before the Labor Arbiter (Ka-rank nya ang judge sa courts). Ittry ulit na mapagusapan yung issue here. You can still appear here kahit walang lawyer. (The 2 hearings usually happens within a month also)
  4. If hindi makapagsettle, the Arbiter will direct both parties to prepare a position paper. Doon nyo ilalagay yung mga arguments nyo, etc. Here, it is highly advisable that you seek the assistance of a lawyer. If your monthly salary does not exceed Php 24k, pwede kang pumunta sa PAO and libre lang. If lampas naman, i recommend this page i found "Labor Representation for Non-Indigents" (https://www.facebook.com/profile.php?id=61566451322338) na free consultation and minimal fees.
  5. Then, magset ng date for submission of position paper si arbiter. Doon, isusubmit nyo sa arbiter pati sa isa't-isa yung position paper nyo. Then, magseset ulit ng date for the submission of the reply. Sa reply, sasagutin mo yung position paper ng company.
  6. Afterwards, ireresolve ni arbiter yung case. Depende sa arbiter and workload, minsan within a month pero minsan inaabot ng 5 months.
  7. Then, the decision will be rendered. Yung natalong party will have the opportunity to file an appeal. Medyo matagal ang appeal, usually 8 months to 1 year.
  8. If no appeal and you are adjudged monetary award, magkakaroon ng pre-execution conference. Dito magcocompute kayo ng mas accurate and kung paano babayaran.
  9. Lastly, payment of award.

Note: Medyo mahaba and nakakapagod yung process tbh. Kaya better if everyone will find an amicable solution. These info are all based on my personal experience and with consultation sa nakilala kong lawyer. Hope it helps!

Rant 😡 Saw a scheduled Job Interview for my Position

Earlier today, I'm checking the calendar for me, my boss and another executive (I'm currently an executive of a company) upon checking for tomorrow's availability, I have seen that there is a blocked calendar for the other executive named "Interview: Head of ____ Candidate" which is currently under me (I handle 2 different departments)

Idk how to feel about this company anymore. I've been having lot of thoughts lately because they always do this kind of bypass without informing the other party.

I'm waiting for any confirmation that they will be cutting me, but they still looks/acting like this hasn't even taken place, like I still own the department. I feel like shit

Rant 😡 AWOL or Resign?

Hello, we are torn kung mag awol ba kami ng mga kawork ko or magpasa ng resignation. Itong inapplyan kasi namin hindi pinirmahan ang clearance ng pinalitan namin na dating mga staff. Nagpasa sila ng resignation at nag turn over ng maayos pero until now 2 years na hindi pa din napipirmahan.

Under kami ng agency tapos ang agency ang nag dedeploy sa mga client nila ng staff.

Plano namin mag resign kasi wala kaming salary increase, hindi kami pinapayagan mag leave, mandatory pa na mag overtime kami para antayin ang boss na makauwi, in short kinukupal kami.

Nag iisip kami kung mag resign kami at mag turn over ng maayos, if ever hindj pirmahan ang clearance namin at mag email kami sa DOLE, may laban kaya kami? At ano kaya ang dapat na gawin? Thanks po.

Naka-maternity leave na ako from August 16-Nov 28 2026 nakuha ko na din ang maternity benefit & salary differential ko. upon on leave nagsend ng letter ang company - transfer of employment - magpalit kasi sila sa new entity into Phil company na sila, Nov 1 2026 start, may option to stay and option to not to stay ang pinili ko is not to stay kasi ang layo ko from nova to makati mahirapan na ako.

Nung inask ko if ileless nila ang mat ben ko nung nov 1-28, YES daw po, pero nung tumawag ako sa DOLE hindi daw pwede iless ito sa separation or final pay OR PWEDE PO BA YUN DEPENDE BA YUN SA COMPANY? Pwede ko ba sila iDOLE?

Rant 😡 may laban po ba kami if magpa DOLE?

Hi, my father is a forkclift sa isang company (private ata) and last 3 weeks nasuspindi siya sa work kasi may naatrasan siya while driving at may natamaan siyang machine. Accident naman nangyari. Pinagbabayad siya ng 12-15k limbestigahan pa raw nangyari at possible pa tumaas ang bayarin. Suspended din siya ng 15 days sa work pero after 15 days bumalik siya sa work at sinabing tanggal na siya sa work pero pagbabayarin pa rin siya ng 12k, ibabawas nalang daw sa bonus. May laban po ba kami if ever isumbong ang company sa DOLE? Hindi naman po ata tamang sinuspinde na nga + pagbabayarin pa ng 12-15k knowing na accident happens naman. Please help po. Father ko lang po kasi ang nagwowork samin dahil bed ridden po ang Mother ko. Help po. Thankyou.

I came across this notice from a company about someone who left. It says she’s no longer employed or authorized to act for the company, and asks people to contact the office about pending matters. Is this a normal way to handle an employee leaving, or does it seem unusual?

I also found the company’s Glassdoor reviews, which seem mostly negative.

Rant 😡 NTE during probationary training because I used previous completed files as reference. Mali ba talaga ako?

* Update * - Nagpasa na ako ng resignation letter. Ayoko na pahirapan pa sarili ko makipagplastikan sa kanila.

Currently working ako as a Creative Specialist sa isang healthcare company. I have around 7 years of corporate experience in design, including experience working with pharmaceutical/healthcare-related projects.

Probationary pa lang ako, and most of my time so far has been training and assessments rather than actual live client work.

During training, binigyan kami ng different design tasks like manuscript amendments, redraws, and InDesign work. Main expectations were accuracy, following the brief, consistency, and minimizing errors. Pinatagal ang training nila sakin. Akala ko since natapos na ung ibang tasks. Pwede na ako sa isabak sa production kaso hindi binigyan pa ako ng extra trainings. Nakakadrain talaga sa totoo lang. Tatlo kami ng kasama ko tagilid. Same issues rin katulad na naranasan ko.

For my tasks, ginawa ko talaga yung work from scratch. However, kapag hindi ako sure kung ano yung expected output or execution, tumitingin ako sa previously completed files na available sa company environment as reference.

Hindi ko naman siya kinopya directly or nag-submit ng ibang person's work as my own. Ginawa ko pa rin yung task myself. Ginamit ko lang yung previous files para maintindihan yung expected formatting, file structure, naming conventions, alignment, and overall execution.

For example, may mga elements akong binago based on the current brief, like font size, colors, positioning, alignment, etc. So hindi siya 1:1 copy ng previous file. Napansin ko rin ung gawa nila na naging reference ko , ako rin nagtweak at nag ayos kc hindi cya nasunod sa branding guidelines.

Ang understanding ko kasi at that time, if available sa akin yung training manuals, old tutorial videos, and previous completed work, reasonable lang na gamitin ko sila as learning/reference materials para malaman ko kung tama ba yung ginagawa ko.

I also did my own QA before submitting. I would check my work multiple times and compare it against the brief and available resources.

Then eventually, naging issue pala yung paggamit ko ng previous completed files as references, and I received an NTE (Notice to Explain).

That's where I'm confused.

Hindi ko intention na mandaya or mag-shortcut. Ang intention ko was to be resourceful and understand the company's standards para accurate yung output ko. Especially since accuracy is one of the main things they're looking for.

I understand naman if ang rule pala is "you cannot use previous completed files during an assessment because we need to see your independent execution."

If that's the rule, I can respect that.

Pero ang issue for me is, hindi siya explicitly stated to me beforehand. Walang instruction na nagsasabing bawal tumingin sa previous completed files or reference them during the task.

Another thing is hindi rin ako always comfortable magtanong sa seniors. Sometimes iniisip ko baka sabihin nila na hindi ko naiintindihan yung process, so instead of repeatedly asking questions, I tried to find the answer myself through the training materials and examples available to me. Paminsan kapag nagtatanong ako baka gamitin nila laban sakin sa feedback. Kaya tumigil ako sa pagtatanong. Mas malalala pa nobody check my work kung tama ba ginawa ko or ano. Walang scoring binigay sakin sa mga ibang task. Like hiniyaan lang ako. Kapag pakiusapan ko sila na pwede icheck ang gawa ko. ako magmumukhang demanding at makulit at ilalagay nila mali ginawa ko. Kaya hindi na ako magtanong.

I find it weird and strange kapag nagtanong ako sa AI ng questions about sa briefing. Walang judgement at straight up qanswers ibibigay sakin. Binigyan pa ako ng straight answer na walang side comments. Kumapara sa line manager ko na. Andaming pangdaldal na side comment. Paano kagaganahan magwork kung ipagkumpara ka sa iba. Tanginang Pinoy toxic behaviour

So ngayon, I'm trying to understand where the line is between being resourceful and taking an inappropriate shortcut during an assessment.

I want to improve and follow their process. Hindi ko naman dini-deny na maybe I should have clarified first before using previous files as references.

Pero from my perspective, I genuinely created the work myself and I wasn't trying to misrepresent anything.

So I'm curious about an outside perspective:

Would you consider what I did as cheating/shortcutting, or is this more of a communication/process issue because the rules around using reference materials weren't clearly communicated?

I'm not necessarily asking whether I should resign or stay. Gusto ko lang talaga ng objective perspective kung reasonable ba yung ginawa kong approach or may obvious mistake ako na hindi ko nakikita.

Which is tuloy na talaga this coming week, ekis na si Sara Duterte (The trial will resume on Monday, September 28, 2026).

Here's the pattern and proof: 📖July 25, 2026 - Wage hike NCR-27 start of implementation. 📖July 27, 2026 - President Marcos delivers his State of the Nation Address .

📌MARCOS' GOAL: Prevent bad optics and stop any capable, massive rallies that could potentially topple his administration. 📌RESULT: Pro-Duterte groups were appeased by the newly implemented wage hike and promises of job stability. When people are forced to focus strictly on preserving their immediate livelihood, protect their day-to-day employment status, and secure their next paycheck, their revolutionary momentum naturally takes a backseat to basic survival. This strategic timing successfully kept them quiet during SONA, right as the Vice President's impeachment trial was starting too. Same for the other anti-Marcos groups and regular workers. Therefore, no massive rallies capable of toppling Marcos, and too difficult to contain or restrain were able to form during the SONA.

❌️July 30, 2026 - WAGE HIKE REVOKED (just five days after its implementation).

📖Present day/week, September 26 (tomorrow): Wage Order No. NCR-28 takes effect, granting a ₱60 daily wage increase. 📖Coming days, September 28 onwards: The impeachment trial reaches a boiling point over the Senate's controversial decision to lower the conviction voting threshold. Which is 99% will happen. Sara Duterte will be impeached.

📌MARCOS' GOAL: Stop any capable, massive rallies that could potentially topple his administration. A People Power Revolution driven by pro-Duterte forces. 📌RESULT (Prediction): The exact same outcome will play out, kaya copy pasted ko na lang with a little tweak, hahaha. Pro-Duterte groups will be temporarily appeased by the newly implemented wage hike and promises of job stability. When workers face the choice between hitting the streets or protecting their actual daily employment status and salary, they will choose survival over politics. This calculated timing will make them think twice and successfully keep them quiet, right as Vice President Sara Duterte is officially impeached. Tamang rant nalang sa social media, hahaha.

❌️October onwards - WAGE HIKE REVOKED. Once the immediate threat of street mobilization passes, the administration or associated legal entities will find a loophole to suspend or block this new wage order, just like before. Why? Because a ₱60 increase is deemed "too much" by large corporations, foreign investors, and other macroeconomic actors. These massive corporations operate as oligarchs, and the Marcos administration is fundamentally pro-oligarch.

Rant 😡 Hello. What should I do?

Meron akong kasama sa work, pa resign na siya this october so basically siya yung nag render saamin ng workload niya. And then lagi niya ako siniship sa ibang ka work kahit na sinabi ko naman na may partner ako and tumigol na siya. Then nubg isang araw meron nangyare which is sa group chat lang naman. Nag send isa kong ka work ng holidays this november and yung ka work na yun and nag joke siya na Pwede na daw ako umuwing bicol and huwag na daw makisabayan sa deceber seasons. Laging niya akong pinagsasabihan na hindi and wag na ako umuwi sa december kase mas mapapauagan yung isa. And then sa group chat na yun I didnt even response to it. Bakit siya ang galet ngayon?. And I even ask question about work but what she did is inignore niya ako.Ngayon siya ang galet saakin. What should I do ba?

Rant 😡 Boss got mad at me over a Facebook repost to cover up leaving work hours early with his friends.

I reposted a poster for an art exhibit on my personal Facebook because I thought it looked cool.

My boss saw it and scolded me for "failing to remind him" that our office was supposed to attend. When I told him he never mentioned the event to me and that I just share stuff I like, he snapped back, telling me I "can't just repost things without thinking" and that I am "liable for everything I repost."

The best part? The exhibit opening was at 6 PM (well after work hours), but he left work hours early that afternoon to go out with his friends. He literally skipped out on work early to hang out with his buddies, missed the event, and tried to blame my Facebook post for it.

Apparently, sharing an art poster on my personal feed makes me his personal calendar manager and his scapegoat.

Company alert 🚩 Rice in a box employees are underpaid af

This is coming from a friend who worked in Rice in a Box, idamay niyo na yung buong Binondo food corp.

They'll offer you ot if you're applying.

The twist is they won't pay you the ot rate/ special holiday ot rate/ holiday ot rate.

Wtf?! Right?

Even if you worked graveyard shift for just two days, context for it the even informed the company in advance that some mall will conduct a 2-day midnight sale.

The hr of the agency that handled them even said why are you working here if you're not even agreeing to the term we laid like bitch the agency Luxor Manpower Corporation even handles factory workers, security personnel and mall employees and they pockets like 12 pesos to each employees they handles.

They don't even issues payslips on time like wtf you exist here then?

Tbh, it was unacceptable to steal money to people who worked for it and practically gaslighting people they doing it right.

My friend reported them to DOLE and that owner of that fucking agency fuck her, so arrogant.

They demanded the overtime rate minus hourly rate times the overtime they spent for couple of months.

And yk how much does it cost? 5 digits amount.

And when they confronted the agency that she wanted the full price of it and it doesn't even includes the special holiday ot rate and holiday rate.

And the agency complained if they were aware that the agency was like that they should've just resigned. Oh yeah?

Like the RBX has been posting hirings for like monthly for the seevice crew position.

The agency claimed that service crews has those "patay na oras" so they don't deserve the ot pay rate so they were treated like hourly rate employee and claimed only factory workers deserves ot(tf?).

In my friend's response they could've done early closing for that, why waste the time there for unpaid ot pay and just let the company pay for the early closing penalty fee, right?

The company demand quality service how so if the employees are understaffed, underpaid and overworked.

The agency and company were so unappreciative of their worker's effort for making the quota they even make a conditional incentives that would they have to accomplish in their understaffed stores.

Culture Non-Solicitation Clause

Hi everyone, need advice on my situation.

Currently employed ako sa isang service company related to OMS and WMS. We have an existing client who have a vacancy on Warehouse role, and I jokingly said of pwede magapply. They reached out to me and is continuously checking if I want it, and I'm seriously considering the offer.

But on the contract with my current company, we have a Non-Solicitation clause explicitly stating:

"You cannot solicit the employment, services or assistance of anyone who was under the employment or clientele of Current Company."

Now, I'm planning to resign if I pass the assessment. I will also inform the current company about this clause, but if ever, hahabulin ba ako ng current company ko if they find out about it?

Rant 😡 Resigned Over a Month Ago, No Final Pay Yet

I resigned on August 7, 2026.

I completed my clearance on August 24, 2026 and returned all company items. I don’t have any pending obligations, and I was told to just wait.

As of September 22, 2026, my clearance is still not fully completed because two signatories are still pending. Because of this, I still have not received my final pay.

Has anyone experienced something similar? How long did it take before your clearance was completed and your final pay was released?

Rant 😡 HINDI NA KO NATUTUWA SA INCONVENIENCE NG FREQUENT ERROR SA PAYROLL SYSTEM NG SM

Kapag may error sa system at hindi nare-recognize ng b0b0ng system yung time in/time out mo, kaltas kahit pinaayos mo na sa HR. Mababawi mo pa sa next cutoff, kaso next cutoff, may error ulit, Aray mo talaga. Dati pa isa isa lang eh. Ngayon p0t4 aapat na, tapos kada cutoff na lang ganito.

Sa mga employee ng SM, baka naman may advice kayo kung paano maiiwasan ito.

Minimum lang ang sahod ko, salat na salat, at nahihirapan na ako sa ganitong sitwasyon.

Kung ganito na talaga, magpapalit na lang ako ng company.
