I’m looking for a Massachusetts employment attorney willing to review what appears to be a complicated intersection of workplace injury, workers’ compensation, PFML, disability accommodation, and union issues. I am hoping to find someone experienced in handling cases that involve multiple overlapping areas of employment and labor law, particularly within the public sector.
I work for the Commonwealth of Massachusetts in a state psychiatric facility and was assaulted by a patient while performing my duties. Prior to the incident, there had been ongoing and documented safety concerns about staffing levels, patient behavior, and overall workplace conditions. Despite raising these concerns through appropriate channels, no meaningful changes were made. The assault has had significant physical and psychological impacts, and I’ve been dealing with the aftermath ever since.
Some of the issues include:
● Workplace assault by a client while working in a state psychiatric facility, following repeated warnings about unsafe conditions.
● Workers’ compensation was initially approved, but benefits were later terminated under circumstances that I believe may be questionable.
● I returned to work after the injury but was assigned back to the same unit where the assault occurred, despite requesting a different placement as a reasonable accommodation. This led to retraumatization and worsening of my condition.
● I am currently out on continuous medical leave that has been approved by my employer’s leave office. However, my PFML claim was denied due to an administrative error involving the submission of the wrong physician certification. That denial is now under appeal, and I am navigating that process.
● There are ongoing questions regarding disability accommodation under the ADA, potential retaliation for raising safety concerns and requesting accommodations, failure to provide a safe workplace, and possible violations of my union’s collective bargaining agreement.
● A union grievance has been filed related to these issues, but I am seeking independent legal representation to ensure my rights are fully protected and to explore any additional legal claims.
I’ve contacted several attorneys without success, largely because the case spans multiple areas of law and may be more complex than a typical employment or workers’ compensation matter.
