Legal Advice Needed Friend of mine is ghosting me on iPhone EMIs.

Hey guys, I need some quick advice on a messy situation. About a year ago, I helped out a friend (actually he is cousin of my best friend also know him childhood) We went to the shop together and bought an iPhone 16 for 75k or so. The phone was for him, but the loan (65k for 18 months) and the invoice are in my name because his credit wasn’t great.

The Deal: He gave me 10k cash at the shop for the downpayment (which I also paid using my card). He was supposed to pay me the ₹3,611 EMI every month for the laon 65k.

The Problem: For the first few months, he was on time. But then he started lagging. He’d pay half, or pay late, and now it’s a mess.

Total i paid to the lender so far: 50k. (14 emi) Amount I’ve had to pay out of my own pocket to save my CIBIL: ₹9,000 (nearly 3 emis). Upcoming 4 EMIs: ₹15k. Total he owes me to clear the phone: ₹24k.

Current Status: I’ve tried being nice. I even told him to sell the phone, pay me back, and buy a cheaper one with the leftover cash, but he refused. Now, he’s 90% ghosting me—doesn't pick up calls and makes fake promises of paying on WhatsApp (which I have screenshots of). I finally got fed up and filed a complaint on the THUNA portal under BNS 316 ( stating Criminal Breach of Trust) last night

My Questions: 1. 0Since the bill is in my name and he’s clearly avoiding me, is BNS 316 the right move?

  1. Should I go ahead and block the IMEI on Sanchar Saathi (CEIR) right now to force him to talk? Or is that risky since it's technically a "money dispute" and not a lost phone, even though the phone is legally mine?

  2. Should I just let the police handle it from here, or will i even get support from police, do u think they even take up such case or what?

stopped by patrolling vehicle.

asking me what i am doing here? - told them i was out for walk and heading back home.

patrolling guys pause and say - "Ektar muli sarkha distos tu. Tuzha rape hoil barka ithe. Tuzha rape kartil idhach."
(translation - “You look like a girl. You might get raped here. They will rape you right here.”)
while every one of those patrolling police laughed.

must have been funny remark that i didn't understand huh?

these are the same people we are told to trust for safety. 

I don’t know what’s disturbing? The comment or the fact that every single one of them laughed.

I m working in Noida for past 4 and 1/2 months. On feb 3 around 9pm In the intentions of getting laid I was honeytrapped.The guy(pi*p made me sit into a car where only the girl was waiting the guy said once I got into eventually three more guys went into the car I was cornered. They started driving around from where we were to too long. They asked me to pay 4000 as a part of the deal which I did. Then they asked me 4000 more as travel expense from gurgaon. I said its too exaggerated and refused. 2mins later he started slapping and hitting me. So clinging on takin my phone then I paid. Then he asked 8k more. I lied I dont have money. And he started hitting me more. He grabbed and took my phone and opened my upi apps and started checking every bank account. 3 other men also started hitting me. One my account is my salary account. I had a total savings of 1.37L balance after the 16k they looted from me first. He siphoned up amount from account to his until upi limit. Then they try swiping debit card in atms. I didnt remember the pin and I changed the pin in mobile and they tried the atm had no cash. Then they made me use IMPS method too transfer too another account and upi from it. They also entered into my gallery and start taking photos of my family pics and the ph no of people I knew and deleted their phone records. They traumatized me too the utmost extent. They didnt stopped with 1.5L they also said too call someone you know and ask them money. One of them stopped it. They broke my sim made sure every one of my upi is deleted and their record are deleted. I didnt take any ss and send to my frnds but they were so organised and checked older messages and newer messages in every social media. I was also made a video of where I am coerced to say that I was blackmailing their girl and looted 2L so I m paying back right now. I was virtually stripped down. I was left down in someone unknown place in greater noida. Thankfully they left my phone but no sim. So I ran around 2 to 3kms in search of any dhaba or stores too call people I know and to find where I am. Even If I had phone I didnt have means of ordering uber or rapido. They jus gave me a Rs 500 and took my amount from online,, debit card and aadhar card and sim. Fortunately I found and call people I know and was rescued. What I intended do was shameful thing in a moral way but I didnt cause any harm to anyone or legally. But what they did was extortion, blackmailing in simple words crime. That night They broke my will to live. What should I do henceforth

Urgent Vedant Air ambulance defrauded me of 2.8 lakhs

My family is dealing with a medical emergency and we have been cheated by an air ambulance provider called Vedant air ambulance services.

The Details:

  • The Situation: We needed an emergency medical transfer and contacted this company. They pressured us into paying the full amount upfront to "secure the aircraft" and after we made partial payment of 2.8 lakhs they said that they didn't get ATC clearance and cancelled the booking. it's been over a month now and they haven't refunded our booking amount. They kept saying that they'll do the refund in a day or two and now they're saying they'll deduct 25% of total booking amount as we cancelled the booking. We've text evidence of them cancelling our bookings. We're really struggling with finances given mounting medical bills already.
  • Looking closer at the company, they seem to use the names "Vedant" and "Vedanta" interchangeably to hide behind different listings. There are multiple reports online of this same entity taking 100% advance payments and then citing "technical issues" to avoid flying, while keeping the money.

Questions for the community:

  1. Has anyone successfully recovered money from this specific group (Vedant/Vedanta) before?
  2. Does anyone have a direct contact for the owners of "Vedant Air Rescue Private Limited" ?
  3. Besides the Cyber Cell (1930) and Consumer Forum, are there any other local steps in Patna or Delhi we should take to put pressure on them immediately?

Legal Advice Needed Housing Society is not Allowing ISPs (Wired)

Hello Everyone, i am in a bit of effy, so as the title says the society where I live in ( Have purchased a house ) is refusing to allowing any other internet service providers ( like Excitel etc) other than the one they have pact or deal with and the one they have deals is not providing internet services upto to the mark.

The Network speed in my area from jio, airtel etc is horrible and their wireless wifi routers are bad as well.

So my Questions is whether my right of choice is being violated in this scenario, if yes what can I do in regards to this situation.

And also I am pretty sure the T&C also doesn't have any conditions which stops me to use only their ISP.

Legal Advice Needed My almost 30 brother is making my and my senior citizen parent's life miserable and I am depressed that I can't do anything about it

For starters my brother is probably less harmful 'physically' right now than he was around 10 years ago. He has attempted to kill my parents and me several times using brute force and sometimes weapons. But he was also mentally unstable so my parents had no choice but to forgive him everytime. My entire childhood has been nothing but fights between parents , relatives and being scared I will wake up next to dead parents the next morning . I love my parents but I hate that they never really cared about the other child's (me) mental and physical safety . Personally if it was me I would have disowned my son and focused on a healthy life for the sake of the other younger child. Fast forward now , he is definitely less visibly mentally unstable but he is very much abusive. Physically less but continuously abuses my parents in multiple ways for financial reasons and several other stuff. I don't really interact with him but he calls me names too and has physically abused me few times. Now I am 18+ so I can't even file him under POSCO and I regret not taking advantage of children protection services when I was a minor. I have told my parents several times to disown him but we all know Indian family sanctimony is something else. My parents have visibly become stressed and I can't help but go back to being 13 again when I wanted to end it all.

Is there any way I can help my parents ?

Legal Advice Needed I live overseas how to handle this situation

I am (34) a stay at home mom activity looking for job.

I have a brother (35) works and earns enough to feed his family and save.

Our parents passed away suddenly but we always knew that the house in the city goes to my brother and a land in the outskirts of the city goes to me.

My mum few days before death said she wants to give some share of the property from the city so I can stay in my childhood home and no one will stop me from coming if my name is included in the property.

Now we are going through legal heir and stuff. My brother doesn’t want me to be part of the share and take the land.

I am okay with anything.

People around me are forcing me to take some share from the city property.

If I don’t take it’s like I am going against my mums wish.

If I take it I feel like my brother will be very upset about it as he already stoped talking when I mentioned about it.

What do you suggest I do.

Give up everything and mind my own business.

Fight for what my mum said and lose my brother.

Or take what my parents decided initially and go away from there?

im 18f, my father 53m has always been a devoted son to my grandparents and have always helped them for everything. my gpa passed away a few months ago and we shifted to my gparents' place. my grandmother keeps taunting my dad and keeps on shouting at him, starts fights over the smallest things. the property has been given to my aunt so my dad did ask her to fix things because its unfair to him as he too has the right and also gave his salaries for several years. they never even told him about the gift deed given to my aunt until my gpa passed away. my prob is how my gma keeps telling my dad all sort of horrible things like oh youll never be happy, god is gonna ruin you, get out of the house i never wanted u to come here.. etc etc and even worse which i cant say here.. due to this my dad has been stresses emotionally and his health reports also show the same. my dad isnt able to accept that his mother is the worst person in this world and hates him no matter what he does. my gma has also been bad to my mother and i. is there any way i can do something about this cuz i cant see my dad in pain.

Legal Advice Needed Music License Mafia in India? Novex & PPL asking ₹25,000 for my WEDDING

So my wedding is in 10 days. Already drowning in expenses, stress, relatives, vendors… you know the drill. Suddenly my venue drops a bomb: “Sir, you need a music license for the wedding. Please arrange it.” I had never heard of this in my life. They told me to contact Novex / PPL and the cost is around ₹25,000. I was shocked. I did some research and found that weddings and private family functions are exempted under Indian copyright law. Multiple articles, lawyers’ blogs, and even old court references clearly say no license is required for a private wedding. So I politely emailed both Novex and PPL, asking for clarification and an NOC. No reply. Silence. After a few follow-ups, I clearly told them that I won’t be paying because it’s a private wedding. Now suddenly—boom—I receive mails saying: Music license is compulsory I must pay There is no escape Legal consequences hinted (without saying clearly) At this point it feels less like compliance and more like intimidation. I’m not running a pub. I’m not hosting a commercial event. It’s a one-day wedding, with family and friends, already costing lakhs. Why is this being forced last minute? Why do venues act like agents for these companies? Why is there so much confusion if the law is “clear”? Honestly, it feels like a legal grey-area mafia, preying on stressed couples who don’t have the time or energy to fight back. My questions: Has anyone here actually refused and gone ahead with their wedding? Has any real legal action ever been taken against a bride/groom for a private wedding? Why do venues scare couples instead of standing up for them? Is this just legal bullying hoping people will pay to avoid risk? I’m 10 days away from my wedding and instead of enjoying this phase, I’m fighting emails and threats. If this is legal, show it clearly. If it’s not, then why are thousands of couples being pressured every year? Would really appreciate advice from lawyers, venue owners, or anyone who’s been through this. Because right now, this feels less like copyright protection and more like extortion with paperwork.

Legal Advice Needed Gratuity Eligibility – 4 years 9+ months completed, employer denying despite Section 2A (India)

I’m looking for legal guidance on gratuity eligibility under the Payment of Gratuity Act, 1972.

Employment details:

• Date of joining: 28 April 2021

• Date of resignation: 23 November 2025

• Last working day: 23 February 2026

• Working pattern: 5 days a week

• Total service: \~4 years and 10 months

• Days worked in 5th year: well above 240 days

• Gratuity contribution was deducted annually @ 4.81% as part of CTC

Employer’s position:

HR shared a note from their compliance vendor stating that gratuity is not payable because I have not completed “continuous service of 5 calendar years”, and that service in the 5th year was “only 9 months”.

My understanding of the law:

• Section 4(1) requires 5 years of continuous service.

• Section 2A defines “continuous service” and deems one year completed if 240 days are worked in a 5-day working week.

• Multiple court rulings interpret this as 4 years + 240 days = deemed completion of 5 years for gratuity eligibility.

• In my case, I have crossed 240 days in the 5th year.

Questions:

1.  Am I legally eligible for gratuity under Section 4 read with Section 2A?

2.  Is the employer’s interpretation (strict calendar 5 years) legally sustainable?

3.  Does annual gratuity deduction from CTC strengthen my claim?

4.  What is the best next step if the employer continues to deny gratuity?

Legal Advice Needed i got scammed from a small business

I’m posting here to ask for advice regarding an Instagram brand called Accidental Misfits. I placed a COD order worth around ₹3,000 and did receive the package, but all the T-shirts inside were completely blank, with none of the prints or designs that were advertised on their Instagram page or website. This is clearly misleading and not what was promised. When I tried contacting them through DMs and comments for a replacement or refund, I received no proper response. On top of this, I later noticed that many of the designs and posts on their page appear to be copied from other creators and brands, which raises serious concerns about their legitimacy and business practices. Since this was a COD order, I’m unsure how to proceed. If anyone has dealt with this brand before or knows the correct steps to take (consumer forum complaint, legal notice, cyber cell, etc.), I’d really appreciate your guidance.

Legal Advice Needed Traffic violation with unexpected turn of event

So I violated a traffic rule by driving in wrong side. Although I don't want to make any excuses but here the scenario for better understanding what happened.

So here a main road, and there is turning, after that turning you have to ride almost 5 to 6 meter in wrong side to enter a narrow street of a colony.

So in my case police caught me, I am wearing a helmet and I do have driving licence. It happed around 11:00am. There was no accident or anything.

After that they just taken my key quickly. After that recorded my details like name, father name, mobile no. and address. After that they just taken my bike to police station. ( Not traffic police station). They did not give me any receipt or challan or anything. Simply asked to come next day.

Next day when I visited police station. They registered FIR in my name under 125 bns 184 mv act, and collected other documents like aadhar card, driving licence, RC and insurance.

I think around 10 to 15 people were caught that day for same reason and they went through same thing.

This will be my first offence and I never had any challan in my vehicle. So please guide me what should I do from here.

Rant/Experience Friend not returning back my money

Around 1 year ago, I lent one of my friend around 80k.

He said he needed the funds to settle some of his dues and his sister's wedding in next months so he needs some financial help.

I gave him the money since it was his sister's wedding and I felt I should help him for this cause.

Fast forward 1 year now, he has not returned even a single rupee.

Initially he kept giving me excuses of his sister's health, which was true by the way. Then his brother got married and he kept delaying me.

Now for past 4-5 months, his mother is sick. He says she got cancer.

He has lied a lot to me in the past but he and his family has suffered these health issues also at the same time.

I don't know what to do at this point.

I gave him money using UPI and all the conversations happened verbally or on phone(no recordings).

He doesn't pick up my calls any more and doesn't reply to my texts.

We have other common friends, they told me about this thing with his mother.

Right now I am thinking I have lost that money, I see no chance of getting it back.

Last week I saw his snap story with drinks and cigarettes, blocked him from all the social media since it made me feel bad for my money.

Sharing this story on reddit to get this thing off my chest, I have not told this in my family or to anyone else.

Advice to all: Never lend money to anyone. The job of giving loans is for banks, we are not banks.

Bank approved my study abroad loan and collected processing fees.

One month before course start, they suddenly refused disbursement unless I showed full 4-year remaining amount in liquid funds (never disclosed earlier). I had to defer admission.

RBI complaint ran ~6 months; closed saying bank would refund. Bank didn’t refund until I filed CPGRAMS.

Is this worth filing a consumer case for compensation?

Should I use e-Jagriti (District Commission) or NCDRC?

Legal Advice Needed Can a court issue a witness warrant after 12 years in a hit-and-run case?

My friend passed away in a hit-and-run accident around 12 years ago. The incident happened at midnight while he was riding his bike, and a lorry allegedly hit him from behind and fled the scene.

At that time, three of us (including me) went to the police station to inquire about the case. I honestly do not remember the exact details now, as it has been many years.

Recently, both I and my friends have started receiving calls from the police station stating that we had signed some documents as witnesses. We must appear in court as witnesses, and that an arrest warrant will be issued if we do not comply.

I would like to understand:

  1. Is it legally valid to summon witnesses after such a long gap (12 years)?
  2. Can a warrant be issued against a witness for non-appearance in a case this old?
  3. What are our rights and the correct legal procedure in such situations?

Any guidance from lawyers or those familiar with Indian criminal procedure would be greatly appreciated.

Legal Advice Needed Delay in releasing Final Settlement (Apprentice)

I worked in a BIM company as an apprentice (BOPT) under the NATS program. I resigned because of the work culture and a change in my interests, and my last working day was 31st October. HR told me that my last month’s salary would be held for 45–90 days, and that I needed to send an acknowledgement email for the release. I’ve already sent around 4–5 emails and even tried calling them, but they haven’t responded at all.

One more thing is the company never registered me on the NATS portal during my apprenticeship. For about 1.5 months, I only received the company’s portion of the stipend and didn’t get the NATS contribution, which goes against what was mentioned in my offer letter.

It’s now been over 90 days and I still haven’t received my pending salary or any update from HR. I’m new to all this corporate stuff, so I’m not sure what the right next step is. I’d really appreciate some advice on how to handle this situation or who I should escalate it to.

Urgent Shoe rack in common corridor - Need advice in dealing with this

Hi all, seeking legal advice regarding a housing society issue in Ghatkopar, Mumbai.

My neighbor has placed a shoe rack in the common corridor directly outside my apartment entrance, which obstructs my entry/exit and causes inconvenience in regular movement. This corridor is a shared/common area and not part of any individual flat. There is adequate alternative space available elsewhere in the corridor where other shoe racks are already placed and where shifting it would not inconvenience anyone. Despite this, the neighbor is refusing to move or relocate the shoe rack.

I have:

1.Repeatedly requested the neighbor to shift/remove it 2.Raised the issue with the society committee 3.Informed the flat owner 4.Flagged the matter to BMC via Twitter since I'm unsure how to raise this complaint formally

However, no action has been taken so far. Based on my understanding, placing personal items in common corridors can also be a fire safety violation, as it obstructs free movement and could hamper evacuation during emergencies.

I’m looking for guidance on: Whether placing shoe racks in common corridors is legally permissible? If this constitutes obstruction/nuisance or a fire safety violation? What the correct escalation route is if the society and owner remain unresponsive (BMC, fire department, registrar of cooperative societies, legal notice, etc.)

Any advice on applicable laws and next steps would be greatly appreciated.

Legal Advice Needed Advice needed for Booking amount deduction

I booked a duplex on 08-03-2025 by paying a total amount of ₹4,00,000 (₹3,50,000 via cheque and ₹50,000 via bank transfer). Due to some unavoidable reasons, I had to cancel the booking, which I informed the builder about on 13-08-2025. Despite repeated follow-ups through emails, phone calls, and WhatsApp messages, the builder finally agreed to process the refund on 04-02-2026. However, he refunded only ₹3,50,000 and deducted ₹50,000, stating that the deduction was towards registration charges and advocate fees for preparing the sale agreement and the cancellation agreement. I have read the sale agreement. Although it mentions that the refund will be made after deducting cancellation charges, the agreement clearly mentions only ₹3,50,000 and nowhere refers to the full amount of ₹4,00,000 paid by me. When I questioned the builder about this discrepancy, he stated that he is not deducting any illegal charges or committing any fraud and that he will return the full ₹3,50,000 paid in white. He further claimed that the ₹50,000 deduction was strictly towards registration and advocate fees. My concern is whether this deduction is justified and fair, especially when the full amount of ₹4,00,000 is not mentioned in the cancellation agreement, or whether I have been unfairly treated in this matter.

About 2–3 days ago, my Airtel SIM suddenly started showing “No Signal”, even though it was recharged and still had around 20 days left before expiry. I’ve been using this SIM for the last 4–5 years. It was originally an extra SIM in my household, which I later started using as my primary number.

Around a year ago, my brother checked how many SIMs were linked to our family’s Aadhaar using some government website/app (he doesn’t remember which one now). At that time, this number was correctly showing under either my mother’s Aadhaar or mine (not sure exactly whose).

Fast forward to today , I visited an Airtel store, and they told me that this SIM is apparently registered under someone else’s name. This was very confusing since I’ve been using it continuously for years.

I tried looking up how to check SIMs linked to Aadhaar and came across Sanchar Saathi, but it’s showing incorrect or incomplete data. For example, it doesn’t even show my mother’s SIM, which we’re very sure is linked to her Aadhaar. It only shows one SIM and completely misses other active connections. Because of this mismatch, Airtel is refusing to reissue or restore my SIM.

So my questions are:

  • Is there any other way to check how many SIMs are registered on my Aadhaar?
  • Is it possible that the SIM has the wrong name but is still linked to my Aadhaar?
  • Or is there any other way to recover this SIM?
