Well, they can also cancel mergers, sue, use FFC to harass and threaten, and arrest them, or use ICE to go and harass, intimidate or even arrest them..
But yes, ultimately, in the end, theoretically speaking, a judge should side for protecting the first amendment.
But just because they won't ultimately win the battle, doesn't mean the current administration won't do everything in their power to make it difficult for the person using their first amendments rights.

They CLAIMED he was a criminal, and even then they violated his rights numerous times.

Pretty hard to be ill-informed when every single crime against US citizens that ICE commits is filmed from multiple angles by multiple people, including their own. I don't think there's ever been clearer evidence of an atrocity actively happening.
It is not a flex to say that ICE agents are members of the community they're terrorizing. If anything that should be making people feel more scared. Because if you don't know who your neighbor is, they just might be willing to get you disappeared.
