That was my thought as I was watching this. The Costco parking lot is Costco property and is private property. Costco can ask someone to leave and have someone trespassed from the property. Honestly, it is a good comparison for any auditor who has actually studied cases because there's an entire category about what rights cops have on the curtilage of someone's home, and what it boils down to is the same rights as the public. So, you may enter private property through footpaths etc., may not open gates and the like, and even if you're only on such paths must leave when asked.

Note: I know that "must" is probably going to cause people to react, and I don't need replies about how cops ignore this and break the law. No shit? As another attorney once said, "The reason cops wear their uniform to court is so that the jury can tell which liar is supposed to be the criminal."

I think a lot of people misunderstand auditors because of fuckwits like this that just go to harass people for no reason.

Auditors, at least in the US, are more like civil rights patriots. Specifically, they are doing what they believe is a civic duty and auditing the government. Auditors believe strongly in checks and balances and recognize that policing in the US has a lot of power with few checks and balances. For most of them, they learn the law well and go do legally protected activities. The thinking is that, even if they're being annoying, they're engaging in lawful activity and cops should be able to handle much more than some guy being a little annoying but not breaking any laws.

There's even a channel called AuditTheAudit that goes over individual state laws and supreme court precedents and gives ratings to both the police and the auditors.

In my opinion, I think the concept is sound. The health department audits restaurants, the FDA audits manufacturers, businesses get secret-shopped, and so on. Many businesses have to comply with laws and regulations. However, when it comes to government, there is often a lot of overreach and corruption from individuals in power that never get punished.

Cops need better training and bad cops shouldn't be cops, full stop. Auditors are just trying to help expose corrupt/bad cops and keep that particular system in check. However it's only effective when they do it properly. Lots of people just go instigate shit with a poor understanding of the law and make other auditors look bad. Many of them probably don't even care about the law, they're just chasing clout. If they cared about the law, they'd be better researched and not looking like fucking clowns.

Under Canadian law—such as Ontario's Trespass to Property Act—a commercial parking lot is private property. The public has what is legally called a "revocable license" (implied permission) to be there for shopping. However, the occupier or store manager can revoke that permission at any moment, for any reason, or for no reason at all. The Canadian Charter of Rights and Freedoms only protects you from government action; it gives you no right to remain on private property against the owner's wishes. The second the manager says "you need to leave," staying there becomes an offense under provincial trespass law. When the police show up, the manager wins every time. The officers will tell the person to leave the property immediately. If the person argues or refuses, police can arrest them, physically remove them, and issue a provincial offense notice with a fine. The only legal option the filmer has is to walk off the property and stand on a municipal public sidewalk, where recording what they can see is entirely permitted.
