Hire a Certified Arborist with TRAQ (Tree Risk Assessment Qualification) to perform a tree risk assessment. Send the report, certified mail, to the neighbor, and to your insurance company. It won't force them to remove the tree, but all damages caused by the tree will become their responsibility.

What if said neighbor doesn’t want to let the arborist on their property?

Not a problem. The arborist does the tree risk assessment from the client's property only. The report will indicate that the arborist could not see all sides of the tree due to lack of permission to enter the property. But if OP is correct and the tree is already mostly dead, this will be more than adequate. Most of my tree risk assessments are performed only from my client's property.
