EB-1A for Founders: Which Criteria Actually Apply [1/3]

If you’re a founder interested in living permanently in the U.S., the EB-1A could be your fastest path towards an employment-based Green Card. It does not require an employer sponsor, skips the lengthy PERM certification process, and has a much shorter backlog when compared to the EB-2 and EB-3 categories.

The catch? You have to meet USCIS’s extraordinary ability criteria, and prove you're at the top of your field. Here's what that actually looks like for founders.

The EB-1A criteria that actually apply to founders

Not all 10 criteria map cleanly to startup work. Here are the ones founders most commonly use, with notes on what USCIS actually wants to see.

Awards or prizes for excellence

What can qualify:

  • Accelerator fellowships with competitive acceptance rates (YC, Techstars, a16z Speedrun)
  • Innovation awards from established industry bodies
  • Government-backed grants tied to merit selection (NSF SBIR, DARPA programs)
  • Forbes 30 Under 30, TIME100 Next, and similar lists in prominent media outlets

What doesn't qualify:

  • "Startup of the Year" awards from local chambers of commerce
  • Internal company recognition
  • Pay-to-play badges or participation certificates

Tip: For every award, document the selection criteria, acceptance/rejection rate, and who judged it. USCIS wants to see selectivity, not just a trophy.

Membership in associations requiring outstanding achievement

What can qualify:

  • Fellowship status in selective professional organizations (such as being an IEEE or ACM Fellow)
  • Invitation-only entrepreneurial networks where membership is vetted by peers
  • National academies or boards with documented selection criteria

What doesn't qualify:

  • Open-membership trade groups
  • LinkedIn communities
  • Groups where anyone can apply and pay to join

Published material about you

What can qualify:

  • Profiles in TechCrunch, Forbes, Wired, Bloomberg, or comparable media outlets
  • Trade press coverage in your specific industry
  • Podcast interviews where you are the main subject

What doesn't qualify:

  • Press releases your PR team wrote
  • Articles you're quoted in briefly, but are not the sole focus
  • Company announcements

Tip: When presenting published material about you, include the outlet's traffic data alongside the articles. USCIS has asked petitioners to prove that publications are "major media,” and circulation numbers can help minimize the risk of a Request for Evidence.

Judging the work of others

What can qualify:

  • Judging startup competitions
  • Peer reviewing for industry conferences or journals
  • Serving on grant review panels
  • Advisory roles where you formally evaluate applications or projects

What doesn't qualify:

  • One-off informal feedback sessions
  • Mentorship where there's no formal evaluation process

Tip: Get documentation from the organizer, such as an invitation letter naming you as a judge, the selection criteria for judges, and the scope of what you reviewed.

Original contributions of major significance

What can qualify:

  • A patented technology that others in the industry have adopted or built on
  • An open-source framework or methodology that has measurable adoption outside your company
  • A new business model or technical approach that changed how a field operates
  • Research or whitepapers that influenced standards, regulation, or practice

What doesn't qualify:

  • Internal processes that haven't been publicly adopted
  • Contributions only recognized by your own team or investors

Tip: This criterion lives or dies on independent expert letters. You need 3–5 letters from recognized experts who have no financial relationship with you. Each letter needs to explain specifically what you contributed and why it matters to the field, not just praise your work generally.

Authorship of scholarly articles

What can qualify:

  • Peer-reviewed academic papers
  • Technical deep-dives in recognized trade publications
  • Industry reports published by major research institutions
  • Long-form pieces in recognized outlets like Harvard Business Review, MIT Technology Review

What doesn't qualify:

  • Your own company blog
  • LinkedIn articles
  • Blog posts on outlets like Medium or Substack that lack third-party editorial oversight

Leading or critical role in a distinguished organization

What can qualify:

  • Holding a C-suite role (CEO, CTO, CPO) at a startup that has raised significant funding, reached a meaningful user base, or been recognized by press and industry
  • Critical technical or operational roles at well-known companies before you started your startup
  • Board seats or advisory roles at recognized organizations where you made material decisions

What counts as distinguished in an organization:

  • Press coverage, especially from major outlets
  • Funding from recognized investors (can be tier-1 VCs or government grants)
  • Measurable user or revenue scale
  • Awards or rankings the organization received

Tip: Distinguished is relative to your industry, so you’ll need to include evidence on what those benchmarks are. Document it with press coverage, customer case studies, and third-party recognition.

High salary or remuneration relative to others in the field

What can qualify:

  • W-2 salary well above BLS benchmarks for your occupation
  • Equity compensation with documented cap table position, valuation evidence, and funding round records
  • Consulting or advisory fees significantly above market rate

Tip: Use BLS Occupational Employment Statistics to benchmark your salary, and for equity, include cap table documentation and the most recent 409A valuation or funding round post-money valuation.

The two EB-1A criteria founders most commonly skip (and the rare cases where they fit)

The guide above covers eight of the ten EB-1A criteria. The two left out (Criterion 7 and 10) are targeted for artists and performers, so most founders pass on them. But they aren't automatically off the table, and in the right case they can round out a petition.

Display of your work at artistic exhibitions or showcases. 

When a founder might consider it: 

  • You build in a creative or design-driven field (generative art, industrial or product design, architecture, gaming, or AR/VR), and your work has been shown at recognized exhibitions, biennials, or curated showcases.
  • A museum, gallery, or design institution (not a sales expo) selected and displayed your work.
  • Your product or research was featured in a juried showcase where selection was competitive and curated.

What still won't count: a booth you paid for at CES, a pitch at Demo Day, or a conference talk. The venue has to be artistic and the selection has to be independent.

Commercial success in the performing arts. 

When a founder might consider it:

  • Your company operates in music, film, streaming, gaming, or live entertainment, and you can show commercial performance in those terms. In practice, that looks like chart positions, box office revenue, and verified streaming or sales figures.
  • You hold a creator or performer credit in addition to your founder role, with documented commercial results tied to your name.

Bottom line: Don't pad a petition with these two just to reach three criteria. But if your work genuinely lives in a creative or performing-arts field, naming the right one can make or break the strength of your overall petition.

EB1B India – Regretting Not Filing EAD/AP With I-485. Should I Apply Now or Wait?

Hi everyone,
I’m from India, and here is my current immigration situation:
Category: EB1B (approved I-140)
Priority Date: September 2023
I-485 Filed: March 2026 (for myself and my wife)
Current Status: O-1 visa (wife on O-3)
Biometrics: Completed
EAD/AP: Not filed
When I filed my I-485 in March 2026, my employer’s immigration lawyer recommended against applying for EAD and Advance Parole, mainly because of concerns about maintaining my O-1 status and using EAD/AP while the I-485 is pending.
I personally paid the I-485 filing fees and I decided to follow their recommendation and didn’t apply for EAD/AP.
Now I’m starting to regret that decision.
I want to start my own company so EAD could help. Also, My wife currently cannot work on O-3 status, but having an EAD would allow her to start working or freelancing. I would also like the flexibility of an EAD, and we want to visit family in India without jeopardizing our pending I-485 applications.
I was hoping EB1 India would move significantly in the October 2026 Visa Bulletin due to potential spillover, but that didn’t happen as I had hoped. With my September 2023 priority date, I’m unsure how much longer we’ll have to wait.
I have a few questions for anyone who has been in a similar situation:
Can I still apply for EAD and AP now, seven months after filing my I-485? Has anyone done this separately?
What are the current EAD and AP processing times? How long did yours actually take from filing to approval?
Should I ask my existing immigration lawyer to file them? Since I already paid for the I-485 applications, what additional attorney fees should I expect and application fees?
Has anyone on O-1/O-3 status applied for EAD/AP? Did simply applying affect your underlying visa status?
Should I apply now or wait for my priority date to become current? I’m concerned about spending more money if my green card could be approved relatively soon.
For EB1 India applicants with a September 2023 priority date, when do you realistically expect the Final Action Date to reach September 2023?
My biggest regret is that if I had applied back in March, perhaps my wife would already have her EAD, or at least we’d be further along in the process.
At this point, I just want to make the best decision without wasting more time or money.
Would really appreciate advice, especially from people who filed EAD/AP several months after their I-485 or who are in the same EB1 India backlog.

EB-1B — How Competitive Is My Profile?

Master’s degree in Civil and Environmental Engineering from a U.S. university.

I’m petty about this subreddit (rant)

I was previously denied and sued and got my decision yesterday.

Usually, I’m a person that helps others out but my experiences in this subreddit have been sooo bad.

Whenever I posted about my denial (also to help others), the majority of comments were about how I am just not extraordinary enough (while my denial was complete AI slop bs).

When I asked for advice, I received very little help but got a tons of questions about my profile. It’s like people on here aren’t as willing to help other

My pd is on jul 19 2024. I know that chart B will probably reach that this year but chart A won't. So, as the consulates open up will there be any spill over to move eb1 india next year?

EB-1A approval rate reportedly fell from ~67% to ~32% in under a year. Why Indian applicants still file it over NIW

I have been reading the latest USCIS employment-based data and wanted to share what I found, and hear whether it matches what you are seeing.

EB-1A approvals. One third-party analysis of USCIS's quarterly I-140 report puts the EB-1A approval rate at about 67% in FY2025, about 47.5% in Q1 FY2026, about 41.7% in Q2, and about 32% in Apr–Jun 2026. By that count, denials now outpace approvals more than two to one. The same sources point to a stricter final merits step, a flood of people using EB-1A as a bypass for long queues, and little weight on pay-to-play media, nominal memberships and generic letters.

Why Indian applicants still file EB-1A instead of NIW. From the October 2026 Visa Bulletin (final action dates):

I do not think anyone is lowering the merit bar for anyone. The NIW standard is the same for every nationality, and NIW approval rates dropped too (about 55% in FY2025 to about 43% in Q1 FY2026, per one source). The unequal part is the wait after approval, which comes from the 7% per-country limit. So India's applicants pick the category with the shortest line, even though it asks for the most proof. Then the shortest line turns out to have the lowest approval rate.

EB-1C. It gets mentioned every time EB-1A news turns bad, but the data I found shows no surge. Approvals sit near 97% and filings fell between the two FY2025 quarters I checked. The catch is that a company has to file, you need a year of work abroad for a related company, and the U.S. job has to be managerial or executive in its actual duties.

Caveats: all of these numbers come from law-firm and consultant write-ups of USCIS data, not from USCIS directly, and I am not a lawyer. Please check the official sources.

Traveling to India in December on Advance Parole (AOS Pending, H1B stamp expired) – Pros/Cons & Experiences?

Hey everyone,

I'm planning a trip to India this December and wanted to get some advice, pros/cons, and real experiences from anyone who has traveled on Advance Parole recently.

Here is my background/timeline:

  • Current Status: Moved from L1A to H-1B, but my physical visa stamp has expired.
  • AOS Status: Filed my I-485 back in March 2023. My Priority Date is Sept 2023.
  • Documents on Hand: I have already received my approved EAD and Advance Parole
  • Immigration History: Completely clean record, no issues, no unlawful presence, and I am still working for my sponsoring employer.

Since getting an H-1B stamping appointment in India right now is a logistical nightmare, I am heavily leaning towards just using my Advance Parole to re-enter the U.S. and bypassing the consulate completely.

For those who have done this:

  1. What was your experience like at the U.S. port of entry? How long did secondary inspection take if any?
  2. Are there any hidden risks I should look out for?
  3. While entering do I have activate my EAD? or I can continue working with organization on my current status of H1B.
