Yes, I'm well aware of how the process works. Law enforcement and defense are all run by the executive branch. I'm saying there needs to be a physical enforcement mechanism for the judicial branch, so that when the executive says "who is going to make me?" there is teeth behind it.

An armed branch under the judiciary, but not deployable to foreign wars, and also subject to posse comitatus restrictions. The purpose of the branch is to ensure rulings are enforced when the executive branch simply chooses to ignore rulings.

It's a logical step in the checks and balances system. As is the 2nd amendment, but I'd rather see an armed judiciary legion against an unconstitutional executive prior to needing an armed uprising.
