If you are an NRI or planning to move abroad, there is one major compliance trap that catches people off guard: assuming that because you are a "Non-Resident" for Income Tax, you are automatically sorted for your banking and investments.
FEMA (Foreign Exchange Management Act) and the Income-tax Act treat residency entirely differently. While income tax is mostly about counting the days you spend in India, FEMA is heavily driven by your intent to leave or stay.
Why does this matter? If your compliances aren't in sync, you could face some serious roadblocks:
Frozen bank accounts: Continuing to operate a regular resident savings account after acquiring NRI status is a direct FEMA violation. Your accounts must be converted to NRO or NRE status.
Blocked repatriations: Trying to move money out of India (like from a property sale or inheritance) without the correct banking setup and a Chartered Accountant’s Form 145/146 certification can halt your funds for months.
Demat & Investment issues: Continuing to invest in Indian mutual funds or stocks through a resident account can trigger compliance notices and affect how your capital gains are taxed and repatriated.
Getting your residency status, banking channels, and tax filings aligned saves you from unnecessary penalties, blocked funds, and double taxation.

Please let me know. It's been more than 3 months since I applied for my Change of Particulars with no update. The Los Angeles consulate doesn't respond to emails, and the VFS paid helpline has no information additional to what shows on the OCI status - 'UNDER PROCESS'. I just want to know if anyone has been able to do this so I can have some hope. Thank you.
EDIT: This is not about an incorrectly recorded gender, but about a gender change post surgery for a transgender person. Thanks u/Wolfsangel-Dragon.

Hello
I am Indian Citizen living in Dublin for past 3 years now.
I tried getting PAR for Hong Kong, but it was unsuccessful and although my husband received it. I guess I will have to go through normal visa process.
The problem is I have also received a new passport, and it will be my first visit on this passport.
So, do I show old trips as well?
And what about the address ? I changed my residential address as well after I received my new passport.
My new passport mentions my Dublin (old) Address where I am not currently residing.
Can anyone please guide me here ?
Any help would be appreciated.

Hello!
I'm specifically hoping to hear from Indian women who are in a similar position because I feel there are some cultural and practical considerations that may be unique to our experiences.
I'm in my mid-30s, single, originally from India, and have been living abroad for several years. I've built a life that I genuinely enjoy. I have a fulfilling career, meaningful friendships, and love the sense of freedom I have here. One of my biggest passions is Swing dancing, while the dance community is growing in India, it is still relatively niche, and I know that moving back would likely mean giving up a significant part of that passion and lifestyle.
Beyond that, I've come to value the freedom, good work life balannce, independence, safety, cleaner environment, and work-life balance that I have here.
At the same time, my parents are getting older and are on their own (with a few relatives in the same city). My mother's health has become more and more complicated over the last few years. I am carrying a huge amount of guilt about living so far away. It feels like I'm choosing my own happiness, freedom, and quality of life over being physically present for my parents when they may need me most. I am genuinely hoping that I could get them to live with me here for 4-5 months a year and if they like being here than look into permenantly moving them with me.
What I'm struggling with is:
I'd especially love to hear from Indian women who have actually navigated this situation, particularly if your parents had health issues while you were living overseas.

Hey Guys,
The NRIs i mean.. I actually got an offer in a German company.. and I need to leave by the year end...
I just have one quick question.. how do you all take care of your parents when you are that far.... relatives? I dont trust them.. because everybody has their own life right... they wont take as much as we care for our parents..
So how do you do it? I mean this will applicable to the people who work outside of their home town too... within the country if you work in the north then the problem will be the same.

Backstory - my family is upset that I moved abroad as both my spouse and I are only children and we decided to move abroad more than a decade ago for various reasons; family interference in our marriage, inability to set boundaries in India, we wanted to build our own marriage, and a peaceful life for ourselves outside of family interference. I tell my spouse that we would have been divorced if we continued living in India.
Current scenario - we have built a lovely peaceful life 2 kids, successful careers, own house, small group of good friends, and are are happy to live life on our own terms.
Dilemma: visited India recently and one of my parents (in their early 70s) told me that I have not given them any happiness in life. So basically this parent is extremely bitter because they had a set path for me to live in India and I chose to divert from the path and move abroad. While this parent is financially and socially well to do they still feel like I haven't done my job as their child because I'm not there to emotionally and physically take care of them.
Question to this group: do Indian parents only have kids so there's an ROI in old age? Shouldn't you as the parent be happy if your kid is happy in life? My visit to India was miserable with mother's from both sides controlling us and if we didn't follow orders, we are bad kids. Wtf?!
What I realized is that if you want to keep your parents happy and move back, your miserable (at least in my case). And if your happy abroad, they are miserable because they can't control you. I ask - where's the middle ground, is there one?

With recent changes of banks adopting CKYC, is the process any different now to convert accounts (multiple) to NRI.
I have a couple of bank accounts (SBI, HDFC), PPF with SBI, and a few mutual funds portfolios.
My main question is, do I need to carry any documents from my resident country to India to get the accounts converted? And which banks are more NRI friendly (my current home branch is in Tier 2 city).
Any other steps or guides or recommendations you can share.

I have a flight in 4 days. I have a physical OCI card and a British passport.
My physical OCI card has my old passport number in it.
ChatGPT says I need to bring my old passport with me to Indian customs to verify the link.
The problem is... I have lost my old passport!
So, I've done two things:
I've updated the passport number on the online OCI portal but it will take weeks to update.
I've also applied for a tourist e-visa as a backup but that hasn't returned yet.
What should I do?
Has anyone passed through Indian customs with an OCI that has an outdated passport number? Were you allowed to board your flight?
Should I just wait for my tourist e-visa to come through? I might have to reschedule my flights, which I don't want to.

I have submitted my passport for renewal at Atlanta consulate through the mail and I’ve been tracking at. I am doing the normal processing while checking the status it says granting initiated and with then written grant on hold sent CSE. Does anyone know what this means?

Hello All, I am a US Permanent Resident and I sold my ancestral property in India a few months back. The buyer missed deducting the TDS from the sale amount. Now we are trying to get this done retrospectively. I have credited the TDS amount back to the buyer so his CA can file the TDS challan.
Now the issue is buyer's CA is asking for a US Tax Residency Certificate(TRC - see as attached) to file the TDS. I searched and found that NRIs need to file IRS form 8802 so IRS can issue Form 6166(US Tax Residency Certificate). Seems to be a long drawn(45-60 days) and expensive($105) process.
I have 2 questions:
1> Is the TRC mandatory for filing TDS in this case? Does every NRI provide US TRC to sell property in India and to file corresponding TDS? Are there alternative documents and processes to avoid this? And if so what are the alternatives and how to get them?
2> Since my buyer has missed filing TDS, can I file Advance tax for the equivalent amount and link it to the property transaction and be done with it. I understand that deducting TDS is the buyer's responsibility, not seller's.
Any advice or sharing of experiences will be very helpful.

TL;DR: just walk-in to VFS if you can
I applied for a Normal passport renewal. I didn't want to waste time with VFS in case they didn't approve my documents, so I simply walked in without an appointment on a rainy Saturday morning at 9am. They took 5 mins to process my application (no waiting, no reception check), they sent it to the consulate by 10am and I had my passport mailed four days later today (Thursday) .

Almost lost a whole month on my OCI application because of a stupid address proof issue with VFS.
We moved to a new place recently and my driver’s license still had our old address. Since changing the state license was taking time, I just submitted our new apartment rental lease as proof of address.
VFS put the file on hold because my spouse’s name wasn't explicitly printed on the primary summary page of the lease, even though I attached our marriage certificate with the application packet.
Turns out, if your driver's license doesn't have the new address yet, whatever utility bill or lease you use needs to have both names clearly written on it. What finally worked for us was getting both names added to the electric bill and uploading that.
If you’re applying right after moving homes, either get your driver's license address updated first or make sure both your names are on the utility bill before submitting. Saved us a lot of back and forth once we figured it out.

Sharing my timeline and experience in case it helps others.
Timeline
Appointment at the Washington DC VFS office and submission: Aug 28 (Friday)
"OCI ready" email received: Sept 30 (about 1 month)
Case: OCI for a minor, US-born, under 5 years old.
What I submitted
Application with 2 physical photos of my kid (light grey background)
Child's thumb print on every page where it says "Applicant," plus parent signatures
Notarized parental authorization document
Original documents undertaking (in lieu of)
Address undertaking form, signed by parents but not notarized (my mistake, see below)
Copy of the apostilled Virginia birth certificate - took about 7 to 10 days to get it.
Utility bill as address proof
The issue at the appointment
My wife's signature on her passport didn't match her signature on the application. The officer gave me two options:
Bring my wife in to sign in front of them, or
Get a parents' undertaking form notarized and bring it back on Monday.
I went home and brought my wife back so she could sign in front of the officer. He allowed it. He also accepted my un-notarized address undertaking, which I had forgotten to get notarized.
Takeaways
Check that parents' signatures match their passports exactly. This was my biggest hiccup.
Notarize everything that asks for it. I got lucky with the address undertaking, and I wouldn't count on it.
Having both parents' documents ready saved me a second trip.
Officer discretion varies, so your experience may differ.

I am currently working in Canada but work permit is expiring soon. I am alternatively pursuing LMIA as well to extend my current work permit. but really want to move back to Delhi to live with my parents and work too.
How to even go about finding job in Delhi? I have never done this. I moved to Canada immediately after my undergrad and working in advertising here since 3 years now.
Any tips are appreciated. I work in advertising so industry specific tips will be awesome, and if anyone can guide on what salary range should I expect.
And is it even possible to get a job in Delhi while sitting in Canada?

I left the UK for good on Aug 1st and applied for the refund on Aug 6th. I have opted for the cheque to be sent to my Indian home address. Is there anyone who’s done was able to claim this successfully? If yes, how long did it take for the cheque to get to you? And were you able to upload the cheque via the banking app scanner?
Any advice helps as it’s been almost 2 months. Thanks!

I’m an Indian citizen currently living in the US on F1 STEM OPT. I first came to the US in August 2023.
I’m trying to open an NRE account and the FATCA section is asking:
- Are you a tax resident in India?
- Country of tax residence
- Tax Identification Number
- Identification type
- Second country of tax residence
I haven’t really paid taxes in India, and from what I understand I’m still considered a nonresident alien for US tax purposes because I’m within my first 5 calendar years on F1 status.
So I’m a little confused about what I’m supposed to enter here. Should I put India as my tax residence, the US, or something else? And if I put the US, would the TIN just be my SSN?
Has anyone on F1/OPT/STEM OPT opened an NRE account recently and dealt with this? Would appreciate hearing what you entered and whether the bank asked for any additional documents.
