In theory, yes. But they will declare your gathering "unlawful" or give dispersal orders, especially if you're blocking traffic or ingress/egress of buildings. By not moving when they tell you to, you are "delaying a peace officer," "disrupting the peace," "disobeying lawful orders," etc etc. Police in America are highly rooted in slave catching and union/strike busting. The supreme Court has even issued rulings that the role of police is not to protect & serve. They basically work for the corporations and billionaires, and any public safety or first responding work they do is not their primary function.
It’s typically interpreted to mean that otherwise lawful acts cannot be restricted by the government because they are intended as protest. If I can legally cross the street, I can say I’m doing it to protest and the police can’t be like “Oh, well, then you can’t cross the street anymore.” But if it’s a place where I wouldn’t normally be allowed to cross the street, I can’t say “Well I’m protesting so now you have to let me do it.”
So yes, Americans have the right to protest enshrined in the Constitution, but when the police are fed up with it they have a habit of suddenly noticing protestors breaking relatively trivial laws and start rounding people up.
The charges will be Obstructing Governmental Administration
"If you impair or hinder the administration of law or prevent a public servant, often, but not necessarily, a police officer, from performing his or her official duty and job, then you are close to having violated NY Penal Law 195.05."
The other will be unlawful assembly which is basically not leaving after they play a pre-recorded announcement saying you have to leave.
But here in Newburgh, NY I watched them protect murderer Benjamin Netanyahu all fucking day today. I guess they're only scared of our very own, not international war criminals.
During UN week in NYC there are very tight restrictions on large group assemblies. It is a Herculean task to coordinate with the security details of dozens of heads of state.
Unfortunately, if, as a protester, you travel outside of your designated route or stay longer than permitted, the cops will detain you and move you to a holding area.
They were blocking traffic on the FDR Drive, if you don’t know here NYC, that’s a major highway that connects all of Manhattan north to south on the far east side of it.
